INFORMATION

The Undersigned Assistant City Prosecutor hereby accuses JOHN

MICHAEL V. PALANCIO and ISHMAEL B. ARUMPAC of the crime of
Theft committed as follows:

That on or about August 10, 2021, in the City of Cagayan de Oro,

Philippines, within the jurisdiction of this court, the above-mentioned
accused, did then and there willfully, unlawfully and feloniously, without
force upon things or violence upon persons, with intent to gain and without
the knowledge and consent of the owner, took 10 units of Apple 12.9-inch
Pro Wi-Fi iPad Air 5th Generation with the following serial and/or model
numbers, to wit:

The above-enumerated units have 128GB storage with the value of

SIXTY-FOUR THOUSAND NINE HUNDRED NINETY PESOS (Php
64,990.00) each, with the total amount of SIX HUNDRED FORTY-NINE
THOUSAND AND NINE HUNDRED PESOS (Php 649,900.00) for the
ten (10) units, belonging to JOHAYMAH D. BAGUL, owner of Abenchon
Technologies located in Centrio Ayala Mall of Cagayan de Oro City, to the
prejudice of said owner.

That in the commission of the said offense, both accused committed

grave abuse of confidence, them being then employed as Inventory Clerks of
Ms. Bagul at the time.

That the act be committed with abuse of confidence or obvious

ungratefulness, with evident premeditation and with treachery.

CERTIFICATION AS TO CONDUCT OF INQUEST

I hereby certify that the accused was lawfully arrested without a

warrant and that, upon being informed of his rights, refused to waive the
provisions of Article 125 of the Revised Penal Code and, for this reason, an
Inquest was conducted; that based on the complaint and the evidence
presented before me without any countervailing evidence submitted by the
accused, despite opportunity to do so, there is reasonable ground to believe
that the accused has committed the crime of theft and should, thus, be held
for said crime; that this Information was with the prior authority of the City
Prosecutor.
