AFFIDAVIT – COMPLAINT
I, JADE CARLOS DEL MUNDO, of legal age, Filipino and a resident of 420 Telabastagan San
Fernando Pamapanga, after having been sworn to in accordance with law hereby depose and
state:
1. That am accusing JUAN LAZATIN a resident of 230 Telabastagan Sanfernando Pamapanga
for the crime of THEFT.
2. That on April 11, 22. About 3:00 pm I was outside of my house to prepare my motorcycle to
buy some food;
3. That on that same date, I accidentally left my iPhone X in the pocket of my motorcycle Mio,
due to I left my wallet inside the house to buy some food. When I came back my phone was
missing.
4. As standard procedure, I verbally reported the incident to the barangay in our place and they
promise to look and review the CCTV footage in our area;
5. April 12, 2022, after they review the CCTV footage in our area and from the time where I park
my motor in the front of our house;
6. Upon checking it, MR. JUAN LAZATIN was caught in the camera where he was the one who
steal my phone after I go inside in our house;
7. At this juncture, myself, MR. JAMES BAKAL, the barangay official who review the CCTV
footage and call the attention of MR. JUAN LAZATIN after confirming it;
8. Upon checking the phone’s IMEIs, we found out that it was a complete match;

9. When we asked JUAN LAZATIN why he stole my phone why he stole my phone, he denied
stealing the same, and argued that he bought it from its own money;
10. Respondent JUAN LAZATIN, despite my objection, asked us to allow to him to get the
receipt of the phone when he bought it, however he never returned nor did he show proof of his
rightful possession of my cellular phone;

11. Later on, he informed me that he had lost the cellular phone;

 THEFT
 Art. 308. Who are liable for theft. — Theft is committed by any person who, with intent to gain
but without violence against or intimidation of persons nor force upon things, shall take personal
property of another without the latter’s consent.
Theft is likewise committed by:
 Any person who, having found lost property, shall fail to deliver the same to the local
authorities or to its owner;
12. That attached hereto as Annexes to prove the elements of the crime of theft:
“A” –  Warranty Receipt of the stolen phone indicating the name of the buyer and its respective
IMEIs (International Mobile Equipment Identity);
“B” – Sworn Affidavit of the barangay official MR. JAMES BAKAL, to prove and attest that the
IMEI of cellular phone in possession of JUAN LAZATIN matches the IMEI of the cellular phone I
bought;
“C” - Signed statement of JAMES BAKAL dated April 12, 2022;
“D” - Incident Report dated April 12, 2022 which I sent to our barangay official to review the
CCTV footage in our area to look JUAN LAZATIN in possession of a cellular phone which he
was caught stealing my phone;
“E” - Photographs of the stolen phone;
“F” – Photographs of the Product Box, indicating the IMEIs of my cellular phone, to prove the
phones unique identity.

That I am executing this Complaint-Affidavit for the purpose of filing the complaint for
THEFT against MR JUAN LAZATIN.
IN WITNESS WHEREOF, I have hereunto set my hand this 08 day of May 2022, in San
