Ram Bahadur was a student and was preparing for UPSC examination with
collage. During that time, he fallen in love Usha, a medical student. Both fall in
love and came to close to each other, and they made physical relations with
each other. After Ram cleared IAS exam, he refused to marry Usha and said his
parents are against the marriage because Usha is of backward class and refused
to marriage. Usha then filed case of rape against the Ram. Rape, according to
Article 21 of the Indian Constitution, violates the victim's fundamental right. It
is the most morally and physically revolting crime in society since it violates the
victim's body, mind, and privacy. Rape is committed under Section 375 of the
Indian Penal Code. Rape occurs when a man has sexual contact with a woman
against her will, unless one of the exclusions stated in the section applies.
Women's permission is essential in this situation. And if consent is obtained by
making a fake promise of marriage and a man engages in sexual intercourse
with a woman while making a false promise of marriage, the IPC considers it
rape. This illegal intention and assent must be obtained fraudulently or by
making false promises. If a person commits this crime, he or she is guilty of
rape under the IPC. If a man agrees to marry and has sexual relations with
women and is unable to marry the girl owing to an unusual circumstance, he is
not guilty for rape because men do not have any malicious intent.
So, rape occurs when there is no consent taken from women or consent taken
false promise of marriage. When two adult male and female mutually agrees to
in their healthy condition of mind then the sex happened between them is not
rape. In case of Ram and Usha both mutually decide to have physical relations
consent was not taken forcefully or fraudulently by Ram. And Ram never
promised to Usha that he will marry her or even he wanted to but his family
members were against this marriage. So the case of complain of Usha will be
quashed
