CHAPTER 41:01

RECREATION GROUNDS AND PASTURES ACT

An Act to provide for the regulation of Public Recreation 1950 Ed.


Ch. 40. No. 3.
Grounds and Pastures. 10 of 1909.

[24TH MARCH 1909] Commencement.

1. This Act may be cited as the Recreation Grounds and Short title.
Pastures Act.

2. (1) The Minister may make Rules and Regulations as to Rules and
Regulations.
the use by the public of any public recreation ground or pasture, as
to the times during which, and the terms and conditions under
which, persons, horses, and carriages and other vehicles, cattle
and other animals may be admitted to any such ground or pasture.
(2) Any person who contravenes any such Rules and
Regulations is liable, on summary conviction, before a Magistrate
or Justice, to such penalty as is provided by the Rules and
Regulations, or, if no penalty is so provided, to a fine of one
hundred dollars.

3. Any constable within the meaning of the Police Service Power to arrest.
[21 of 1990].

may arrest without warrant any person who, within his view,
commits any breach of any rule or regulation made under this Act,

conveniently brought before a Magistrate or Justice to be dealt
with according to law.

4. This Act shall not apply to the Queen’s Park in Queen’s Park.

1. These Regulations may be cited as the Arima Citation.


Savannah Regulations.

2. The control, management and maintenance of the Arima Control,

pipe or cock;
(b) sit upon or damage any fence, gate or turnstile;
(c) commit any nuisance by depositing any offensive
matter or rubbish;
(d) throw, deposit, or leave any bottles or glass,
broken or otherwise, or any earthenware or
old iron;

(e) wilfully damage any seat, walk, footpath, cricket


pitch, or other specially prepared recreation
ground registered under these Regulations;
(f) cut, trim, uproot, damage or destroy any tree,
shrub or plant;
(g) dig any earth, cut any grass, or remove any turf,
manure or grass without permission from the
Chief Executive Officer;
(h) discharge any firearm without the authority of
the Chief Executive Officer;
(i) drive any cart, save with the special leave of the
Chief Executive Officer;
(j) wilfully neglect or refuse to obey the lawful
orders of the Chief Executive Officer or any
person authorised by him or of any member of
the Police Service;
(k) set or light any fire;
(l) molest, obstruct or annoy any person or persons
engaged in or looking on at any game or
recognised sport or pastime on any ground
registered for that purpose;
(m) use any obscene language, throw any stone or
other missile or otherwise conduct himself in a
disorderly manner to the annoyance of the public,
every such person shall be deemed guilty of an offence and is liable
on summary conviction to a fine of two hundred dollars.

Applications. 7. Applications by Clubs for permission to use particular sites


for cricket or other forms of recreation must be made to the Chief
Executive Officer, who will register the application and allot sites
in such localities as may in his discretion be suitable and convenient.

Allotting site. 8. No site shall be allotted for a term of more than one year
at any one time.

10. No person shall— Prohibition.

(a) sit or lie down on the paved or gravelled paths


or commit any nuisance on any of the footwalks
or pavements around the Arima Savannah;
(b) climb or stand or sit on any part of any railing or
on any tree on the footwalk or pavement; or place
or expose for sale any goods, merchandise, or
provisions on any such footwalk or pavement;
(c) make use of any such footwalk or pavement for
the purpose of shaving or clipping, or cutting
the hair of any person or of any animal, or for
tethering or keeping any animal on any such
footwalk or pavement;
(d) play any football, cricket, or other dangerous
games on any such footwalk or pavement;
(e) use any part of any such footwalk or pavement
for skating with roller skates;
(f) stand or lie down on any bench, or sit on the arm
or back of any bench on any such footwalk or
pavement, or affix any placard posting-bill or
advertisement against or upon any bench, railing,
shelter, tree or statue on any such footwalk
or pavement;
(g) wilfully break, destroy or damage any part of any
such bench, railing, shelter or statue on any such
footwalk or pavement; or
(h) wilfully break, destroy, damage, take away or
interfere with any tree, shrub, flower or plant on
any such footwalk or pavement.

11. It shall not be lawful for any person to lead, ride or Footwalks or

other child’s vehicle) on any of the footwalks or pavements around
the Arima Savannah.
Penalty. 12. Any person who contravenes regulation 10 or 11 is liable
on summary conviction to a fine of forty dollars.

REGULATIONS
made under section 2

Citation. 1. These Regulations may be cited as the Paradise Pasture


(San Fernando) Regulations.

Interpretation. 2. In these Regulations “the Pasture” means the Paradise


Pasture, San Fernando.

shrub or plant;
(h) digs any earth, cuts any grass or removes any turf,
manure or grass without permission from the
Superintendent of the Pasture;
(i) discharges any firearm without the authority of
the Minister;

person authorised by him or of any member of
the Police Service;
(l) rides or drives furiously any animal or vehicle to
the danger of the public;
(m) sets or lights any fire;
(n) molests, obstructs or annoys any person or
persons engaged in or looking on at any game or
recognised sport or pastime on any ground
registered for that purpose; or
(o) uses any obscene language, throws any stone or
other missile or otherwise conducts himself in a
disorderly manner to the annoyance of the public,
such person shall be deemed guilty of an offence and is liable on
summary conviction to a fine of two hundred dollars.

1. These Rules may be cited as the Recreation Grounds Rules. Citation.

2. (1) Each recreation ground specified in the First Schedule Use of

(b) allot the recreation ground or any part thereof on
any day or part thereof for the use of any particular
person, school, club, society or other organisation;
(c) close or authorise the closure of such recreation
grounds or part thereof to the public on such days
(not exceeding fifty-two days in any year nor
seven consecutive days on any one occasion nor
two Sundays a month) and on such terms and
conditions as the Council thinks fit, for use by

any person, school, club, society or other


organisation for any purpose authorised by
subrule (1);
(d) charge an admission fee to any recreation ground
or part thereof closed to the public; and
(e) permit any person, school, club, society or
organisation to charge an admission fee to any
recreation ground or part thereof closed to the
public, if the proceeds or the admission fee are to
be given to some charitable or sporting
organisation approved by the Council.
(4) Applications for permission to use a recreation ground
shall be made in writing to the Council for the County in which
the recreation ground is situated.
(5) A Council desiring to close the recreation ground or
part thereof otherwise than in accordance with subrule (3)(c) shall
obtain prior approval from the Minister to whom responsibility
for local government has been assigned.

(e) wilfully damages any seat, walk, footpath, or
specially prepared part thereof;

shrub or plant;
(g) digs any earth, cuts any grass, or removes any
turf, manure or grass, without the permission of
the Council for the County in which the recreation
ground is situated;
(h) discharges any firearm, or throws, casts, sets fire
to, or lets off any fireworks, without the authority
of the Council for the County in which the
recreation ground is situated;
(i) wilfully neglects or refuses to obey the lawful
orders of any person authorised by the Council
for the County in which the recreation ground is
situated or any member of the Police Service;
(j) rides any animal, or leads any animal, except a
dog, or drives or pushes any vehicle, except a
perambulator or other hand-carriage for young
children or such other vehicle as may be permitted
by the Council for the County in which the
recreation ground is situated;
(k) sets or lights any fire;
(l) molests or obstructs or annoys any person
engaged in, or who has made preparation to
engage in, or who is a spectator at, any permitted
game, sport or pastime;
(m) creates any obstruction on any walk or drive;
(n) uses obscene language, throws any stone or other
missile, or otherwise conducts himself in a

disorderly manner to the annoyance of the public


or young children respectively;
(o) tethers or allows to trespass any animal;
(p) wilfully interferes with or obstructs the authorised
user thereof;
(q) erects or places thereon any booth, tent, shed,
stand, screen, post, rail, fence, swing chair or seat
or other erection or obstruction of any kind
whatsoever without the authority of the Council
for the County in which the recreation ground is
situated;
(r) does, aids in, or abets any act or thing which may
not in these Rules be specifically mentioned and
which may tend to the injury, disfigurement
thereof or to interference with the use thereof by
the public or by young children respectively for
the purposes of exercise and recreation,
is liable on summary conviction to a fine of two hundred dollars.
