[GENDER INEQUALITY]

The gender inequality is one of the the most


discussed issues in the world and indian media.But gender
inequality are mostly discussed about the inequality
against the women.the inequality against transgender is
the least discussed issue in the world and Indian
media.Whereas they are facing huge discrimination in the
society,workplace and in the public place also.
First of all we all need to know that what exactly
transgender is-A transgender person is someone whose
gender identify or gender expression does not correspond
with their sex assigned at birth.
Actually transgender is an umbrella term.In addition
to trans man and transwomen, it may also include people
who are non binary or genderqueer.Other definition of
transgender also include people who belong to a third
gender,orelse conceptualise transgender people a third
gender and the term may be defined very broadly include
cross-dresses.The tansgnder people may be of any sexual
orientation.
Transgender inequality is the unequal protection
received by transgender people in work,school and society
inn general.Transgender people regularly face so many
problems in our country india also and that is
{A} DISCRIMINATION IN EMPLOYMENT- Transgender
people face huge discrimination in employment and at
work place.We have some example of it also-

[1]- Kabir who is a 30 years old transman shares


his experience as a transgender to ‘’the hindu’’
correspond .Kabir remembers his school days when
classmates were confused and abusive.once he went
for a school teacher job interview and the panel
apprehensively mentioned that a sari was the manda-
tory attire in school.He says that he did not know how
to respond .He had not fully transitioned but had
short hair.What he think is the most general attire
,a kurta and jeans.It was also the time he was strug-
ling to fully understand who he was,Kabir said that.

[2]- We have another person name JANE-KAUSHIK who is


29 years old transwomen.she shares her experience as
a transwomen to the newspaper’’THE HINDU’’.She said
‘’When I let them know I am tans ,they don’t even bother
to shortlist me for the interview even she is in post-graduate
in political science with a B.E.D. degree.She decided to go
through the delhi subordinate service selection board,but
while fillind the application form,she saw there was no
option to identify as a third gender.She applied as a women
but did not show up for the exam fearing her appearance
could create troble inside the examination hall and that
she may be denied permission to write the exam.Later,
JANE approached an NGO for help to get the job appli-
cation form revised with an option for third gender ,which
was done in 2021.However, the updated version follo-
wing the intervention of social justice ministry does not
allow re-registrtion after a correction is made in the
gender-column and this,says JANE,has been a recurring
problem for majority of transgender person.JANE appr-
oached the delhi high court with a plea to enable re-
registration and also sought reservation for tansgender
persons in government job.

We have so many examples like KABIR AND


JANE-KAUSHIK who is facing discrimination every day
because they are transgender.Even so many people don’t
like to sit next to them.They don’t like to talk to them and
make fun of them.In India the word ‘’HIJRA’’is considered
as an abussive word so if you call omeone hijra he or she
would get offended.Transgender mainly in Asian countries
are often marginalised and encounter stigma and
discrimination due to their sexual orientation ,gender
identities and expressions.The stigma is spred in society
through the cultural and social atmosphere. Transgender is
also discussed openly in Asian culture .Hence, society
remains conservative and non supportive about it.

Transgender individual are usually subjected to


enormous social weight to conceal their identity due to
their social pressure .The environment is depressive to
transgender visibility as it is considered abnormal.Asian
government exhibit small resistance to social activism
promoting transgender right.lost resourcs about such
activism will not be published in mainstram and
transgender individuals felt excluded in society and in their
families.They hesitate to come come out to their families
because of the projected registration.

{B}- THE SECOND PROBLEM FACED BY TRANSGENDER


COMMUNITY IS LACK OF FAMILY SUPPORT-
Several recent studies from Trans Equality ,have
shown that trasnsgender individual face discrimination
within their own family units.Once their identity is
identified than,from very young age ,children are often
brought up in heteronormative setting within their own
homes.Parents oftentimes respond quite negatively when
their children crossgender barriers.Prompting transgender
youth to ran away.As a result,homeless transgender youth
are more likely to turn into drug dealing,car theft and
sexual exploitation.According to the human right
compaign,less than 45% of gender expassive youth sad
they could turn to an adult in their family if they were
worried or sad.

[c]- DISCRIMINATION IN EDUCATIONAL INSTITUTION -


In education,transgender individuals also describe
discrimination from peers. Transgender youth are three
times more likely to be excluded by peers because they
are different.A survey of national center of transgender
equality states,’’Those who expressed a transgender
identity or gender non-confirmity while in grades k-12
reported alarming rates of harrashment(78%),physical
assault(35%) and sexual violence(12%).Harashment was so
severe that it lead almost one-sixth(15%)to leave a school
in k-12 setting or in higher education.

[C] – DISCRIMINATION WITHIN GOVERNENT SETTING-

Transgender individuals are also oftentimes


discriminated within government setting through
healthcare policies and government-issued IDs
.Healthcare policies do not recognise transgender
identities as a physical disability providing transgender
individuals with sufficient care.Healthcare policies do not
address the pre and post operative needs of those
individulas who elect to go through sex change
operations.In addition ,transgender individuals are
disproportionality affected by HIV-AIDS and are ,more
likely to do drugs or alcohol,Although transgender
individuals are at risk health wise,19% of the respondents
haave described being refused medical are and 50%
described their medical care was postponed because of
their gender status.Transgender also face discrimination
when it comes to government issued IDs.Only one-fifthof
the respondents live without a driver’s license that
matches their gender identify.

Moreever,Transgender also face hate crimes,and


some cold argue that current justice and legal system are
not equipped to manage such crimes despite that most of
the time they don’t report transphobic violence because of
their distrust for the police.According to the
NCTF,’’one-fifth that’s 22.1% of respondent who have
interacted with police reported harrashmant by police
NCTF also reports ‘’one-fifth(22.1%) were denied equal
treatment by a government agency or official,’’29%
reported police harrashmant or disrespect and 12% had
been denied equal treatment or harrashed by judges
or court official which is shocking.As we expect atleast
judiciary should be unbiased or neutral and treat everyone
equally irrespective of their gender.

So far,Ihave discussed all the problems and


discrimination faced by transgender in our society but as
an Indian the discrimination of transgender in our country
is shocking for me as in our culture from ancient time we
worship ‘’ARDHANARISHVARA ‘’,a half male and half
female fusion of lord shiva and adisakti which is one of
several deities importand to mny hijras and
transgender.Hindu also called an androgynous and
transgender deity.Even in our ancient Indian text from
early3000 years ago document a third gender which has
been connected to the hijras who have formed a category
of third gender or trans feminine people on the indian
subcontinent since ancient times.In the ‘’RIGVEDA ‘’(from
roughly 3500 yrs ago),it is said that before creation in the
world lacked all distinctions including of sex and gender
,a state ancient poets expressed withimage like men with
wombs or breasts.And in our epics like Mahabharat and
ramayan also shown that there was not any disrespect
against transgender in ancient time as in Mahabharat
(from 2-3000 yrs ago)there was a trans man shikhandi and
in the Ramayan (from roughly 7000 yrs ago),when a rama
asks ‘’men and women ‘’not to follow him,hijras remain
and he blessed them.So at least as an Indian we should
learn these things from our history and stop discriminating
transgender in our country.

Indian government introduce a bill in 2019 for he


transgender to protect their rights.

PROVISION OF THE TRANSGENDER
PERSON(protection of right)BILL,2019.

-The bill states that a transgender person shall have


the right to self perceived gender identity and prohibits
discrimination on various grounds.

-- Every transgender person will have the right to


be included in their house holds ,and in case the i-
mmediate family is unable to take care of the other person
,he/she may be placed in a rehabilition center.

-- The government shall provide education , sports


and other facilities for transgender people ,provision for
separate HIV surveillance centre and sex reassignment
services should also be provided by the government ,as
per the bill.

--In order to exercise the provisions and functions of


the transgender person (protection of right) act
2019,the government will set up National Council for
transgender persons(NCT).This body wil advise ,monitor
and revill the policies and schemes formulated by the
central government for transgender people.

But despite its holistic and benevolent


outhole,the Transgender Bill is being creiticised because of
[1] -It propose a ‘’screening committee’’ of
experts for issuing identities certificates of
individual,which activist say could leave transgender
people vulnerable to abuse .
[2] – Begging is a primary source of livelihood for
transpersons in india.By criminalizing the activist ,the bill
pushes them into penury.
[3] – he absence of any provision about education
and affirmative action for the transgender community is
another major shortening.

[CONCLUSION]

Sexual orientation and gender identity are intrgral to


every person’s dignity and humanity and must not be the
basis for discrimination or abuse in a democratic society
.So to avoid discrimination against transgender we need to
spread awareness and understanding of transgender
people in the society.And I think that transgender
persons(protection of right)Bill 2019 is also a right step by
government in this direction.
