‫ﻗﺎﻧﻮﻥ ﺍﻟﺼﺤﺔ ﻭﺍﻟﺴﻼﻣﺔ ﺍﻟﻤﻬﻨﻴﺔ ﻟﻌﺎﻡ ‪2004‬‬

‫ﺗﻮﻓﻴﺮ ﻣﺼﻨﻊ )ﺑﻤﺎ ﻓﻴﻪ ﺍﻵﻻﺕ ﻭﺍﻟﻤﻌﺪﺍﺕ ﻭﺍﻷﺟﻬﺰﺓ ﻭﺍﻷﺩﻭﺍﺕ‬ ‫•‬ ‫ﻳﻘﻮﻡ ﻗﺎﻧﻮﻥ ﺍﻟﺼﺤﺔ ﻭﺍﻟﺴﻼﻣﺔ ﺍﻟﻤﻬﻨﻴﺔ ﻟﻌﺎﻡ ‪ 2004‬ﺑﺸﺮﺡ ﻭﺗﺤﺪﻳﺚ ﻗﻮﺍﻧﻴﻦ‬
‫ﻭﻣﻜﻮﻧﺎﺗﻬﺎ ﻭﻛﻞ ﻣﺎ ﻳﺘﺼﻞ ﺑﻬﺎ( ﺁﻣﻦ ﻭﺻﻴﺎﻧﺘﻪ ﺑﺤﻴﺚ ﺗﻜﻮﻥ ﺟﻤﻴﻊ‬ ‫ﺍﻟﺴﻼﻣﺔ ﻓﻲ ﻓﻴﻜﺘﻮﺭﻳﺎ ﺣﺘﻲ ﺗﻌﻜﺲ ﻇﺮﻭﻑ ﺃﻣﺎﻛﻦ ﺍﻟﻌﻤﻞ ﺍﻟﺤﺪﻳﺜﺔ‬
‫ﺍﻵﻻﺕ ﻭﺍﻟﻤﻌﺪﺍﺕ ﻭﺍﻷﺩﻭﺍﺕ ﻣﻨﺎﺳﺒﺔ ﻷﻫﺪﺍﻓﻬﺎ ﻭﻣﺤﺮﻭﺳﺔ ﻋﻨﺪ ﺍﻟﺤﺎﺟﺔ‬ ‫ﻭﺃﻭﺿﺎﻋﻬﺎ‪.‬‬
‫ﻭﻳﺘﻢ ﺍﻟﺤﻔﺎﻅ ﻋﻠﻴﻬﺎ ﻓﻲ ﻭﺿﻊ ﺁﻣﻦ؛‬ ‫ﻭﻳﻨﺺ ﻫﺬﺍ ﺍﻟﻘﺎﻧﻮﻥ ﻋﻠﻲ ﺃﺻﺤﺎﺏ ﺍﻟﻌﻤﻞ ﺍﻟﻘﻴﺎﻡ ﺑﻜﻞ ﻣﺎ ﻫﻮ ﻣﻌﻘﻮﻝ ﻭﺍﻟﻌﻤﻞ‬
‫ﻭﺿﻊ ﻧﻈﺎﻡ ﺁﻣﻦ ﻟﻠﻌﻤﻞ )ﻃﺮﻳﻘﺔ ﺗﻨﻈﻴﻢ ﺍﻟﻌﻤﻞ ﺑﻤﺎ ﻓﻴﻬﺎ ﺍﻟﻌﻤﻠﻴﺎﺕ‬ ‫•‬ ‫ﺑﺸﻜﻞ ﻓﻌﺎﻝ ﻟﻀﻤﺎﻥ ﺻﺤﺔ ﻭﺳﻼﻣﺔ ﻣﻜﺎﻥ ﻧﺸﺎﻃﻬﻢ ﺍﻟﺘﺠﺎﺭﻱ ‪.‬‬
‫ﻭﺇﺟﺮﺍءﺍﺕ ﺍﻟﺘﺸﻐﻴﻞ ﺍﻵﻣﻨﺔ‪ ،‬ﺗﺮﺗﻴﺒﺎﺕ ﺍﻟﻌﻤﻞ ﻭﺳﺮﻋﺘﻬﺎ‪ ،‬ﺇﺟﺮﺍءﺍﺕ ﻟﻤﻨﻊ‬
‫ﺍﻹﺭﻫﺎﻕ ﻭﺍﻹﺟﻬﺎﺩ ﺍﻟﻤﻬﻨﻲ ﻭﺍﻟﻌﻨﻒ ﻓﻲ ﺍﻟﻌﻤﻞ ﻭﻃﺮﻕ ﻣﻌﺎﻟﺠﺘﻬﻢ(؛‬ ‫ﻣﻦ ﻫﻮ ﺻﺎﺣﺐ ﺍﻟﻌﻤﻞ؟‬
‫ﺍﻟﺤﻔﺎﻅ ﻋﻠﻰ ﻣﻜﺎﻥ ﺍﻟﻌﻤﻞ ﺁﻣﻨﺎ ﻭﺑﺪﻭﻥ ﻣﺨﺎﻃﺮ ﺻﺤﻴﺔ )ﻳﺸﻤﻞ ﺫﻟﻚ‬ ‫•‬ ‫ﺻﺎﺣﺐ ﺍﻟﻌﻤﻞ ﻫﻮ ﻓﺮﺩ ﺃﻭ ﺷﺮﻛﺔ ﺃﻭ ﻫﻴﺌﺔ ﻣﻌﻨﻮﻳﺔ ﺃﻭ ﺷﺮﺍﻛﺔ ﺃﻭ ﺟﻤﻌﻴﺔ‬
‫ﺍﻟﻤﻜﺎﻥ‪ ،‬ﺗﺨﻄﻴﻄﻪ‪ ،‬ﺇﺿﺎءﺗﻪ ﻭﺗﻬﻮﻳﺘﻪ ﻭﺃﻣﻨﻪ‪ ،‬ﻭﺍﻟﺘﻌﺎﻣﻞ ﻣﻊ ﺍﻟﻀﺠﻴﺞ(؛‬ ‫ﻏﻴﺮ ﺇﻋﺘﺒﺎﺭﻳﺔ ﺃﻭ ﻭﻛﺎﻟﺔ ﺇﻣﺘﻴﺎﺯ ﺃﻭ ﻣﻨﻈﻤﺔ ﻻﺭﺑﺤﻴﺔ‪ ،‬ﻓﻲ ﺍﻟﻘﻄﺎﻋﻴﻦ ﺍﻟﺨﺎﺹ‬
‫ﺗﻄﺒﻴﻖ ﺇﺟﺮﺍءﺍﺕ ﻟﻺﺳﺘﺨﺪﺍﻡ ﺍﻵﻣﻦ ﻟﻠﻤﺼﻨﻊ )ﺑﻤﺎ ﻓﻴﻪ ﺍﻵﻻﺕ‬ ‫•‬ ‫ﻭﺍﻟﻌﺎﻡ ﻟﻬﻢ ﻣﺴﺘﺨﺪﻡ ﻭﺍﺣﺪ ﺃﻭ ﺃﻛﺜﺮ‪.‬‬
‫ﻭﺍﻟﻤﻌﺪﺍﺕ ﻭﺍﻷﺟﻬﺰﺓ ﻭﺍﻷﺩﻭﺍﺕ ﻭﻣﻜﻮﻧﺎﺗﻬﺎ ﻭﻛﻞ ﻣﺎ ﻳﺘﺼﻞ ﺑﻬﺎ( ﻭﺍﻟﻤﻮﺍﺩ‬
‫ﻭﻟﻠﺘﻌﺎﻣﻞ ﻣﻌﻬﻢ ﻭﺗﺨﺰﻳﻨﻬﻢ ﻭﻧﻘﻠﻬﻢ ؛‬ ‫ﻣﻦ ﻫﻮ ﺍﻟﻤﺴﺘﺨﺪﻡ ؟‬
‫ﺗﻮﻓﻴﺮ ﺍﻟﻤﺮﺍﻓﻖ ﺍﻟﻤﻼﺋﻤﺔ ﻷﺟﻞ ﺭﻓﺎﻩ ﺍﻟﻤﺴﺘﺨﺪﻣﻴﻦ )ﻣﺜﻞ ﻣﺎء ﺍﻟﺸﺮﺏ‬ ‫•‬ ‫ﻫﻢ ﺍﻷﺷﺨﺎﺹ ﺍﻟﻌﺎﻣﻠﻴﻦ ﺑﻤﻜﺎﻥ ﻋﻤﻞ ﺣﻴﺚ ﺍﻟﻤﺴﺆﻭﻟﻴﺔ ﻭﺍﻹﺩﺍﺭﺓ ﺗﻘﻊ ﻋﻠﻲ‬
‫ﻭﺍﻟﻤﺮﺍﺣﻴﺾ ﻭﺍﻣﺎﻛﻦ ﺗﻨﺎﻭﻝ ﺍﻟﻄﻌﺎﻡ ﻭﺍﻹﺳﻌﺎﻓﺎﺕ ﺍﻷﻭﻟﻴﺔ (؛ ﺑﺎﻹﺿﺎﻓﺔ‬ ‫ﺻﺎﺣﺐ ﺫﻟﻚ ﺍﻟﻌﻤﻞ ﺃﻭ ﻣﻦ ﺍﻟﻤﻔﺮﻭﺽ ﺃﻥ ﺗﻘﻊ ﻋﻠﻴﻪ ﻓﻲ ﺣﺎﻟﺔ ﻛﻮﻧﻬﻢ‪:‬‬
‫ﺍﻟﻰ‬ ‫ﻣﺴﺘﺨﺪﻣﻮﻥ ﻭﻓﻖ ﻋﻘﺪ ﺗﻮﻇﻴﻒ ﺃﻭ ﺇﺗﻔﺎﻕ ﺷﻔﻮﻱ ﺃﻭ ﻋﻘﺪ ﺗﺪﺭﻳﺐ ﺧﻄﻲ ‪-‬‬ ‫•‬
‫ﺗﻘﺪﻳﻢ ﺍﻟﻤﻌﻠﻮﻣﺎﺕ ﻭﺍﻟﺘﺪﺭﻳﺐ ﻭﺍﻹﺭﺷﺎﺩﺍﺕ ﺍﻟﻀﺮﻭﺭﻳﺔ ﻭﻣﺘﺎﺑﻌﺔ‬ ‫•‬ ‫ﻳﺘﻀﻤﻦ ﺫﻟﻚ ﻣﺴﺘﺨﺪﻣﻴﻚ ﺍﻟﻤﺒﺎﺷﺮﻳﻦ‪ ،‬ﻭﺍﻟﻤﻨﺘﺴﺒﻴﻦ ﻣﻦ ﺧﻼﻝ ﻣﺠﻤﻮﻋﺎﺕ‬
‫ﺍﻟﻤﺴﺘﺨﺪﻣﻴﻦ ﺣﺴﺐ ﺍﻟﻀﺮﻭﺭﺓ ﺣﺘﻲ ﻳﻘﻮﻣﻮﺍ ﺑﻮﻇﺎﺋﻔﻬﻢ ﺑﺼﻮﺭﺓ ﺁﻣﻨﺔ‬ ‫ﺍﻟﺘﺪﺭﻳﺐ ﻭﺍﻟﺘﻤﺮﻳﻦ؛‬
‫ﻭﺩﻭﻥ ﺗﻌﺮﻳﺾ ﺻﺤﺘﻬﻢ ﻟﻠﻤﺨﺎﻃﺮ‪.‬‬ ‫ﻣﻘﺎﻭﻟﻮﻥ ﻣﺴﺘﻘﻠﻮﻥ ﻣﺴﺘﺨﺪﻣﻮﻥ ﻣﻦ ﻗﺒﻠﻚ ‪ -‬ﻣﺜﻼ ﻛﺎﻟﺒﻨﺎﺋﻴﻦ ﺑﻤﻮﻗﻊ ﺑﻨﺎء ؛‬ ‫•‬
‫ﻳﺠﺐ ﻋﻠﻰ ﺻﺎﺣﺐ ﺍﻟﻌﻤﻞ ﺃﻥ ﻳﻘﺮﺭ ﻣﺎ ﻫﻮ ﻣﻌﻘﻮﻝ ﻋﻤﻠﻴﺎ ﻓﻲ ﻇﺮﻭﻑ‬ ‫ﻣﻘﺎﻭﻟﻴﻦ ﺛﺎﻧﻮﻳﻴﻦ ﻟﻬﺆﻻء ﺍﻟﻤﻘﺎﻭﻟﻴﻦ ؛‬ ‫•‬
‫ﻣﻌﻴﻨﺔ ﺑﻌﺪ ﺍﻷﺧﺬ ﺑﺎﻷﻣﻮﺭ ﺍﻟﺘﺎﻟﻴﺔ ﻓﻲ ﺍﻹﻋﺘﺒﺎﺭ‪:‬‬ ‫ﻣﺴﺘﺨﺪﻣﻲ ﻫﺆﻻء ﺍﻟﻤﻘﺎﻭﻟﻴﻴﻦ – ﻣﺜﻼ ﻋﻤﺎﻝ ﺍﻟﺒﻨﺎء‪ ،‬ﺃﻭ‬ ‫•‬
‫ﻣﺪﻯ ﺇﺣﺘﻤﺎﻝ ﻭﻗﻮﻉ ﺍﻟﺨﻄﺮ ﺃﻭ ﺍﻟﻤﺠﺎﺯﻓﺔ ﻓﻌﻼ‪ ،‬ﺃﻱ ﻣﺪﻯ ﺇﺣﺘﻤﺎﻝ ﻭﻗﻮﻉ‬ ‫•‬ ‫ﺷﺨﺺ ﻳﻘﻮﻡ ﺑﺘﻘﺪﻳﻢ ﺧﺪﻣﺎﺗﻪ ﻟﻚ ﻣﻦ ﺧﻼﻝ ﺷﺮﻛﺔ ﻋﻤﻞ ﺃﻭ ﻭﻛﺎﻟﺔ‬ ‫•‬
‫ﺍﻷﺫﻯ ﺃﻭ ﺇﺻﺎﺑﺔ ﺷﺨﺺ ﻣﺎ ﺧﻼﻝ ﺗﺄﺩﻳﺘﻪ ﻟﻤﻬﺎﻣﻪ؛‬ ‫ﺇﺳﺘﺨﺪﺍﻡ‪ ،‬ﻣﺜﻞ ﻋﺎﻣﻞ ﻣﺼﻨﻊ‪ ،‬ﻣﺴﺘﻠﻢ ﺍﻟﻄﻠﺒﻴﺎﺕ ﻓﻲ ﻣﺨﺰﻥ‪ ،‬ﻣﻮﻇﻒ‬
‫ﺩﺭﺟﺔ ﺍﻷﺫﻯ ﺍﻟﻨﺎﺗﺞ ﻋﻦ ﺣﺪﻭﺙ ﺧﻄﺮ ﻣﺤﺘﻤﻞ )ﻛﺎﻟﻮﻓﺎﺓ ﻣﺜﻼ ﺃﻭ‬ ‫•‬ ‫ﺇﺳﺘﻘﺒﺎﻝ ﻣﺆﻗﺖ ﺃﻭ ﻣﻤﺮﺿﺔ ﻣﻦ ﻭﻛﺎﻟﺔ‪.‬‬
‫ﺍﻷﺻﺎﺑﺎﺕ ﺍﻟﻤﺘﻌﺪﺩﺓ‪ ،‬ﺍﻟﺤﺎﺟﺔ ﺍﻟﻰ ﺍﻟﻌﻨﺎﻳﺔ ﺍﻟﻄﺒﻴﺔ ﺃﻭ ﺍﻹﺳﻌﺎﻓﺎﺕ ﺍﻷﻭﻟﻴﺔ‪،‬‬ ‫ﻭﻗﺪ ﻳﺘﻢ ﺇﻋﺘﺒﺎﺭ ﺍﻷﺷﺨﺎﺹ ﺍﻟﻌﺎﻣﻠﻴﻦ ﻓﻲ ﻣﺠﺎﻝ ﺗﻘﻊ ﻣﺴﺆﻭﻟﻴﺔ ﺇﺩﺍﺭﺗﻪ ﻋﻠﻰ‬
‫ﺃﻭ ﺁﺛﺎﺭ ﺻﺤﻴﺔ ﻗﺼﻴﺮﺓ ﺃﻭ ﻃﻮﻳﻠﺔ ﺍﻟﻤﺪﻱ(؛‬ ‫ﺻﺎﺣﺐ ﺍﻟﻌﻤﻞ ﻣﺴﺘﺨﺪﻣﻴﻦ ﻟﺪﻳﻪ ﺣﺘﻰ ﻓﻲ ﺣﺎﻟﺔ ﻋﺪﻡ ﻭﺟﻮﺩ ﻋﻘﺪ ﺗﻮﻇﻴﻒ‬
‫ﺗﻮﺍﺟﺪ ﻭﻣﻼﺋﻤﺔ ﻃﺮﻕ ﻟﻠﺘﺨﻠﺺ ﻣﻦ ﺍﻟﺨﻄﺮ ﺃﻭ ﺍﻟﻤﺠﺎﺯﻓﺔ ﺃﻭ ﺍﻟﺘﻘﻠﻴﻞ‬ ‫•‬ ‫ﺑﻴﻨﻪ ﻭﺑﻴﻨﻬﻢ ﺃﻭ ﺑﻴﻦ ﺍﻟﻤﻘﺎﻭﻝ ﺍﻟﻤﺴﺘﺨﺪﻡ ﻟﻬﻢ‪.‬‬
‫ﻣﻨﻬﻤﺎ؛‬
‫ﻣﺎ ﺗﻌﺮﻓﻪ ﺃﻭ ﻣﻦ ﺍﻟﻤﻔﺮﻭﺽ ﺃﻥ ﺗﻌﺮﻓﻪ ﻋﻦ ﺍﻟﺨﻄﺮ ﺃﻭ ﺍﻟﻤﺠﺎﺯﻓﺔ ﻭﻋﻦ‬ ‫•‬
‫ﻃﺮﻕ ﺍﻟﺘﺨﻠﺺ ﻣﻨﻬﻤﺎ ﺃﻭ ﺗﻘﻠﻴﻠﻬﻤﺎ؛ ﺑﺎﻹﺿﺎﻓﺔ ﺍﻟﻰ‬ ‫ﻭﺍﺟﺒﺎﺕ ﺻﺎﺣﺐ ﺍﻟﻌﻤﻞ‬
‫ﺗﻜﻠﻔﺔ ﺍﻟﺘﺨﻠﺺ ﺃﻭ ﺍﻟﺘﻘﻠﻴﻞ ﻣﻦ ﺍﻟﺨﻄﺮ ﺃﻭ ﺍﻟﻤﺠﺎﺯﻓﺔ )ﺃﻯ ﺇﺟﺮﺍءﺍﺕ‬ ‫•‬
‫ﺍﻟﺮﻗﺎﺑﺔ ﺍﻟﺘﻲ ﻳﺠﺐ ﺗﻄﺒﻴﻘﻬﺎ ﻣﺎ ﻟﻢ ﻳﻜﻦ ﺍﻟﺨﻄﺮ ﻧﻔﺴﻪ ﻃﻔﻴﻔﺎ ﻣﻘﺎﺭﻧﺔ‬ ‫ﺍﻟﺤﻤﺎﻳﺔ ﻣﻦ ﺍﻷﺫﻯ ﻓﻲ ﻣﻜﺎﻥ ﺍﻟﻌﻤﻞ‬
‫ﺑﺘﻜﻠﻔﺔ ﺗﻄﺒﻴﻖ ﺍﻹﺟﺮﺍءﺍﺕ(‪.‬‬ ‫ﻣﻦ ﻭﺍﺟﺒﺎﺕ ﺻﺎﺣﺐ ﺍﻟﻌﻤﻞ ﺣﻤﺎﻳﺔ ﺻﺤﺔ ﻭﺳﻼﻣﺔ ﺍﻟﻤﺴﺘﺨﺪﻣﻴﻦ ﺃﺛﻨﺎء‬
‫ﺗﻮﺍﺟﺪﻫﻢ ﺑﺎﻟﻌﻤﻞ ﻭﺫﻟﻚ ﺑﺘﻮﻓﻴﺮ ﺑﻴﺌﺔ ﻋﻤﻠﻴﺔ ﺁﻣﻨﺔ ﻭﺧﺎﻟﻴﺔ ﻣﻦ ﺍﻟﻤﺨﺎﻃﺮ‬
‫ﻭﺍﺟﺒﺎﺕ ﺻﺎﺣﺐ ﺍﻟﻌﻤﻞ ﺍﻷﺧﺮﻯ ﺗﺠﺎﻩ ﻣﺴﺘﺨﺪﻣﻴﻪ‬ ‫ﺍﻟﺼﺤﻴﺔ ﻭﺍﻟﺤﻔﺎﻅ ﻋﻠﻰ ﻫﺬﻩ ﺍﻟﺒﻴﺌﺔ‪ .‬ﻭﻳﺠﺐ ﺍﻟﺘﺨﻠﺺ ﻣﻦ ﺍﻟﻤﺨﺎﻃﺮ ﺃﻭ‬
‫ﻋﻠﻲ ﺃﺻﺤﺎﺏ ﺍﻟﻌﻤﻞ ﺍﻟﻘﻴﺎﻡ ﺑﻜﻞ ﻣﺎ ﻫﻮ ﻣﻌﻘﻮﻝ ﻓﻲ ﺳﺒﻴﻞ‪:‬‬ ‫ﺍﻟﺘﻘﻠﻴﻞ ﻣﻨﻬﺎ ﺑﻘﺪﺭ ﻣﺎ ﻫﻮ ﻣﻌﻘﻮﻝ ﻋﻤﻠﻴﺎ‪ ،‬ﻭﺫﻟﻚ ﻣﻦ ﺧﻼﻝ‪:‬‬
‫• ﻣﺮﺍﻗﺒﺔ ﺻﺤﺔ ﺍﻟﻤﺴﺘﺨﺪﻣﻴﻦ )ﺟﻤﻊ ﻭﻣﺮﺍﺟﻌﺔ ﺃﻯ ﻣﻌﻠﻮﻣﺎﺕ ﺣﻮﻝ‬
‫ﻣﻌﻠﻮﻣﺎﺕ ﻷﺻﺤﺎﺏ ﺍﻟﻌﻤﻞ‬
‫ﻳﺠﺐ ﺃﻥ ﺗﺸﺘﻤﻞ ﻫﺬﻩ ﺍﻹﺳﺘﺸﺎﺭﺍﺕ ﻋﻠﻰ ﺍﻟﺘﺎﻟﻲ‪:‬‬ ‫ﺍﻟﺤﻮﺍﺩﺙ ﺃﻭ ﺍﻹﺻﺎﺑﺎﺕ‪ ،‬ﺍﻟﻘﻴﺎﻡ ﺑﺈﻧﺘﻈﺎﻡ ﺑﺈﺟﺮﺍء ﻓﺤﻮﺻﺎﺕ ﺍﻟﺴﻤﻊ‬
‫• ﻣﺸﺎﺭﻛﺔ ﺍﻟﻤﺴﺘﺨﺪﻣﻴﻦ ﺑﺎﻟﻤﻌﻠﻮﻣﺎﺕ ﺣﻮﻝ ﺻﺤﺘﻬﻢ‪ ،‬ﺳﻼﻣﺘﻬﻢ ﻭﺭﻓﺎﻫﻴﺘﻬﻢ؛‬ ‫ﻟﻠﻌﺎﻣﻠﻴﻦ ﻓﻲ ﺑﻴﺌﺎﺕ ﺫﺍﺕ ﻣﺴﺘﻮﻯ ﺿﺠﻴﺞ ﻋﺎﻝ ﻭﺗﺤﻠﻴﻞ ﻫﺬﻩ ﺍﻟﻨﺘﺎﺋﺞ ( ؛‬

‫ﻳﺠﺐ ﻋﻠﻰ ﺻﺎﺣﺐ ﺍﻟﻌﻤﻞ ﺍﻟﻘﻴﺎﻡ ﺑﻜﻞ ﻣﺎ ﻫﻮ ﻣﻌﻘﻮﻝ ﻟﻠﺒﺪء ﻓﻲ ﺍﻟﻤﻔﺎﻭﺿﺎﺕ‬ ‫ﺗﻮﻇﻴﻒ ﺃﻭ ﻣﻘﺎﻭﻟﺔ ﺃﺷﺨﺎﺹ ﺫﻭﻱ ﻣﺆﻫﻼﺕ ﻓﻲ ﺍﻟﺼﺤﺔ ﻭﺍﻟﺴﻼﻣﺔ‬ ‫•‬
‫ﺣﻮﻝ ﺗﺄﺳﻴﺲ ﻣﺠﻤﻮﻋﺔ ﻋﻤﻞ ﻣﻌﻴﻨﺔ ﻓﻲ ﺧﻼﻝ ‪ 14‬ﻳﻮﻣﺎ ﻣﻦ ﻣﻄﺎﻟﺒﺔ ﺃﺣﺪ‬ ‫ﺍﻟﻤﻬﻨﻴﺔ ﻟﺘﻘﺪﻳﻢ ﺍﻟﻨﺼﺢ ﺣﻮﻝ ﺻﺤﺔ ﻭﺳﻼﻣﺔ ﺍﻟﻤﺴﺘﺨﺪﻣﻴﻦ )ﻇﺮﻭﻑ‬
‫ﺍﻟﻤﺴﺘﺨﺪﻣﻴﻦ ﺑﺬﻟﻚ‪ .‬ﻭﺑﻌﺪ ﺗﺄﺳﻴﺲ ﻣﺠﻤﻮﻋﺔ ﺍﻟﻌﻤﻞ ﺍﻟﻤﻌﻴﻨﺔ ﻳﻤﻜﻦ ﻋﻠﻰ‬ ‫ﺍﻟﻌﻤﻞ ﻗﺪ ﺗﺘﻄﻠﺐ ﻋﻠﻰ ﺳﺒﻴﻞ ﺍﻟﻤﺜﺎﻝ ﻭﺟﻮﺩ ﻣﺴﺘﺸﺎﺭ ﺧﺒﻴﺮ ﺑﺎﻟﺼﺤﺔ‬
‫ﺃﻋﻀﺎﺋﻬﺎ ﺃﻥ ﻳﻘﺮﺭﻭﺍ ﻛﻴﻔﻴﺔ ﺇﻧﺘﺨﺎﺏ ﻣﻤﺜﻠﻴﻬﺎ ﻟﻠﺼﺤﺔ ﻭﺍﻟﺴﻼﻣﺔ ﻭﺍﻟﺠﻬﺔ‬ ‫ﻟﻤﺮﺍﻗﺒﺔ ﻣﺴﺘﻮﻳﺎﺕ ﻣﺎﺩﺓ ﺍﻟﺮﺻﺎﺹ ﻓﻲ ﺍﻟﻌﻤﻞ ﺃﻭ ﺧﺒﻴﺮ ﻓﻲ ﻣﻴﻜﺎﻧﻴﻜﻴﺔ‬
‫ﺍﻟﻤﺴﺆﻭﻟﺔ ﻋﻦ ﺍﻹﻧﺘﺨﺎﺑﺎﺕ‪ .‬ﻓﻲ ﺣﺎﻟﺔ ﻋﺪﻡ ﺍﻹﺗﻔﺎﻕ ﺣﻮﻝ ﻛﻴﻔﻴﺔ ﺇﺟﺮﺍء‬ ‫ﺣﺮﻛﺔ ﺍﻟﺠﺴﻢ )‪ (Ergonomist‬ﻟﺘﻘﺪﻳﻢ ﺍﻟﻨﺼﻴﺤﺔ ﺣﻮﻝ ﻣﺨﺎﻃﺮ‬
‫ﺍﻹﻧﺘﺨﺎﺑﺎﺕ ﻳﻤﻜﻦ ﻋﻠﻰ ﻫﻴﺌﺔ ﺳﻼﻣﺔ ﺍﻟﻌﻤﻞ )‪ (WorkSafe‬ﺍﻟﻤﺴﺎﻋﺪﺓ ﺇﻣﺎ‬ ‫ﺍﻟﻤﻌﺎﻟﺠﺔ ﺍﻟﻴﺪﻭﻳﺔ(‪.‬‬
‫ﺑﺈﺟﺮﺍء ﺍﻹﻧﺘﺨﺎﺑﺎﺕ ﺃﻭ ﺑﺘﻌﻴﻴﻦ ﺷﺨﺺ ﺁﺧﺮ ﻟﻠﻘﻴﺎﻡ ﺑﺬﻟﻚ‪ .‬ﻭﻳﻤﻜﻦ ﺗﺮﺷﻴﺢ‬
‫ﺃﺣﺪ ﺃﻋﻀﺎء ﻣﺠﻤﻮﻋﺔ ﺍﻟﻌﻤﻞ ﺍﻟﻤﻌﻴﻨﺔ ﻣﻤﺜﻼ ﻟﻠﺼﺤﺔ ﻭﺍﻟﺴﻼﻣﺔ ﻭﻳﺤﻖ ﻟﻜﻞ‬ ‫ﻭﺍﺟﺐ ﺻﺎﺣﺐ ﺍﻟﻌﻤﻞ ﻓﻲ ﺣﻤﺎﻳﺔ ﺍﻷﺧﺮﻳﻦ‬
‫ﺃﻋﻀﺎء ﻣﺠﻤﻮﻋﺔ ﺍﻟﻌﻤﻞ ﺍﻟﻤﻌﻴﻨﺔ ﺗﻠﻚ ﺍﻟﺘﺼﻮﻳﺖ‪.‬‬
‫ﻛﻤﺎ ﻳﺘﻮﺟﺐ ﻋﻠﻰ ﺃﺻﺤﺎﺏ ﺍﻟﻌﻤﻞ ﺣﻤﺎﻳﺔ ﺃﺷﺨﺎﺹ ﻟﻴﺴﻮﺍ ﻣﻦ ﺍﻟﻤﺴﺘﺨﺪﻣﻴﻦ‬
‫ﻭﻗﺪ ﻳﺘﻔﻖ ﺻﺎﺣﺐ ﺍﻟﻌﻤﻞ ﻣﻊ ﺍﻟﻤﺴﺘﺨﺪﻣﻴﻦ ﻋﻠﻲ ﺇﻧﺘﺨﺎﺏ ﺃﻛﺜﺮ ﻣﻦ ﻣﻤﺜﻞ‬ ‫ﻭﻟﻜﻨﻬﻢ ﻣﺘﻮﺍﺟﺪﻭﻥ ﺩﺍﺧﻞ ﻣﻜﺎﻥ ﺍﻟﻌﻤﻞ ﺃﻭ ﺑﺎﻟﻘﺮﺏ ﻣﻨﻪ ﻭﺫﻟﻚ ﻟﻠﻀﻤﺎﻥ ﺑﻘﺪﺭ‬
‫ﻟﻠﺼﺤﺔ ﻭﺍﻟﺴﻼﻣﺔ ﻟﻤﺠﻤﻮﻋﺔ ﻋﻤﻞ ﻣﻌﻴﻨﺔ ﺑﺎﻹﺿﺎﻓﺔ ﺍﻟﻲ ﻧﺎﺋﺐ ﺃﻭ ﺃﻛﺜﺮ ﻋﻦ‬ ‫ﻣﺎ ﻫﻮ ﻣﻌﻘﻮﻝ ﻋﻤﻠﻴﺎ ﺑﺄﻧﻬﻢ ﻏﻴﺮ ﻣﻌﺮﺿﻮﻥ ﺍﻟﻰ ﻣﺨﺎﻃﺮ ﺻﺤﻴﺔ ﺃﻭ ﻣﺨﺎﻃﺮ‬
‫ﺍﻟﻤﻤﺜﻞ‪ .‬ﻭﻳﻘﻮﻡ ﻧﺎﺋﺐ ﻣﻤﺜﻞ ﺍﻟﺼﺤﺔ ﻭﺍﻟﺴﻼﻣﺔ ﺑﺼﻼﺣﻴﺎﺕ ﺍﻟﻤﻤﺜﻞ ﻓﻲ‬ ‫ﻟﺴﻼﻣﺘﻬﻢ ﻧﺘﻴﺠﺔ ﺍﻟﻌﻤﻞ ﺍﻟﺘﺠﺎﺭﻱ ﺍﻟﺬﻱ ﻳﻘﻮﻡ ﺑﻪ ﺻﺎﺣﺐ ﺍﻟﻌﻤﻞ‪.‬‬
‫ﺣﺎﻟﺔ ﻋﺪﻡ ﺗﻤﻜﻦ ﻫﺬﺍ ﺍﻷﺧﻴﺮ ﻣﻦ ﺫﻟﻚ‪.‬‬
‫ﻓﻌﻠﻰ ﺳﺒﻴﻞ ﺍﻟﻤﺜﺎﻝ‪:‬‬
‫ﻳﻤﺘﻠﻚ ﻣﻤﺜﻠﻮ ﺍﻟﺼﺤﺔ ﻭﺍﻟﺴﻼﻣﺔ ﺻﻼﺣﻴﺎﺕ ﻣﺨﺘﻠﻔﺔ ﺃﺛﻨﺎء ﻗﻴﺎﻣﻬﻢ ﺑﺪﻭﺭﻫﻢ‪،‬‬
‫ﻣﻨﻬﺎ‪:‬‬ ‫ﻳﺠﺐ ﺣﻤﺎﻳﺔ ﺍﻟﻤﺎﺭﺓ ﺑﺠﻮﺍﺭ ﻣﻮﻗﻊ ﺑﻨﺎء ﻣﻦ ﺧﻄﺮ ﺍﻷﺟﺴﺎﻡ ﺍﻟﺴﺎﻗﻄﺔ‬ ‫•‬
‫ﻭﻣﻦ ﺍﻟﺴﻴﺎﺭﺍﺕ ﺍﻟﺘﻲ ﺗﺪﺧﻞ ﺃﻭ ﺗﻐﺎﺩﺭ ﺍﻟﻤﻮﻗﻊ؛‬
‫ﺃﻥ ﻳﺘﻮﻓﺮ ﻟﻬﻢ ﻭﻟﻨﻮﺍﺑﻬﻢ ﻭﻗﺖ ﻋﻠﻰ ﺣﺴﺎﺏ ﺍﻟﺸﺮﻛﺔ ﻟﺤﻀﻮﺭ ﺍﻟﺘﺪﺭﻳﺐ‬ ‫•‬ ‫ﻳﺠﺐ ﺣﻤﺎﻳﺔ ﺯﻭﺍﺭ ﺍﻟﻤﺼﻨﻊ )ﺑﻤﺎ ﻓﻴﻪ ﺍﻵﻻﺕ ﻭﺍﻟﻤﻌﺪﺍﺕ ﻭﺍﻷﺟﻬﺰﺓ‬ ‫•‬
‫ﺍﻟﻤﻘﺪﻡ ﻣﻦ ﻗﺒﻞ ﻫﻴﺌﺔ ﺳﻼﻣﺔ ﺍﻟﻌﻤﻞ )‪ (WorkSafe‬ﺃﻭ ﺍﻟﻤﺼﺪﻕ ﻣﻦ‬ ‫ﻭﺍﻷﺩﻭﺍﺕ ﻭﻣﻜﻮﻧﺎﺗﻬﺎ ﻭﻛﻞ ﻣﺎ ﻳﺘﺼﻞ ﺑﻬﺎ(‪ ،‬ﺑﻤﺎ ﻓﻴﻬﻢ ﺳﺎﺋﻘﻮ ﺍﻟﺸﺎﺣﻨﺎﺕ‬
‫ﻗﺒﻠﻬﺎ‪ .‬ﻭﻳﻘﻮﻡ ﺻﺎﺣﺐ ﺍﻟﻌﻤﻞ ﺑﺘﺴﺪﻳﺪ ﺗﻜﺎﻟﻴﻒ ﺣﻀﻮﺭ ﺍﻟﺘﺪﺭﻳﺐ ﺍﻷﻭﻟﻲ‬ ‫ﺍﻟﻤﻮﺭﺩﺓ ﻭﺍﻟﻌﻤﻼء‪ ،‬ﻣﻦ ﺍﻟﺘﻌﺮﺽ ﻟﻠﻤﻮﺍﺩ ﺍﻟﺨﻄﺮﺓ ﺃﻭ ﺍﻷﻻﺕ ﺍﻟﻤﺘﺤﺮﻛﺔ؛‬
‫ﻭﺃﻱ ﺩﻭﺭﺍﺕ ﻣﺮﺍﺟﻌﺔ ﺗﺎﻟﻴﺔ ﻟﻠﻤﻤﺜﻠﻴﻦ؛‬
‫ﻳﺠﺐ ﺣﻤﺎﻳﺔ ﺍﻟﻤﺮﺿﻰ ﻭﺍﻟﻤﻘﻴﻤﻴﻦ ﻭﺍﻷﻫﻞ ﻭﺍﻟﺰﻭﺍﺭ ﺑﺎﻟﻤﺴﺘﺸﻔﻲ ﻣﻦ‬ ‫•‬
‫ﺍﻟﺤﺼﻮﻝ ﻋﻠﻰ ﻣﻌﻠﻮﻣﺎﺕ ﺣﻮﻝ ﺃﻯ ﻣﺨﺎﻃﺮ ﺃﻭ ﻣﺠﺎﺯﻓﺎﺕ ﻓﻌﻠﻴﺔ‬ ‫•‬ ‫ﺍﻷﻣﺮﺍﺽ ﺍﻟﻤﻌﺪﻳﺔ؛‬
‫ﻭﻣﺤﺘﻤﻠﺔ ﻭﻋﻦ ﺻﺤﺔ ﻭﺳﻼﻣﺔ ﺃﻋﻀﺎء ﻣﺠﻤﻮﻋﺔ ﺍﻟﻌﻤﻞ ﺍﻟﻤﻌﻴﻨﺔ ﺍﻟﺘﻲ‬
‫ﻳﻤﺜﻠﻮﻧﻬﺎ؛‬ ‫ﻳﺠﺐ ﻋﻠﻰ ﺷﺮﻛﺔ ﺑﺴﺘﻨﺔ ﺗﻌﻤﻞ ﻓﻲ ﻣﻜﺎﻥ ﻋﺎﻡ ﻛﻤﻨﺘﺰﻩ ﻣﺜﻼ ﺃﻥ ﺗﺤﻤﻲ‬ ‫•‬
‫ﺃﻓﺮﺍﺩ ﺍﻟﻌﺎﻣﺔ ﻣﻦ ﻣﺨﺎﻃﺮ ﻣﺜﻞ ﺍﻹﺻﺎﺑﺔ ﺑﺄﻏﺼﺎﻥ ﻗﺪ ﺗﺴﻘﻂ ﻋﻨﺪ ﺷﺬﺑﻬﺎ‬
‫ﺍﻟﺘﻔﺘﻴﺶ ﻟﻤﻜﺎﻥ ﺃﻭ ﺃﻣﺎﻛﻦ ﺍﻟﻌﻤﻞ ﺍﻟﺘﻲ ﻳﻌﻤﻞ ﺑﻬﺎ ﺃﻋﻀﺎء ﻣﺠﻤﻮﻋﺔ‬ ‫•‬ ‫ﺃﻭ ﺣﺠﺎﺭﺓ ﻣﺘﻄﺎﻳﺮﺓ ﻋﻨﺪ ﻗﺺ ﺍﻟﺤﺸﺎﺋﺶ ﺁﻟﻴﺎ‪.‬‬

‫ﺃﻭ ﺃﻣﺎﻛﻦ ﺍﻟﻌﻤﻞ ﺍﻟﺘﻲ ﻳﻌﻤﻞ ﺑﻬﺎ ﺃﻋﻀﺎء ﻣﺠﻤﻮﻋﺔ ﺍﻟﻌﻤﻞ ﺍﻟﻤﻌﻴﻨﺔ ﺍﻟﺘﻲ‬ ‫ﻣﻦ ﻭﺍﺟﺐ ﺃﺻﺤﺎﺏ ﺍﻟﻌﻤﻞ ﺇﺳﺘﺸﺎﺭﺓ ﺍﻟﻤﺴﺘﺨﺪﻣﻴﻦ ﺑﻘﺪﺭ ﻣﺎ ﻫﻮ ﻣﻌﻘﻮﻝ‬
‫ﻳﻤﺜﻠﻮﻧﻬﺎ؛‬ ‫ﻋﻤﻠﻴﺎ ﺣﻮﻝ ﺃﻣﻮﺭ ﻗﺪ ﺗﺆﺛﺮ ﻣﺒﺎﺷﺮﺓ ﻋﻠﻰ ﺻﺤﺘﻬﻢ ﻭﺳﻼﻣﺘﻬﻢ ﻭﺧﺎﺻﺔ ﻋﻨﺪ‪:‬‬

‫ﻓﻲ ﻣﻮﺍﻗﻊ ﺍﻟﻌﻤﻞ ﺗﺘﻄﻠﺐ ﻣﻦ ﺃﺻﺤﺎﺏ ﺍﻟﻌﻤﻞ ﺣﻤﻞ ﺍﻟﺮﺧﺺ ﺃﻭ ﺍﻹﺟﺎﺯﺍﺕ‬ ‫ﻣﻌﺎﻟﺠﺔ ﺍﻟﻤﺨﺎﻟﻔﺔ ﻣﻦ ﺧﻼﻝ ﺍﻟﻤﺸﺎﻭﺭﺓ‪ .‬ﻓﺈﺫﺍ ﻛﺎﻥ ﺍﻟﺸﺨﺺ ﺍﻟﺬﻱ ﺻﺪﺭ ﻓﻲ‬
‫ﺍﻷﺧﺮﻯ‪ .‬ﻳﺠﺐ ﺃﻥ ﻻ ﻳﻘﻮﻡ ﺻﺎﺣﺐ ﺍﻟﻌﻤﻞ ﺑﺄﻱ ﻋﻤﻞ ﺗﺠﺎﺭﻱ ﺑﺪﻭﻥ‬ ‫ﺣﻘﻪ ﺍﻹﻧﺬﺍﺭ ﻣﺴﺘﺨﺪﻣﺎ ﻓﻌﻠﻴﻪ ﺇﺧﺒﺎﺭ ﺻﺎﺣﺐ ﺍﻟﻌﻤﻞ ﻋﻦ ﺍﻹﻧﺬﺍﺭ‪ .‬ﻭﺇﺫﺍ ﺻﺪﺭ‬
‫ﺍﻟﺮﺧﺺ ﻭﺍﻟﺘﺴﺠﻴﻼﺕ ﺍﻟﻤﻼﺋﻤﺔ ﺍﻟﻤﻨﺼﻮﺹ ﻋﻠﻴﻬﺎ ﻓﻲ ﺃﻱ ﺗﻌﻠﻴﻤﺎﺕ ﺫﺍﺕ‬ ‫ﺍﻹﻧﺬﺍﺭ ﻓﻲ ﺣﻖ ﺻﺎﺣﺐ ﺍﻟﻌﻤﻞ ﺃﻭ ﺷﺨﺺ ﻳﻌﻤﻞ ﻟﺤﺴﺎﺑﻪ ﺍﻟﺨﺎﺹ ﻓﻌﻠﻴﻪ‬
‫ﺍﻟﺼﻠﺔ ﺑﺎﻟﻘﺎﻧﻮﻥ )ﻋﻠﻰ ﺳﺒﻴﻞ ﺍﻟﻤﺜﺎﻝ ﻳﺠﺐ ﺃﻥ ﻳﺤﻤﻞ ﻣﺘﺨﺼﺺ ﺇﺯﺍﻟﺔ‬ ‫ﺇﺧﺒﺎﺭ ﻛﻞ ﻣﻦ ﻳﺆﺛﺮ ﺍﻹﻧﺬﺍﺭ ﻓﻲ ﻋﻤﻠﻬﻢ ﻭﺃﻥ ﻳﻀﻌﻪ ﻓﻲ ﻣﻜﺎﻥ ﺑﺎﺭﺯ‬
‫ﺍﻷﺳﺒﺴﺘﻮﺱ ﺭﺧﺼﺔ ﺧﺎﺻﺔ(‪.‬‬ ‫ﺑﺎﻟﻤﻮﻗﻊ ﺍﻟﺬﻱ ﻳﺨﺘﺺ ﺑﻪ ﺍﻹﻧﺬﺍﺭ‪ .‬ﻭﻋﻠﻰ ﺍﻟﺸﺨﺺ ﺍﻟﺼﺎﺩﺭ ﻓﻲ ﺣﻘﻪ ﺍﻹﻧﺬﺍﺭ‬
‫ﻳﺠﺐ ﺃﻥ ﻳﻀﻤﻦ ﺃﺻﺤﺎﺏ ﺍﻟﻌﻤﻞ ﺑﺄﻥ ﺍﻷﺷﺨﺎﺹ ﺍﻟﻤﻨﻔﺬﻭﻥ ﻟﻠﻌﻤﻞ ﺍﻟﺬﻱ‬ ‫ﺍﻹﻟﺘﺰﺍﻡ ﺑﻪ ﺇﻻ ﻓﻲ ﺣﺎﻟﺔ ﺍﻟﻄﻠﺐ ﻣﻦ ﻫﻴﺌﺔ ﺳﻼﻣﺔ ﺍﻟﻌﻤﻞ )‪(WorkSafe‬‬
‫ﻳﺘﻄﻠﺐ ﺭﺧﺼﺎ ﺇﺧﺘﺼﺎﺻﻴﺔ ﺃﻭ ﺗﺴﺠﻴﻼﺕ ﺃﻭ ﺇﺟﺎﺯﺍﺕ ﺃﻭ ﺷﻬﺎﺩﺍﺕ ﺍﻟﻜﻔﺎءﺓ‬ ‫ﺇﺭﺳﺎﻝ ﻣﻔﺘﺶ ﻟﻠﺘﺤﻘﻴﻖ ﻓﻲ ﺃﻣﺮ ﺍﻹﻧﺬﺍﺭ‪.‬‬
‫ﻣﺆﻫﻠﻮﻥ ﺑﺸﻜﻞ ﺻﺤﻴﺢ ﻭﺫﻭﻱ ﺧﺒﺮﺓ ﻭﻳﺘﻢ ﺍﻹﺷﺮﺍﻑ ﻋﻠﻴﻬﻢ ﺑﺸﻜﻞ ﻣﻼﺋﻢ‪.‬‬ ‫ﻓﻲ ﺣﺎﻟﺔ ﺣﺪﻭﺙ ﺃﻣﺮ ﻳﺘﻀﻤﻦ ﺧﻄﺮﺍ ﻣﺒﺎﺷﺮﺍ ﻋﻠﻰ ﺍﻟﺼﺤﺔ ﺃﻭ ﺍﻟﺴﻼﻣﺔ‬
‫ﻭﻋﺪﻡ ﻣﻼءﻣﺔ ﻃﺮﻕ ﺣﻞ ﺍﻟﻤﺸﻜﻠﺔ ﻟﻠﺘﻌﺎﻣﻞ ﻣﻊ ﻫﺬﺍ ﺍﻷﻣﺮ ﻓﺈﻧﻪ ﺑﺈﻣﻜﺎﻥ‬
‫ﺍﻟﺘﺒﻠﻴﻎ ﻋﻦ ﺍﻟﺤﻮﺍﺩﺙ ﻭﺍﻟﻤﺤﺎﻓﻈﺔ ﻋﻠﻰ ﻣﻮﺍﻗﻌﻬﺎ‬ ‫ﺻﺎﺣﺐ ﺍﻟﻌﻤﻞ ﺃﻭ ﻣﻤﺜﻞ ﻟﻠﺼﺤﺔ ﻭﺍﻟﺴﻼﻣﺔ ﺫﻭ ﺻﻠﺔ ﺑﺎﻷﻣﺮ ﺇﺻﺪﺍﺭ ﺍﻷﻣﺮ‬
‫ﻳﺠﺐ ﺃﻥ ﻳﺒﻠﻎ ﺻﺎﺣﺐ ﺍﻟﻌﻤﻞ ﻫﻴﺌﺔ ﺳﻼﻣﺔ ﺍﻟﻌﻤﻞ )‪ (WorkSafe‬ﻓﻮﺭ‬ ‫ﺍﻟﻰ ﺍﻟﻤﺴﺘﺨﺪﻣﻴﻦ ﺑﺎﻟﺘﻮﻗﻒ ﻋﻦ ﺍﻟﻌﻤﻞ ﻭﺫﻟﻚ ﺑﻌﺪ ﺍﻟﺘﺸﺎﻭﺭ ﻓﻴﻤﺎ ﺑﻴﻨﻬﻤﺎ‪.‬‬
‫ﺍﻟﻤﻮﺕ ﺃَﻭ ﺍﻹﺻﺎﺑﺔ ﺍﻟﺨﻄﻴﺮﺓ‪ .‬ﺍﻹﺻﺎﺑﺎﺕ‬

‫• ﻋﻼﺟﺎ ﻃﺒﻴﺎ ﺧﻼﻝ ‪ 48‬ﺳﺎﻋﺔ ﻣﻦ ﺍﻟﺘﻌﺮﺽ ﻟﻤﺎﺩﺓ ﻣﺎ ؛‬ ‫ﺇﺫﺍ ﻟﻢ ﻳﺘﻢ ﺇﻳﺠﺎﺩ ﺣﻞ ﻟﻸﻣﺮ ﺍﻟﺬﻱ ﺃﺩﻯ ﺍﻟﻰ ﺃﻣﺮ ﺑﺘﻮﻗﻒ ﺍﻟﻌﻤﻞ ﻓﻲ ﻭﻗﺖ‬
‫• ﺍﻟﻌﻼﺝ ﺍﻟﻤﺒﺎﺷﺮ ﺑﺎﻟﻤﺴﺘﺸﻔﻲ ﻛﻤﺮﻳﺾ ﺩﺍﺧﻠﻲ؛ ﺃﻭ‬ ‫ﻣﻌﻘﻮﻝ‪ ،‬ﺑﺈﻣﻜﺎﻥ ﺃﻱ ﻣﻦ ﺍﻷﻃﺮﺍﻑ ﺍﻟﻄﻠﺐ ﻣﻦ ﻫﻴﺌﺔ ﺳﻼﻣﺔ ﺍﻟﻌﻤﻞ‬
‫)‪ (WorkSafe‬ﺇﺭﺳﺎﻝ ﻣﻔﺘﺶ ﻟﻠﺘﺤﻘﻴﻖ ﻓﻲ ﺍﻷﻣﺮ‪.‬‬
‫• ﺍﻟﻌﻼﺝ ﺍﻟﻄﺒﻲ ﺍﻟﻤﺒﺎﺷﺮ ﻟﻺﺻﺎﺑﺎﺕ ﺍﻟﺨﻄﻴﺮﺓ ﻛﺎﻟﺒﺘﺮ‪ ،‬ﺍﻹﺻﺎﺑﺎﺕ ﺍﻟﺒﺎﻟﻐﺔ‬

‫ﻳﺠﺐ ﻋﻠﻰ ﺻﺎﺣﺐ ﺍﻟﻌﻤﻞ ﺗﺄﺳﻴﺲ ﻟﺠﻨﺔ ﺍﻟﺼﺤﺔ ﻭﺍﻟﺴﻼﻣﺔ ﺍﻟﻤﻬﻨﻴﺔ ﻓﻲ‬
‫ﻛﻤﺎ ﻋﻠﻲ ﺃﺻﺤﺎﺏ ﺍﻟﻌﻤﻞ ﺇﺑﻼﻍ ﻫﻴﺌﺔ ﺳﻼﻣﺔ ﺍﻟﻌﻤﻞ )‪(WorkSafe‬‬ ‫ﺧﻼﻝ ﺛﻼﺙ ﺃﺷﻬﺮ ﻣﻦ ﻣﻄﺎﻟﺒﺔ ﻣﻤﺜﻞ ﺍﻟﺼﺤﺔ ﻭﺍﻟﺴﻼﻣﺔ ﺑﺘﺄﺳﻴﺴﻬﺎ‪.‬‬
‫ﺑﺎﻟﺤﻮﺍﺩﺙ ﺍﻟﺘﻲ ﺗﻌﺮﺽ ﺻﺤﺔ ﻭﺳﻼﻣﺔ ﺷﺨﺺ ﻣﺎ ﻓﻲ ﺍﻟﺠﻮﺍﺭ ﺍﻟﻘﺮﻳﺐ ﺍﻟﻲ‬

‫ﺍﻟﺴﻘﻮﻁ ﻣﻦ ﺇﺭﺗﻔﺎﻉ ﻷﻱ ﺟﺰء ﻣﻦ ﺍﻵﻻﺕ ﻭﺍﻟﻤﻌﺪﺍﺕ ﻭﺍﻷﺟﻬﺰﺓ‬ ‫•‬
‫ﻭﺍﻷﺩﻭﺍﺕ ﻭﻣﻜﻮﻧﺎﺗﻬﺎ ﻭﻛﻞ ﻣﺎ ﻳﺘﺼﻞ ﺑﻬﺎ ﺑﻤﻜﺎﻥ ﺍﻟﻌﻤﻞ‪.‬‬ ‫ﺣﻞ ﺍﻟﻤﺸﺎﻛﻞ‬
‫ﻛﻤﺎ ﻳﺠﺐ ﺃﻥ ﻳﻘﺪﻡ ﺻﺎﺣﺐ ﺍﻟﻌﻤﻞ ﺇﻟﻰ ﻫﻴﺌﺔ ﺳﻼﻣﺔ ﺍﻟﻌﻤﻞ )‪(WorkSafe‬‬ ‫ﻋﻠﻰ ﺃﺻﺤﺎﺏ ﺍﻟﻌﻤﻞ ﻭﻣﺴﺘﺨﺪﻣﻴﻬﻢ )ﺍﻟﻤﻤﺜﻠﻮﻥ ﻣﻦ ﻗﺒﻞ ﻣﻤﺜﻠﻲ ﺍﻟﺼﺤﺔ‬
‫ﺳﺠﻼ ﻣﻜﺘﻮﺑﺎ ﻋﻦ ﺍﻟﺤﺎﺩﺛﺔ ﻭﺍﺟﺒﺔ ﺍﻟﺘﺒﻠﻴﻎ ﺧﻼﻝ ‪ 48‬ﺳﺎﻋﺔ ﻣﻦ ﺍﻟﺘﺒﻠﻴﻎ ﻋﻨﻬﺎ‬ ‫ﻭﺍﻟﺴﻼﻣﺔ( ﻣﺤﺎﻭﻟﺔ ﺣﻞ ﺍﻟﻤﺸﺎﻛﻞ ﻣﻦ ﺧﻼﻝ ﺇﺟﺮﺍءﺍﺕ ﺩﺍﺧﻠﻴﺔ ﺳﺒﻖ ﻭﺗﻢ‬
‫ﺍﻟﺴﺠﻞ ﻟﻔﺘﺮﺓ ‪ 5‬ﺳﻨﻮﺍﺕ‪ ،‬ﻭﻳﻮﻓﺮ ﻧﺴﺨﺎ ﻣﻨﻬﺎ ﻟﻜﻞ‬
‫ِ‬ ‫ﻭﺃﻥ ﻳﺤﺘﻔﻆ ﺑﻨﺴﺨﺔ ﻫﺬﺍ‬ ‫ﺍﻹﺗﻔﺎﻕ ﻋﻠﻴﻬﺎ‪ .‬ﻓﻲ ﺣﺎﻟﺔ ﺇﻧﻌﺪﺍﻡ ﻣﺜﻞ ﻫﺬﻩ ﺍﻹﺟﺮﺍءﺍﺕ ﻳﻤﻜﻦ ﺇﺳﺘﺨﺪﺍﻡ‬
‫ﻣﻦ‪:‬‬ ‫ﺍﻟﻌﻤﻠﻴﺔ ﺍﻟﻤﻨﺼﻮﺹ ﻋﻠﻴﻬﺎ ﻓﻲ ﺗﻌﻠﻴﻤﺎﺕ ﺍﻟﻘﺎﻧﻮﻥ‪ .‬ﻓﺈﺫﺍ ﻟﻢ ﻳﺘﻤﻜﻦ ﺍﻷﻃﺮﺍﻑ‬
‫ﻣﻔﺘﺶ ﻫﻴﺌﺔ ﺳﻼﻣﺔ ﺍﻟﻌﻤﻞ )‪(WorkSafe‬؛‬ ‫•‬ ‫ﻣﻦ ﺣﻞ ﺍﻟﻤﺸﻜﻠﺔ ﻓﻲ ﻭﻗﺖ ﻣﻌﻘﻮﻝ ﻳﺤﻖ ﻷﻱ ﻣﻦ ﺍﻟﻄﺮﻓﻴﻦ ﺍﻟﻄﻠﺐ ﻣﻦ ﻫﻴﺌﺔ‬
‫ﺳﻼﻣﺔ ﺍﻟﻌﻤﻞ )‪ (WorkSafe‬ﺇﺭﺳﺎﻝ ﻣﻔﺘﺶ ﻟﻠﺘﺤﻘﻴﻖ ﻓﻲ ﺍﻷﻣﺮ‪.‬‬
‫ﺍﻟﺸﺨﺺ ﺍﻟﻤﺘﺄﺛﺮ ﺑﺎﻟﺤﺎﺩﺛﺔ ﺃﻭ ﻣﻦ ﻳﻤﺜﻠﻪ؛‬ ‫•‬
‫ﻣﻤﺜﻞ ﺍﻟﺼﺤﺔ ﻭﺍﻟﺴﻼﻣﺔ ﻟﻤﺠﻤﻮﻋﺔ ﺍﻟﻌﻤﻞ ﺍﻟﻤﻌﻴﻨﺔ ﺍﻟﻤﺘﺄﺛﺮﺓ ﺑﺎﻟﺤﺎﺩﺛﺔ‬ ‫•‬ ‫ﻋﻨﺪ ﻣﺤﺎﻭﻟﺔ ﺣﻞ ﺍﻟﻤﺸﺎﻛﻞ ﺍﻟﻤﺘﻌﻠﻘﺔ ﺑﺎﻟﺼﺤﺔ ﻭﺍﻟﺴﻼﻣﺔ ﺍﻟﻤﻬﻨﻴﺔ ﻳﺠﺐ ﺃﻥ‬

‫ﻭﺍﻟﻜﻔﺎءﺓ ﺑﺤﻴﺚ ﻳﻜﻮﻥ ﻗﺎﺩﺭﺍ ﻋﻠﻰ ﺍﻹﻧﺎﺑﺔ ﻋﻦ ﺻﺎﺣﺐ ﺍﻟﻌﻤﻞ ﻭﺃﻥ ﻻ ﻳﻜﻮﻥ‬
‫ﺃﻋﻀﺎء ﻟﺠﻨﺔ ﺍﻟﺼﺤﺔ ﻭﺍﻟﺴﻼﻣﺔ )ﺇﺫﺍ ﻛﺎﻧﺖ ﻫﻨﺎﻙ ﻭﺍﺣﺪﺓ(‪.‬‬ ‫•‬ ‫ﻣﻦ ﻣﻤﺜﻠﻲ ﺍﻟﺼﺤﺔ ﻭﺍﻟﺴﻼﻣﺔ‪.‬‬
‫ﻋﻨﺪ ﺣﺪﻭﺙ ﺣﺎﺩﺛﺔ ﻭﺍﺟﺒﺔ ﺍﻟﺘﺒﻠﻴﻎ ‪ ،‬ﻳﺠﺐ ﻋﺪﻡ ﻣﺲ ﻣﻮﻗﻊ ﺍﻟﺤﺎﺩﺛﺔ ﺍﻟﻰ ﺣﻴﻦ‬
‫ﻳﺴﻤﺢ ﺑﺬﻟﻚ ﻣﻔﺘﺶ ﻫﻴﺌﺔ ﺳﻼﻣﺔ ﺍﻟﻌﻤﻞ )‪ .(WorkSafe‬ﻻ ﻳﻨﻄﺒﻖ ﻫﺬﺍ ﻋﻠﻰ‬ ‫ﻣﻨﻊ ﺍﻟﺘﻤﻴﻴﺰ‬
‫ﻣﻮﻗﻊ ﻳﺠﺐ ﻣﺴﻪ ﻟﺤﻤﺎﻳﺔ ﺻﺤﺔ ﻭﺳﻼﻣﺔ ﺷﺨﺺ ﻣﺎ‪ ،‬ﺃﻭ ﻟﻤﺴﺎﻋﺪﺓ ﺷﺨﺺ‬ ‫ﻋﻠﻰ ﺃﺻﺤﺎﺏ ﺍﻟﻌﻤﻞ ﺍﻹﻣﺘﻨﺎﻉ ﻋﻦ ﺗﻬﺪﻳﺪ ﺃﻱ ﺷﺨﺺ ﺃﻭ ﻓﺼﻠﻪ ﻋﻦ ﺍﻟﻌﻤﻞ‬
‫ﺟﺮﻳﺢ ﺃﻭ ﻹﺗﺨﺎﺫ ﺇﺟﺮﺍء ﺿﺮﻭﺭﻱ ﻟﺠﻌﻞ ﺍﻟﻤﻮﻗﻊ ﺃﻣﻨﺎ‪.‬‬ ‫ﺃﻭ ﺭﻓﺾ ﺗﻌﻴﻴﻨﻪ ﺃﻭ ﺍﻟﺘﺄﺛﻴﺮ ﺳﻠﺒﺎ ﻋﻠﻰ ﻋﻤﻠﻪ ﺭﺩﺍ ﻋﻠﻰ ﺗﺼﺮﻓﺎﺕ ﺇﺗﺨﺬﻫﺎ‬

‫ﻋﻨﺪ ﺍﻟﺘﺤﻘﻴﻖ ﻓﻲ ﺍﻟﻤﺨﺎﻟﻔﺔ ﺍﻟﻤﺸﺘﺒﻪ ﻓﻴﻬﺎ ﻳﻤﻜﻦ ﺃﻥ ﻳﻘﻮﻡ ‪ ARREO‬ﺑﺎﻟﺘﺎﻟﻲ‪:‬‬
