Company Vehicle Policy Agreement

This is an agreement between Excelucent Equipment Corporation (“Company”) and

MR. JASON MIN (“Employee”) for company

vehicle assignment with the following details:

VEHICLE MODEL: SM3


PLATE NUMBER: ATA 3293
This agreement is designed to ensure that the EMPLOYEE who is provided with company
vehicle is aware of the duties and responsibilities. This agreement is also created to regulate the
use of company vehicles and ensure the EMPLOYEE who is responsible for the assign vehicle
is in compliance with any applicable policies, rules and laws.

The EMPLOYEE operating a company vehicle agrees to operate the vehicle according to the
following guidelines. Failure to adhere to these guidelines may result in revocation of an
employee’s privilege and/or will be given necessary disciplinary action.

I. VEHICLE USAGE

Company vehicle are to be used exclusively for company business purposes and if will
utilized for personal or private matters not related to the business of the company is subject
for approval of the management.

II. RECORDS

The EMPLOYEE should keep the OR/CR of the company vehicle at all times, and to
report the renewal of the car registrations no more than 60 days before its expiration date.

III. SAFETY

The EMPLOYEE should always carry his/her valid driver’s license and required to
conduct safety inspection before using the vehicle. The EMPLOYEE is responsible for the
condition and safe operation of their assigned vehicles.

IV. ACCIDENT

The COMPANY will provide a comprehensive insurance policy to company vehicle. In


case of accident and/or damages, the COMPANY will shoulder the 50% of the total cost
and another 50% from the EMPLOYEE if found NEGLIGENCE OF THE DRIVER. If the
company vehicle use for non-business transaction/personal during the accident, the
EMPLOYEE is liable for the total damage incurred.

V. MAINTENANCE

The EMPLOYEE is required to properly maintain the assigned company vehicle at all
times. Vehicles should not be operated with any defects that would inhibit safe and free
from accident.

a. Conduct regular pre-trip inspections in order to identify vehicle problems and


assure vehicles are in good operating condition.
b. Monitor basic Preventive Maintenance service routines in a timely manner to
identify vehicle problems and keep vehicle systems in good repair.
c. Maintain a clean appearance for vehicles through regular interior and exterior
cleaning.
d. Regularly inspect vehicles in order to identify and correct problems in to prevent
service interruptions.

e. Schedule repairs promptly in order to minimize service interruptions.
f. Preventive maintenance such as, but not limited to regular oil changes (every
5,000 KM), lubrication, tire pressure, tire replacement, brake pad & motor
replacement and fluid checks with recommendation from the assigned mechanic.
g. Unauthorized replacing or stolen car parts such as battery, car tools and etc.is
strictly prohibited.

VI. TRAFFIC VIOLATIONS

The EMPLOYEE is required to report all violations, theft or malicious damage to


General Operation Dept. within 24hrs. The COMPANY will not condone nor may
excuse ignorance of vehicle laws violation incurred that result of penalties and fines.

The EMPLOYEE with three (3) major traffic violations or any combination of three
accidents and/or major traffic violations within in one-year period will be prohibited
from driving a company vehicle.

The EMPLOYEE with violation associated with alcohol or drugs will be prohibited
from driving a company vehicle and may also be grounds for immediate termination of
employment.

VII. DISICPLINARY ACTION

Non-compliance of this agreement may result of disciplinary action up to termination of


employment or may take legal action if more serious offense is committed.

Class II. Company Properties and Accountabilities

2.1 Unauthorized use of company property, equipment, devices or assets;


2.2 Unauthorized service sales, repair, and work during employment contract period;
2.3 Removing company property without prior authorization or disseminating
company information without authorization;
2.4 Disregard for safety and security procedures;
2.5 Using company time for personal gain
2.6 Other analogous pertaining to misused of company time property and
accountabilities.

First Offense: Formal Written Warning


Second Offense: Fifteen Days Suspension without pay
Third Offense: Termination of Employment

VIII. ACKNOWLEDGEMENT

By signing below, I acknowledge that I have read and fully understand the content of
this agreement and that I agree to abide by such terms. Without limiting the
foregoing, I expressly understand and agrees that:

a. I will obey all applicable national, state and local laws governing the vehicle
assigned to employee including those relating to the operation and maintenance of
such vehicle.

b. I will operate such vehicle in a safe and respectful manner and adhere to published
safe operating practices.

c. I will be responsible of tracking and reporting the mileage and maintenance of


such vehicle.

d. If I am not able to comply with this agreement, then employee is subject to


disciplinary action, up to and including termination of employment.
