CONTRACT OF SERVICE
Dance Instructor

KNOW ALL MEN BY THESE PRESENTS:

This CONTRACT entered into by and between:

The Local Government Unit of Sablayan with office address at Barangay Sablayan,
Occidental Mindoro herein represented by HON. WALTER B. MARQUEZ, Municipal
Mayor, herein referred to as the “FIRST PARTY”.

-and-

CHRISTIAN ARJEI PASCUAL DACAYANAN, of legal age, Filipino and with

residence address Barangay Sto. Niño, Sablayan, Occidental Mindoro, herein referred to as
the “SECOND PARTY”.

-WITNESETH-

1. That the First Party is in need of the services of the SECOND PARTY who shall
perform the work not performed by the regular personnel of the FIRST PARTY;

2. That the SECOND PARTY has signified his intention to which the FIRST PARTY
has accepted, to provide the services needed by the latter;

3. That the SECOND PARTY hereby possesses the education, experience and skills
required to perform the job as described herein;

4. That the SECOND PARTY hereby attests that he has not been previously dismissed
from government service or private institutions by reason of an administrative
offense;

5. That in view hereof, the SECOND PARTY is hereby contracted as DANCE

INSTRUCTOR, for the First Regional Cultural Contest for LCROs with the
honorarium of TWENTY THOUSAND (Php 25,000.00) PESOS..

6. That the DANCE INSTRUCTOR, the SECOND PARTY, is expected to perform

the following functions:

6.1 Preparation of music for the cultural presentation;

6.2 Preparation of the choreography for the cultural presentation;

 6.3 Preparation of the costume and costume design;

That pursuant to CSC Memorandum 40, s. 1998, Section 2, Rule XI as amended that,
“Section 1: Contract of Services / Job Order, as distinguished from those covered under
Section. 2 (e) and (f), Rule III of these Rules, need not be submitted to the Commission.
Service rendered thereunder are not considered government services, “and Section 2:
Contract of Services / Job Order refer to employment described as follows: a) The Contract
covers lump sum work of services such as janitorial, security, consultancy services, where no
employer – employee relationship exist and, b) The contracts of the service or job orders are
not covered by Civil Service Law, rules and regulations but covered by COA rules (emphasis
supplied)”.

7. That the Contract of Services will take effect July 14, 2022 to July 22, 2022;

8. That the SECOND PARTY shall perform work at a time, schedule and as the need
arises in the interest of service;

9. It is understood that this Contract of Services does not create an employer –

employee relationship between the FIRST PARTY and the SECOND PARTY, that
the services, or any revision herein rendered are not considered and will not be
accredited as a government services.

IN WITNESS WHEREOF, that both PARTIES have hereunto set their hands this ___ day

ACKNOWLEDGMENT RECEIPT

Received from the Local Government Unit of Sablayan, the sum of TWENTY FIVE
THOUSAND PESOS (Php 25,000.00) as payment for being the dance instructor for the
First Regional Cultural Contest for LCROs.

This 25th July, 2022 at Sablayan Occidental Mindoro.
