MOOT COURT PROPOSITION

Sufiya was a 2nd Year Economics (Hons.) student & Anirudh was a final Year Student.
In the Year 2020 they both were studying in Commerce Government College, Jaipur. In
College Annual Function intimacy developed between them and by the time they fell in
love with each other.

Sufiya, being a muslim girl and Anirudh, a Hindu boy, their family members were
dissatisfied about their relationship as both the families were of separate religions.

However one day they escaped from college & start's living in a rented house in a remote
village of Kota. There Anirudh was working in a Firm as H.R.& managed to maintain
their livelihood. Both the family members were not satisfied about their live-in-
relationship. Anirudh's father was a rich man. He tried to convince his son & arrange a
marriage proposal with another girl of a well renowned family named Radhika. One day
Anirudh received a call by his father to meet Anirudh’s mother as she was not well. That
day Radhika & her parents were also invited to his house for ring ceremony. Being
captivated by the beauty of Radhika & family pressure, Anirudh agreed with the
proposal. It was not known to Sufiya. One day Anirudh left Sufiya saying that he has got
a good job at Udaipur. After arrangement of a house at Udaipur he will take her along
with him. Anirudh got married to Radhika on Nov. 08 2021 thereafter Anirudh regularly
neglected Sufiya but by that time Sufiya came to know that Anirudh is married to another
girl.

Then most of the time hatred arguments and hot words were exchanged between them.
During that time Sufiya was blessed with a girl child on Aug. 22 2022. Finally Anirudh
drove her away with allegation that the child born from Sufiya is an illegitimate one
hence he was reluctant to accept the child. Without getting any hope Sufiya took the
shelter of the Court & filed a maintenance case under Section 125Cr.PC for herself &
her child. Anirudh claimed that there was no marriage solemnized between them. So he is
not liable to pay the maintenance to Sufiya& her child.

Application rejected by the trial Court. Sufiya filed a SLP against this order before
Hon'ble Supreme Court.
Issues Framed :-

 Whether the live-in relationship is Legal / Valid.

 Whether the case is maintainable under Section 125 Cr.PC.

 Whether the child is a legitimate one.
