MOOT COURT PROBLEM- 2

Nalini and Suresh were engaged in living relationship from 1/10/2019. Both are working in
same Private Ltd. Company in Noida . Suresh proposed Nalini for marriage . She denied
from marriage right now . He asked the reason . She told him some family issues. Suresh
created a doubt at her. Suresh started to pursue Nalini .One day Nalini went to Relience Mall
with her friends to celebrate the birthday party of her friends. Suresh saw Nalini with her
friend Deepak hugging to each other.
One day 1/10/2020 Nalini was returning from the company by the cab Suresh with his
friends already sat in cab. They moved the cab in opposite direction and started physical
torcher and They were also intoxicated. They committed sexual assault and raped her after
that one of his friends stabled knife in stomach of Nalini and thrown Nalini into Hindan
river. when his friend sexually assaulted Nalini, Suresh objected one time for that but they
did not listen anything and continue raped her.
Nalini’s parents lodged an FIR against Suresh and his friends U/S. 34,364,376(D),120(B)
201 & 302. After 5 days Nalini’ dead body received by Police. Decide the charges and
Case on the basis of said FIR.

Rules Regarding Presentation:

1. Each student must prepare memorials from both sides and submit hard copy in
college at the time of presentation.

2. Each student must prepare argument for their defence.

3. All have to stand before the Jury Penal for argument.

4. You have to present your arguments in pair of 2-2 students
