WHO IS THE REAL OWNER?

China and Philippines are two countries that have been fighting over their claims to the Spratly
Islands in the South China Sea (West Philippine Sea). The dispute has been going on since 1974
when it was first brought up by-then Philippine President Ferdinand Marcos. However, it is only
now that China is taking a more aggressive stance against its neighbors.

The dispute began as a trade dispute between China and Taiwan over fishing rights in waters
near the Spratly Island. In 1974, then-President Ferdinand Marcos of the Philippines raised
concerns about Chinese ships illegally fishing in Philippine waters around these island.

In order to pursue economic gains from China, former President Duterte has minimized the
issue of territorial sovereignty in the South China Sea during his presidency. In line with this
strategy, he downplayed Manila’s 2016 arbitration victory, which rejected Beijing’s sweeping
claims of sovereignty and “historic rights” over the sea and was granted by a tribunal created
under the 1982 UN Convention on the Law of the Sea (UNCLOS). Since then, Manila has
maintained a flexible approach , frequently viewed as erratic by both domestic and foreign
observers, with the goal of fostering relations with Beijing in order to promote economic growth.
The Philippines sought to avoid the maritime issue harming its bilateral ties with the leading
economic and military force in the region by acting cautiously. (International Crisis Group, 2021)
