The Petitioner, being duly sworn, makes complaint to the above-named Court and states that there is probable
cause to believe that the Respondent committed the following offense(s):

COUNT 1

On or about February 10, 2023, in the County of Ramsey, Minnesota, Nosakhere Kazeem Holmes did cause
the death of D.D.E.S. without intent to effect the death of any person, while committing or attempting to
commit a felony, Assault in the Second Degree, and possessed a knife.

Said acts constituting the offense of Murder - 2nd Degree - Without Intent - While Committing a Felony in
violation of: §609.19.2(1); 609.11.4.

STATEMENT OF PROBABLE CAUSE

Petitioner states that the following facts establish probable cause:

On February 10, 2023, at approximately 1146 hours, officers with the Saint Paul Police Department were
dispatched to 1540 Sixth Street East (Harding High School), in the city of Saint Paul, Ramsey County,
Minnesota, on a report of an assault of a student. Lifesaving measures were initially being performed on the
student by school staff. Saint Paul Fire Department medics arrived and began treating the victim, identified as
D.D.E.S. (DOB: 04/08/2007). D.D.E.S. was transported to Regions Hospital where he was declared deceased.

An investigator with the Saint Paul Police Department interviewed witness J.C.S. who is the Assistant Principal
at Harding High School. J.C.S. stated he was walking the hallways between class times when he saw two
students arguing with another student. J.C.S. observed the students posturing like they were going to start
fighting. He saw them drop their bags and the students began fighting. J.C.S. identified the two students as
D.D.E.S. and a student whose name started with an “M” (later identified as M.B.). J.C.S. identified the student
they were fighting with as NOSAKHERE KAZEEM HOLMES (DOB: 08/31/2006). J.C.S. stated that
HOLMES was a student since the start of the school year, but D.D.E.S. began attending that day and “M” had
only been attending Harding for approximately a week. J.C.S. stated that he heard the students arguing, but
could not specify what was being said. J.C.S. stated he called for assistance from another staff member and
waited for him to arrive. Once the other staff member arrived, they both tried to stop the fight. J.C.S. removed
D.D.E.S. and the other staff member removed “M”. They separated the students. HOLMES got up off the
ground and he was now holding a knife. HOLMES then came at D.D.E.S. and swung the knife. HOLMES
struck D.D.E.S. on the right side of his chest. HOLMES then lunged at D.D.E.S. in a straight jab motion
striking D.D.E.S. in the stomach. D.D.E.S. realized he’d been stabbed and went toward the nurse’s
office. HOLMES walked away.

An investigator with the Saint Paul Police Department interviewed witness S.O.S., a Harding High School staff
member. S.O.S. stated he was walking with another student in the hallway when he heard a commotion and
turned to see two students, D.D.E.S. and HOLMES, with their fists up like they were going to fight. S.O.S. then
saw them fighting. He observed another student, later identified as M.B., join in the fight. S.O.S. saw
HOLMES on the ground with D.D.E.S. and M.B. on top of him, punching him. S.O.S. intervened and they all
started to get up. S.O.S. saw HOLMES reach into his pockets, so S.O.S. started to back away because he did
not know what HOLMES was reaching for. D.D.E.S. ran in the direction of S.O.S. and D.D.E.S. stated he
(D.D.E.S.) was hit in the chest. S.O.S. told D.D.E.S. to go to the nurse’s office. S.O.S. said D.D.E.S. said he
was dizzy and collapsed.

The incident was captured by multiple surveillance cameras. One video shows D.D.E.S. and M.B. walking with
a female in the hallway. As they approach the intersection to another hallway, D.D.E.S. and HOLMES begin to
exchange words. HOLMES squares up to D.D.E.S. and they appear to be saying something to one
another. D.D.E.S. turns to face HOLMES. D.D.E.S. drops his backpack on the ground. D.D.E.S. takes off his
jacket and both D.D.E.S. and HOLMES get ready to fight. HOLMES puts up his fists and the fight
begins. M.B. takes off his jacket and becomes involved in the fight. He appears to tackle HOLMES to the
ground. Once on the ground, D.D.E.S. moves in and throws punches, striking HOLMES as he attempts to get
off the ground. Both D.D.E.S. and M.B. are punching HOLMES as he gets to his feet. HOLMES turns his
back from M.B. and D.D.E.S. His hands are near his waistband. D.D.E.S. and M.B. continue to punch his
back. S.O.S. enters the frame and grabs D.D.E.S. HOLMES turns to face M.B., D.D.E.S., and S.O.S. There is
an estimated eight to ten feet between HOLMES and M.B., D.D.E.S., and S.O.S. Once facing them, HOLMES
begins to walk toward them. His hands are near the front of his waist. J.C.S. pulls M.B. backward. All four
(D.D.E.S., M.B., S.O.S., and J.C.S.) are walking backwards and HOLMES walks toward them. S.O.S. runs
away. D.D.E.S. is observed walking backwards as HOLMES advances on him. D.D.E.S.’s hands are

empty. A knife is observed in HOLMES right hand. HOLMES continues to advance on D.D.E.S. who
continues to back away. On a different camera angle, HOLMES is observed swinging his right arm and striking
D.D.E.S. at least two times. D.D.E.S. runs away from HOLMES. M.B., D.D.E.S., and S.O.S. move quickly
east and then north in the hallway. HOLMES continues to walk in their direction. J.C.S. points at
HOLMES. Two security guards are observed coming around the corner and they engage HOLMES and escort
him in the opposite direction which D.D.E.S. ran. Security staff then struggles with HOLMES and goes to the
ground. HOLMES is placed in handcuffs.

An investigator with the Saint Paul Police Department spoke with witness M.R.F. who works at Harding High
School as security. M.R.F. stated he heard a call on the radio that there was a fight. He and his partner began to
go toward the direction of the fight (10th grade hallway). While on their way, they heard on the radio that it was
a stabbing. M.R.F. estimated it took them about forty-five seconds to get there. J.C.S. was there already and
pointed to HOLMES and stated, “Nas stabbed someone.” M.R.F. used his body to block HOLMES and asked
him to stop. M.R.F. stated that HOLMES was upset and kept moving. HOLMES stated, “they jumped me-they
jumped me.” They tried to deescalate HOLMES, but it was not working. As they got closer to an outside exit
door, M.R.F. became concerned HOLMES would flee. They placed handcuffs on HOLMES. In the office, they
searched HOLMES. M.R.F.’s partner located a knife with blood on it. They put the knife in a plastic bag. An
officer arrived approximately ten minutes later, and they turned the knife over to police.

An investigator with the Saint Paul Police Department spoke with witness R.S.S. who also works at Harding
High School in providing security. He and his partner got a call on the radio that there was a fight in the 10th
grade hallway. R.S.S. and his partner responded and saw a staff member and D.D.E.S. As they were passing,
he observed D.D.E.S. had lacerations on his chest and waist area and was bleeding. When they arrived at the
incident location, they were told that HOLMES was the male that stabbed someone. At that point, they started
walking and talking with HOLMES. R.S.S. stated that HOLMES was irate and doing a lot of movements with
his hands. When they determined he might have a knife, they used their training to bring him down to the
ground in a safe place because HOLMES was still aggressive. They asked HOLMES to put his hands behind
his back. HOLMES did not cooperate and resisted. R.S.S. and M.R.F. were able to handcuff HOLMES and
escorted him into an office. R.S.S. located a “blade” from HOLMES’ left front jean pocket. R.S.S. stated that
the knife was folded, and he could see it was covered in blood. He placed it in a plastic bag.

The knife is a silver folding knife with a brown handle. The knife blade is approximately four inches in length.

An autopsy was performed on D.D.E.S. at 10:00 a.m. on February 11, 2023. The provisional autopsy report
indicated multiple sharp force injuries as the cause of death. Sharp force injury number one is of the left
chest. The wound tract is soft tissue of the chest, sternum, pericardial sac, and heart. Associated injuries are
hemopericardium, bilateral hemothoraces, and punctate wound of the left lung. The direction of the wound
tract is front to back, left to right, and slightly downward. The depth of the wound tract-2 7/8 inches. Sharp
force injury number two is to the abdomen. The wound tract is of the soft tissue of the abdomen only. The
direction of the wound tract is front to back, right to left, and downward. The depth of the wound track-1 3/4
inches. The manner of death was determined to be homicide.
