Dear Mr. Walther :

This is in response to your letter dated June 4, 2009, to the Bureau of Alcohol, Tobacco,
Firearms and Explosives (ATF) . You requested a special explosive device exemption pursuant
to the regulations at 27 CFR 555 .32 .

According to your letter, you import marine safety pyrotechnic products, which the U .S . Coast
Guard and International Maritime laws require on all commercial vessels. You provided the
following information for each device : catalog page, Declaration of Conformity from the
manufacturer, data/technical sheet, U .S . Department of Transportation (DOT) Competent
Authority, U .S . Coast Guard Certificate of Approval, and Material Safety Data Sheet .
Specifically, you are requesting exemptions for the following marine safety products :

Chemring Defence, the manufacturer of these devices, certifies that the Speedline 250 Rocket
and Linethrower are lifesaving equipment, not military weapons .

The regulation at 27 CFR 555 .32 states, in part, that "The Director may exempt certain explosive
actuated devices, explosive actuated tools, or similar devices from the requirements of this part .
A person who desires to obtain an exemption under this section for any special explosive device,
which as designed does not constitute a public safety or security hazard, shall submit a written
request to the Director ."

The following devices are self-contained and designed for signaling in emergency or distress
marine situations :

After careful review, we believe that these devices do not pose a threat to public safety when
possessed and used for their intended purpose. Therefore, we are exempting these products as
special explosive devices.

The following devices are not self-contained and use individual explosive cartridges fired from a
separate firing mechanism :

Miniflare 3 Miniflare MK8 Personal Distress Miniflare MK8 Compact Distress

However, Chernring Defence ships and sells the explosive cartridges and firing mechanisms in
individual water-resistant cases . These devices use a handheld pen-type firing mechanism
(penjector) to fire a flare cartridge that emits a bright light during the day or night . Each
cartridge contains 4'/4 to 5 grams of explosive materials. Each kit contains a firing mechanism
and three to eight flare cartridges, which are designated in the DOT Competent Authority
documents. According to your conversation with ATF Program Manager Mike O'Lena, you
only distribute the cartridges in the complete kit with the firing mechanism .

After careful review, we believe that these devices do not pose a threat to public safety when
possessed and used for their intended purpose. Therefore, we are exempting each kit as a special
explosive device . Keep in mind that any change to the packing methods described in the DOT
Competent Authority documents would require further evaluation by ATF .
