the Arresting Officer during the alleged

Officer that time?
4. When was this designation of you as the
Arresting Officer happened?
5. Do you have any written proof of such
designation?

the prosecution, is this the affidavit you
mentioned you executed?
7. Now, you mentioned Mr. Witness in you
affidavit, particularly Par. 2 that at about
9:00AM of February 6, 2022, you together
with other personnel of Baggao PS led by
PMAJ GIL Pagulayan Jr. COP was manning a
COMELEC checkpoint in Sitio Atananggenet,
Bitag Grande, Baggao, Cag., do you still
affirm that?
8. Do you have a Memorandum or any order
coming from the COMELEC authorizing you
to conduct COMELEC checkpoint at Sitio
Atananggenet, Bitag Grande, Baggao, Cag. At
that time? Proof?
9. You also mentioned in your affidavit
particularly Par. 3 that your COP informed
you about the text message from an
unidentified sender in your Hotline Number
informing that he saw a male person
wearing black sweat shirt and pink short
pants with sling bag showed his firearm to
his fellow customer thereat, do you still
affirm that?
10. Were you around during that time when
your COP received this text message?
11. What time was this wwhen your COP
received this text message?
12. Do you personally know the sender of the
text message?
13. So, you relied merely on the information
supplied by this person, correct?
14. You believed this person immediately,
correct?

given is that the male person was wearing

still affirm that?
19. Where you around during that time when
your Intelligence Operatives called?
20. Can you please tell us the names of your
Intelligence Operatives?
21. Now, do you any proof of this actual
conversation that you mentioned, between
your COP and your Intelligence Operatives?
22. So aside from the bare allegation, you
cannot show us any proof to prove this,
correct?
23. That is despite of the fact that you have an
assigned videographer at that time, correct?
24. By the way, what time was this when your
Intelligence Operatives called?
25. You also mentioned in your affidavit
particularly Par. 5 that while manning the
checkpoint, you saw an approaching red
single motorcycle driven by a male person
with the description of the unknown
informant prompted you to signaled your
hands as to stop him however, the suspect
suddenly swerved and evaded the
checkpoint but you were able to stop him,
do you still affirm that?
26. Now, can you show us any proof Mr.
Witness of your allegation that the suspect
suddenly swerved and evaded the
checkpoint?
27. That is despite of the fact that Officer
Aprille Monique Ballena was designated as
the videographer, correct?
28. You also mentioned in your affidavit
Particularly Par. 6 that upon checking the
suspect, you and your companions were
able to see the protruding handle grip of a
 firearm from his unzipped sling bag that
prompted you to immediately freezed the
accused, do you still affirm that?
29. And you would agree with me Mr. Witness
that again you do not have a video of this
particular incident, correct?
30. That is despite of the fact that your team
were given all opportunities to take a video,
correct?
31. So you want us to believe, you want to
impress this HC that during that time the
bag was unzipped and that handle grip of
the alleged firearm protrude?
32. Knowing that the accused will pass through
a COMELEC checkpoint, correct?
33. And after that, did you immediately conduct
your inventory and making of the pieces of
evidence?

you conducted the inventory?
