“planned” however, there is no mentioning of : SURVEILLANCE, CASING, TEST BUY nor
BACKGROUND INVESTIGATION of the IDENTITY and of the activities of the accused?

Can u describe it ? was it done in an enclosed or open area? Along the road? Near houses/
structures thereat?
At what time was the BB opn conducted?

You did not prepare a sketch relative to your respective positions knowing the exact place of
the opn and having planned it as you claim?

During the briefing and before proceeding to the place of BB opn, no one from your team
members body frisked you for possible possession of illegal drug?
How did you go to the place of BB opn? __________________________________
Who was with you? ______________________________________
How about the rest of the team, how did they go to the place of BB opn?
Where were they located? ______________________ How far from you?________________
Note: members of BB team shall be at least 2 arresting officers and 1 P-Buyer

ARRIVAL AT PLACE OF BB OPN (DURING THE BB OPN )

Why was there a need to ask again the amount of the drug to be bought if in deed there was
an initial contact with the accused and in which you claim to have heard them talk thru call?
(If accompanied with others) When you saw the accused (subject person ) he was with other
persons?
And these persons were not familiar with you and they were not subjects of the BB opn?
When you saw them, they were not doing anything illegal correct? _____________________
And you arrested them simply because they were with the accused who happen to be the
subject person of your alleged BB opn? ________________

INVITATION/ PRESENCE OF WITNESSES

Who? What time did contact? If contacted, who did it?
When you proceeded to the place of BB opn, the witnesses were not with you now with the
other members of the team?
And they arrived only after the arrest of the accused and during the marking and Inventory of
the seized items? What time was that?
Although you claim that you contacted the witness, they were only present after the arrest of
the accused and during the M and I?
Although you claim that you contacted the witnesses before proceeding to the place of BB
opn, and they went with you at the place of BB opn, you were not familiar or sure of their
exact location during the illegal sale transaction because you were with the CI and the
accused?
If insist that knows the exact location— BUT you admitted earlier that you did not prepare
any sketch as to your respective positions during the conduct of the BB opn so how would
you know their exact location and distance from you?
CONDUCT OF BB OPN
During the alleged exchange or transaction, it was you, the CI and the accused who were
there?

Right after confiscation of the alleged sachet of shabu/MJ, where did you keep it? (if
unknown)
(If two or more sachets) how about the other sachets you confiscated, where did you put
them?
(if put in his pocket) You claim that you put inside your pocket the sachet of illegal drug (SM
of BB opn)? How about the other sachet?
You put inside your pocket the seized items without immediately marking them first to
identify them separately from each other?
And you admitted earlier that no one frisked you for possible possession of an illegal drug
before you kept that sachet into your pocket correct?

MARKING/ INVENTORY/ TAKING OF PHOTOGRAPH

Where did you conduct the marking, inventory, taking of photo? _______________

Would you agree with me that in these photos, the document being written on is not clearly
identifiable?
Check the photos whether sachets and markings appear, other evidences, BB money?
Check if the date and time in the Confiscation Receipt is reflected in the photos compared
to what you have submitted as part of the record of the case?

Would you agree with me that although you claim that you did the marking, inventory at the
place of BB opn, this photos show otherwise because they appear to have been taken at the
police station (your station) , other place and not at the exact place of BB as you described
earlier?
(if not in the place of BB opn) You claim that there was risk, commotion etc. but you failed to
prove such claim through evidence such as documents nor pictures?

And you did not arrest any of those who caused the commotion nor filed any case against
them?

INVENTORY/CONFISCATION RECEIPT & MARKING

You claim that you prepared a Confiscation/ Inventory Report?

And based on this CR, only the witnesses signed the same but accused did not?

And for having failed to let him sign the said receipt, you likewise failed to give him a copy of
the same correct?

You marked the seized items using your initials and no other markings?

(Check the proper markings and the CR if Coincide; PNP Drug Enforcement manual: date,
time and place of confiscation be made)

TURN OVER TO INVESTIGATING OFFICER

Who was the Investigating Officer on Duty or on case?

You did not mention in your Affidavit that you turned over the seized items and accused to IO
for documentation?

And you stated in your SS that you turned over the seized items and accused to IO who
likewise turned over the same to the TCLO? ________________________ At what time?
TURN OVER TO THE FORENSIC CHEMIST
After the alleged documentation or marking/ inventory, WHO brought the seized items to
TCLO? __________________

At what time did you leave the station going to TCLO? _______________

At what time did you arrive there and who received the seized items? ______________________

(If answer is did not notice the missing stamp), wouldn’t you know the effect of your failure to
check the details of the report esp the stamp as proof of receipt of the same by the forensic

According to you, the accused handed the illegal drug when there was an exchange of shabu
and you saw it?

In fact you did not hear what they talked about before the alleged exchange?

And when the exchange took place you were not sure at that time what was handed to the PB
whether it was illegal drugs or not considering the distance and the area where you were
situated at that time from the place where the alleged BB was taking place?

And you came to know of the alleged illegal drug only when the accused was already
arrested?

Who called up the witnesses? What time did they arrive? During the Marking and Inventory ?
