Erin has entered into a contract to construct a swimming pool at Nurin’s house. Erin ask
Haziyah Hardware to send materials needed to Nurin’s house and promises to pay three
days after the material has been sent. Erin did not pay as promise and when Haziyah
Hardware went to Nurin’s house to take possession of the materials, it was discovered that
Erin has sold the material to Nuru after Nurin’s cancelled her intention to build a swimming
pool. Immediately, Haziyah Hardware contacted Nuru to recover the materials from Nuru.
Advise as whether Nuru has ownership to the materials.

not make any payment to Haziyah Hardware but promised to pay once he receives initial
payment from Nurin. After a discussion, Haziyah Hardware agrees to load some of the
materials into Erin 4x4 Ford Ranger. After 2 weeks, Haziyah Hardware contacted Erin since
no payment is receive from Erin. Haziyah Hardware was told by Erin that Nurin has cancel
her intention to build a swimming pool and Erin has sold the materials to Nuru. Immediately,
Haziyah Hardware contacted Nuru to recover the materials from Nuru. Advise as whether
Nuru has ownership to the materials.
