ABOUT THE EVENT

This competition was designed to evaluate the legal understanding of students


around the country while also promoting and improving skills about the trial
court's procedure. It assesses the law students' understanding of both laws
and facts. This is actually an endeavour to give law students a platform like this
so they may understand the fundamentals of trial court, which will in turn
broaden their scope of learning. Trial advocacy courses at law schools often
emphasise tactical abilities, however some also include the fundamentals of
strategic planning. Because of the imbalance they produce, especially when
used against attorneys who are not aware of them, several scholars have
expressed disfavour with advanced strategic approaches. The only effective
way to address the systemic inequities that already exist, such as those
between working-class plaintiffs and affluent corporations and impoverished
defendants and the state, is, according to proponents of advanced strategic
strategies.

As one of India's upcoming graduate institutions, we are always taking action


to provide thorough and important legal education to gifted young talent from
all across the nation. In the course of such endeavours, we have observed that
strong backing talents, the ability to think prudently and judiciously, together
with discernment for drafting, are some of the main qualities that are currently
required of a legal advisor. Keeping in mind these requirements, we are setting
up a virtual path advancement competition where the trainee attorneys must
think like an Advocate, think beyond the box, and apply legal rules to current
situations. We are pleased to announce that we will have the Trial Court
Advocacy Tournament-2023 in Symbiosis Law School, Nagpur for the first time.
About the organisers
Symbiosis International (Deemed University) offers varied and content rich
programmes which are industry specific and has multi-disciplinary approach.
These programmes are offered through the constituent institutes of the
University which are under the aegis of separate disciplines viz. Law,
Management, Computer Studies, Health Sciences, Media & Communication,
Humanities & Social Sciences, Engineering and Architecture & Design

Definitions

 Administrators: Administrators shall be constituted by the college


committee

 Tournament: means Trial Advocacy Tournament,2023


 Disqualification: Means that the team will not be allowed to participate
in the competition and therefore, shall not be awarded a Certificate of
Participation or any prize.

 Judge: Means any person appointed to evaluate a Participant’s


memorial or oral pleading.

 “MOOT PROPOSITIONS/COMPROMISE”: Means the official


Compromise including the annexures as well as the evidence and
testimonies of the Competition supplemented or corrected by any
Compromise Clarification or Correction as published by the
Administrators.
 MEMORIAL: Means the written submissions by each participating
Law College/ School/ University submitted pursuant to the Rules of the
Court.

 PENALTIES: Means points deducted for violation of any rule by the


participants

 PARTICIPANTS: Means student representatives from eligible Law


College/School/University, recognized by the Administrators,
participating in the competition.

 RULES OF THE COURT/ RULES: Mean the official rules of the


Tournament

Rules
a. The language of the written and oral arguments shall be in English.
b. The participants shall have to prepare the case for Examinations in Chief
and Cross Examination of witnesses from both Prosecution and Defence
side and prepare their arguments from both sides. Examination in Chief
and Cross Examination shall only be conducted orally and no written
submissions required for the same.
c. The competition comprises of Preliminary Rounds and Advanced rounds
which would include the Semi-Final Rounds and the Final Rounds.
d. Each Team would not face the same team in the preliminary rounds, nor
would the same bench judge the same team more than once in the
preliminary rounds.

Memorial
a. APDefence.
b. The Cover Page of each memorial must contain the
following information:
c. The Team Code should be mentioned in the upper right-
hand corner.
d. Name of the competition
e. Party for which the Memorial has been prepared.
f. Name of the court where case is brought.

Format of memorial
1) Typing of Memorial should be as per specification given below:
I. PAPER SIZE – A4 NOT MORE THAN 70 GSM
II. FONT SIZE – 12
III. FONT TYPE – TIMES NEW ROMAN
IV. LINE SPACING – 1.5
V. MARGINS – 1 INCH ON EACH SIDE

Rounds
A. THE COMPITITION SHALL RUN IN FOUR ROUNDS, i.e.,
I. Preliminary
II. Preliminary II
III. Semi Finals and
IV. Finals
B. All the rounds except Preliminary round shall be the Knock Out rounds.
C. In Preliminary I & Preliminary II, all teams shall present their case
before the trail court from both sides respectively. Further, the
Administrator will intimate prior to one day before the competition in
respect to the team representing in the preliminary round.
D. Top 4 teams from the Preliminary rounds shall qualify to the Semi-Final
Rounds.
E. In deciding the teams for the advanced rounds, the following
procedure will be followed:
F. Teams with the highest number of scores in Preliminary I & Preliminary
II Rounds (including the scores of both Preliminary I & Preliminary II)
G. If in any case ties exist, then the marks of the memorial for the
Competition shall be compared to determine the ranking inter se.
