This is to confirm your probationary employment with NADI’S ITALIAN, INDIAN, and FILIPINO
RESTURANT under the following conditions:

1. Engagement
The Company hereby engages and employs your services as per below:

You shall perform such duties and discharge such responsibilities as required by the
position, and as may be assigned from time to time by the Company.

2. Probationary Period
You shall be on probationary status for six (6) months commencing on 25th APRIL 2019 until
24th OCTOBER 2019, unless you are notified in writing on or before the latter date your
services will no longer be continued. During this probationary period, you will be working on
a trial basis and your conversion to permanent status shall be determined on the basis of
such standards such as satisfactory work performance, acceptable record, compliance with
the policies, rules and regulations, qualifications and suitability for regular employment and
operational requirements of the Company. You shall be evaluated on the 3rd and 5th months
for confirmation based on your performance from start date.
3. Compensation
You will receive a basic gross salary of _______________(PHP______)per month and paid
out twice a month subject to taxes.

4. Advances
Employees are not allowed advances unless with express consent of the employer subject to
said employer’s discretion and for just causes.

5. Duties and Responsibilities


You shall perform the duties and responsibilities assigned to you by the Company with a
high degree of honesty, diligence, efficiency, courtesy, safety, skill, obedience, and
trustworthiness. These duties and responsibilities may change according to the needs of
the Company. You recognize the right and prerogative of the Company to change your
duties and responsibilities according to the Company’s needs.

You shall strictly comply with all the rules, regulations, and policies which may be issued by
the company from time to time as well as the instructions made by your supervisor, other
authorized officers and agents of the Company. Violation on your part of such rules,
regulations, and policies shall result in the imposition of the necessary disciplinary action
against you, including employment termination.

You agree that you shall be held solely responsible and accountable for any amount of
company funds that comes into your possession by reason of your position and exercise of
your duties.

6. Bonus
You shall be entitled to a pro-rated 13th month pay effective on your start date.

7. Statutory Benefits
The Company will provide you with all the benefits prescribed by law such as but not limited
to the Company share for your contributions to Social Security System, Philhealth and
Home Development Fund (PagIbig).

8. Accident Insurance
You shall be covered with a local accident insurance policy set up by the Company, which
covers only work-related accidents.

9. Meals
Entitled for duty meals specially prepared by kitchen. Meals hours will be rotational.

10. Vacation and Sick Leave


Your leave entitlement shall be calculated on a pro-rata basis effective upon start date. You
shall be eligible to five (5) service incentive leave after one (1) year of service, non-
cumulative and not convertible to cash, if not availed.
11. Working Hours
You are required to work forty eight (48) hours per week and shall be entitled to one (1) day off
each week. The day, hours, time of work may be reviewed, altered, or modified by the Company
according to its business needs.

Because of the nature of your duties, there may be occasions when you have to work in excess
of or on days or hours other than those that have been initially communicated to you. You
agree to render such work as may be required by such occasions. You further agree to render
overtime work and work during night time.

12. Regular Day Offs


Employees are entitled to 1 off a week which the day of which will be subject to the decision of
the employer in accordance with the what the employer deems best to the operations of the
business. However, employees may avail of a specific day for his or her day off at least 7 days
before said preferred day, approval of which is subject to the discretion of the employer.

13. Time in and Time out cut offs


The company requires strict compliance with shifts, in order to maintain its flow in business
activities employees are required to be in work premises attending to their duties at their
scheduled time. Tardiness will be subject to deductions in accordance with the following rules:
i. 15 minutes will be considered to 30 minutes of being late
ii. 30 minutes will be equivalent to an hour
iii. 1 hour (60 minutes) will be equivalent to half a day

14. Absences
Employees are required to previously notify the employer at least 1 day (24hours) before said
absence or within reasonable time subject to just circumstances about said emergency absence
if said event disables time to attend their shifts. Every absence taken should be accompanied
with evidence in support of said absence. Employer reserves the right to disciplinary action for
absences done last minute or without proper notice, or just cause. Absences without notice,
absences with notice but for an unreasonable amount of time, or absences without just cause
for a period of 3 days whether chronological or not shall be subject to disciplinary action by the
employer.

15. Right to Transfer


The Company has the right to transfer you to work in any department or subsidiary in any
capacity appropriate to the status during the term of the employment, provided that such
transfer does not entail a change to the detriment of your employment.

16. Seasonal Company


The industry of hospitality is mostly based and dependent on year-round season especially
type of restaurant we are operating (mainly Italian & Indian cuisine). During monsoon
season from the month of June to September, the Company may put the employee on
forced leave in accordance with the Philippine labor law.
17. Exclusive Engagement
You shall exclusively devote to the affairs and business of the Company and will not directly or
indirectly in any manner be interested or be engaged personally in any advisory capacity or in
business, except with the Company’s written consent.

18. Time in and Time out cut offs

orderly flow in its operations. Employees are required to be in work premises attending to their

20. Disciplinary Action


Employees are required behave in an appropriate manner with each other and with the
managerial staff. Employees that violate rules and regulations of the company will be subject to
disciplinary action ranging from suspension to termination as well as deductions in proportion to
said act or omission prejudicial to the operations of the company.

21. Uniform
Employees are required to wear the uniform or color schemes the company adheres to.
Employees failing to follow the uniform policy of the company will be subject to disciplinary
action by the employer.

22. Confidentiality
You shall not at any time either during the life of the Contract or after its termination, except
by concurrence and written consent of the Company divulge any secrets or dealings of the
Company to any other company, person or persons. You agree that all Company records,
documents and properties in your custody or control shall be immediately surrendered to the
Company, if requested during the term of your employment, and at the termination thereof,
whether or not requested.

Furthermore, all records, written information, and trade facilities owned by the Company
which shall come into your possession shall be fully accounted for and turned over to the
company upon termination of your employment.

23. Notice Period


You have the right to terminate this employment agreement by providing notice in writing
thirty (30) calendar days in advance. Your notice shall be fully accepted by your immediate
superior. The Company has the right to waive the notice period at its discretion. You may
terminate your employment without notice under the conditions provided by the Philippine
Labor Code for such. Unless the Company waives in writing the notice period, your failure to
comply with the notice period stated in this contract shall make you liable to the Company
for liquidated damages equivalent to one (1) month of your basic salary.

24. Damages
You hereby agree to protect, defend, pay on behalf of, save and hold harmless Company
and their owners and employees against and from all claims, damages, losses and
expenses, however the same may be caused by reason of any suit, claim, demand,
judgment or cause of action initiated by any person arising or alleged to have arisen directly
or indirectly out of the performance of your work.

25. Complete Terms


You acknowledge, agree and accept the employment terms with the Company are in
accordance with the provisions contained in the Contract.
