Serious physical injury (case)

Narration:

Andres Villanueva, a defendant-appellant, who was sentenced to two months and fifteen days and asks
a higher court to review the trial court's decision. Wherein, there are some mistakes that can changed
the final decision or judgement in the case. According to the previous pleading, Villanueva is fighting
against his opponent, Isidro Benter. Then, he suddenly snatched the bolo from Isidro which latter
inflicted wound and caused him not to work for more than 30 days.

However, it turned out that Villanueva was not Benter's opponent and there was no any quarrel
between the two. Eventually, Villanueva didn't inflicted any kind of wound upon Benter and injured
himself by an accident of his own act. Upon questioning Benter in court, he added that Villanueva was in
a good temper and there was no disputation between them. In addition, there are two witnesses who
testified that Benter had said nothing as to who had wounded him.

According to the court, there was no crime committed, wherein Villanueva has no intent to wound
Benter and it was Benter who wounded himself carelessly.
