Week 5 – The Beneficiary Principle and exceptions

A mixed issue problem question

Rosie was someone who travelled extensively and was particularly fond of travelling around India.
Over the years she had amassed a significant amount of wealth and this included a piece of land
known as ‘The Lawns’ and located in her home village of Billington. Earlier this year Rosie died and
left the following in her will:

a) £100,000 to be used to renovate a specific building as a monument to herself. Rosie wants


something like a mini Taj Mahal for herself.
b) £10,000 to her local yoga club to be spent on yoga mats, candles and yoga retreats. The yoga
club has 2 members left and they are thinking of disbanding and reforming themselves into a
tennis club instead. The yoga club members would like to spend the money on tennis
equipment instead of yoga.
c) The ten most valuable pieces of jewellery to be sold and the proceeds divided equally
between Rosie’s friends who have travelled to India with her.
d) The Lawns to be held for the villagers of Billington so that they can use it as a cricket ground
for as long as the law will permit them to use it in this way. Some of the local villagers are
very excited by this and looking forward to playing cricket on The Lawns.
e) £100,000 to Rosie’s nephew Adam, in the certain knowledge that he will use it for good
causes that promote travelling to India.

Adam is also the residuary legatee and would like to know which of the above dispositions are valid?
