Appellant

Summary of arguments

Issue 1

Whether it is proved beyond reasonable doubt that the convict had a motive to murder the
deceased?

It is humbly submitted before this hon’ble court that the appellant had no motive to kill
Prakash Mane, he is being framed by interested witness. He was at home when the incident
took place, as corroborated by an alibi.

Issue 2

Whether it has been proved beyond reasonable doubt that the chain of circumstances
appearing against the convict is so complete that it is not only consistent with the inference of
guilt but also inconsistence with his innocence?

It is humbly submitted before this hon’ble court that the evidence i.e., witness statement and
forensic science laboratories reports in the present case does not sufficiently establish the
guilt of the appellant. There is an incomplete chain of circumstantial evidence to establish
guilt of the appellant beyond reasonable doubt.

the deceased?

It is humbly submitted before this hon’ble court that appellant had motive to commit murder
of Prakash Mane. The evidence and facts which prove constant family dispute and the
presence of appellant near the place of incident with an axe, forms a complete chain, link by
link, to establish the same.

Issue 2

Whether it has been proved that the chain of circumstances appearing against the convict is
complete to draw inference of guilt?

It is humbly submitted before the hon’ble court that the evidence in the present case
sufficiently established the guilt of the appellant for the murder of Prakash Mane. The chain
of circumstantial evidence as formed by the respondent has been established beyond all
reasonable doubt that the appellant is guilty.
