SECTION 01_33_00

SUBMITTAL PROCEDURES

PART 1. GENERAL

1.1. CONTENT

A. Requirements and procedures for submitting documents defined herein, for review and comment
at the stage of approval for construction by Designer. The Designer maintains the right and
responsibility to review submittals for quality control effectiveness, timeliness, certification, and
compliance with contract documents.

1.3. ADMINISTRATIVE REQUIREMENTS

A. Administrative Requirements for Submittals: Submittals shall be made in accordance with


requirements specified herein and in other Divisions of the Specifications.
a. All required submittals, with the exception of O&M, shall be submitted within 90 calendar
days after the project’s construction phase start date.
B. Contractor Coordination of Submittals: Coordinate preparation and processing of submittals with
performance of construction activities. Transmit each submittal sufficiently in advance of
performance of related construction activities to avoid delay.
a. Coordinate each submittal with fabrication, purchasing, testing, delivery, other submittals
and related activities that require sequential activity.

b. Coordinate transmittal of different types of submittals for related elements of the Work
so processing will not be delayed by the need to review submittals concurrently for
coordination.
C. Submittal Log: Prior to proceeding with affected work, Contractor shall prepare and submit a
Submittal Log, which lists submittal items for review and approval by the Designer and Owner.
Submittal Log shall identify all specified submittals to be made and shall serve as checklist for
submittals.
a. Maintain accurate submittal log for duration of Contract. Indicate current status of all
submittals at all times. Submit log at progress meeting and as otherwise requested by
the Designer.
D. Transmission of Submittals: Submittals shall be processed electronically (with exceptions such as
product and material samples). Transmit all submittals from Contractor to Designer via Electronic
Project Management (EPM) systems, unless otherwise directed, using a transmittal form for each
one.
E. Timing of Submittals: Make submittals sufficiently in advance of construction activities to allow
shipping, handling and review by the Designer. Allow sufficient review time so that installation
will not be delayed as a result of the time required to process submittals, including time for
resubmittals.
a. The Designer will make desired corrections and consolidate relevant comments within
three (3) calendar days per each independent Submittal. In the case of groups of up to 3
submittals and submittals that require coordination with other submittals, the Designer
will be allowed a review time of seven (7) calendar days and, for groups greater than 3 a
review time will be defined between the projects work team, prioritizing the most critical
elements.
b. Submittals will be returned to the Contractor via EPM system.
c. Contractor shall make corrections required by the Designer and submit via EPM system
for final review and distribution, within four (4) calendar days after receiving the
Designer’s comments.
d. No extension of Contract Time will be authorized because of failure to transmit
submittals to the Designer sufficiently in advance of the Work to permit processing.
F. Grouping of Submittals: Unless otherwise specifically permitted by the Designer, make all
submittals in groups containing all associated items. The Designer may reject partial submittals
as incomplete or hold them until related submittals are made.

A. Submittals will be reviewed for conformance to requirements of Contract Documents.
a. Review of separate item will not constitute review of assembly in which the item
functions.
b. Review will not relieve Contractor from his responsibility for accuracy of submittals,
conformity of submittals to requirements indicated, compatibility of described product
with contiguous products and rest of system, or for prosecution and completion of
Contract in accordance with Contract Documents.
B. Submittal responses have the following meanings:
a. The mark “APPROVED”: Is an approval, and it means product, material or installation
appears conform to respective requirements of Contract Documents. Fabrication,
assembly, manufacture, installation, application, and erection of the illustrated and
described product may proceed; submittal need not be resubmitted.
b. The mark “APPROVED AS NOTED OR APPROVED WITH CONDITIONS”: Is an
approval, and it means every illustration and description appears to conform to
respective requirements of Contract Documents upon incorporation of reviewer's
corrections.
i. If Contractor accepts corrections, then fabrication, assembly, manufacture,
installation, application and erection of illustrated and described product may
proceed. Submittals so marked need not be resubmitted. Show reviewers'
corrections on As-Built Drawings in accordance with Section 01 78 39 – As-
Built Drawings and Current Status Documents.
ii. If Contractor challenges validity of reviewer's exception, no Work on this issue
will be allowed until there is a written resolution to the challenge. Show the
reviewer’s corrections on As-Built Drawings in accordance with Section 01 78
39 - As-Built Drawings and Current Status Documents, once disagreements
are resolved.
c. The mark “REVISE AND RESUBMIT”: Means that submittal did not fully demonstrate
full extent of all conditions, details and coordination with other surrounding work and
therefore requires additional information as noted by The Designer’s comments. The
Contractor must correct or complete information as indicated by Designer´s comments.
d. The mark “REJECTED”: Is rejection, and it means submittal is deficient to the degree
that a reviewer cannot correct submittal with reasonable degree of effort and the
submittal needs revision and is to be corrected and resubmitted, within four (4) calendar
days for review.

e. The mark “RECORD ONLY”: Means submittal was not reviewed for approval and was
received for information only.

1.5. CONTRACTOR’S RESPONSABILITY

A. Contractor shall present submittals for products to be installed and installations to be carried out,
as a shop drawing. Any work performed prior to receiving a fully approved submittal shall be done
at the Contractor's risk and shall be subject to being replaced, without impact to the project’s cost
and schedule, if Contract requirements are not met.
B. Coordinate each submittal with requirements of Work. Place particular emphasis upon ensuring
each submittal of one trade is compatible with other submittals of that trade and submittals of
other trades.
C. Approval by the Designer of submitted Drawings and associated calculations does not relieve
Contractor from responsibility for errors or omissions in Drawings and associated calculations, or
from deviations from the Contract Documents, unless such deviations were specifically called to
attention of the Designer in a Transmittal submitted with Drawings. The Contractor is responsible
for correctness, accuracy, and completeness of drawings, for shop fits and field connections,
dimensions, and quantities and for results obtained by use of such drawings.
D. Verify field measurements, catalog numbers and similar data.
E. The Contractor must refer to Appendix A, in which the base list of electromechanical submittals is
presented. The Contractor shall present all the submittals on the list with the exception that they
do not apply to the specific project to be worked on.

1.6. SUBSTITUTIONS

A. Substitute products should not be ordered and shall not be installed without written approval or
acceptance from Designer. Contractor assumes all risks associated with premature ordering and
installation of substitute products, without impact to the project’s cost and schedule.
B. The specifically named manufacturers, products, and systems, and descriptive characteristics
used in the Contract Documents normally serve only to establish a level of quality and a
performance standard. Unless specific restriction is placed upon an item in the specifications,
Contractor may submit proposals for substitutions. The Owner reserves the right to disallow
substitutions. Contractor assumes risks associated with possible rejection of proposals for
substitution submitted during the life of the contract.
C. Delays caused by tardiness of Contractor in preparing and forwarding submittals do not constitute
an acceptable basis for consideration of substitute products. Delays due to factors which were in

effect prior to project bidding do not constitute an acceptable basis for consideration of substitute
products.
D. SUBSTITUTION REQUEST
a. Requests for substitutions shall be submitted to Designer on the form exhibited as
Section 01 25 33, or in a similar format which provides the same or more information.
b. When making requests for substitutions, Contractor assumes the following
responsibilities:
i. To have personally investigated the proposed substitute product and
determined it is equal or superior in all respects to that specified;
ii. To provide the same warranty for substitute that Contractor would for that
specified;
iii. To provide complete cost data, and waive all claims for additional costs related
to substitution which subsequently become apparent; and
iv. To coordinate installation of the accepted substitute, making such changes as
may be required for Work to be complete in all respects.
