WHAT IS THE RELEVANCE OF RA 10173 TO OUR ON-LINE

CLASSES?
“Data Privacy Act of 2012” or “DPA” refers to Republic Act No. 10173. An act protecting
individual personal information in information and communications system in the government
and the private sector, creating for this purpose a national privacy commission, and for other
purposes. Any freely provided, precise, and informed indication of will that the data subject
gives in order to permit the gathering and processing of his or her private, sensitive personal, or
confidential information is referred to as "consent of the data subject." Consent must be verified
in writing, electronically, or by recording. It may also be supplied on a data subject's behalf by a
legitimate representative or an agent who has been given express permission to do so.

The impact of Covid-19 pandemic on education had brought numerous coping strategies on
our curriculum. This crisis has exposed the many inadequacies and inequities in our education
systems – from access to the broadband and computers needed for online learning.This is where
what we call data sharing comes in, it is the release or transfer of personal data to a third party in
accordance with possession by a controller or processor of personal information. In the latter
scenario, the disclosure or transfer must have been carried out as directed by the relevant
personal information controller. The phrase precludes outsourcing, as well as the disclosure or
transfer of personal data from a controller to a processor.

Personnel at an educational institution are not permitted to utilize personal information they
have gathered in the course of their official duties or while engaged in official activities. If the
educational institution has a social media policy, sharing such information on personal accounts
might be against it and result in disciplinary action. On the other hand, they must first get
consent from the concerned data subjects in line with the principles of fairness and openness if
they have gathered personal data in their individual or personal capacity and wish to use it for
work-related reasons.
