Scenario:

As a member of the Thebarton Logic legal department, you get many requests and today, one of the
company’s web developers has come to ask for your help. The web development department provides
various high-quality programming and design services to its clients. The department is specialised in
making web sites for all types of consumers in the market. The department has more than 100
employees for web site development.
Clients can range from individuals seeking a personal website to businesses who require complete e-
commerce solutions. Recently, the Thebarton Logic web development team have been working with a
new company that is involved in homewares and furniture design. One of the members of this
department have approached you and voiced their concerns after telling you about the following
scenario:

The web developer has provided the plans they have received from the start-up furniture company, and
from the samples you have, it is clear that many of the furntiture designs and names are very similar
to those that can be found at Ikea, including some designs that have simply been repurposed from the
Ikea catalogue. Further to this, the logo for the new company is just about an exact replica of the Ikea
logo.
The manager of the new company believes that since Ikea has already lost two cases of infringement
against its design(s), that he will be secure in his attempts to create this new company, despite its
apparent similarity to Ikea. They want your web development department to move ahead with a
website for them, based upon the designs that they have provided. The web development team have
concerns and have come to you as a result.
Upon further investigation (each student must obtain further information by posing a relevant question
regarding the scenario to the trainer), it becomes clear to you that the new company does not have
any policies on IP, ethics or privacy, which could prove damaging for Thebarton Logic if they develop
the website for this company.

You will be required to write a report to the web development department advising them of the dangers
ofproceeding with the website for the new company and giving them some advice of how to educate
the new company on the requirements they should be meeting.
Before you begin, you should re-familiarise yourself with the laws surrounding the following. You might
also like to review Thebarton Logic’s policies which are available for you to use:

explanation of it’s contents and how they should proceed. Your trainer will be the ‘Web Development
department’.
