The Consumer Act of the Philippines (RA.

The RA. 7394 or known as Consumer Act of the Philippines was enacted to protect the
interests of consumers through the promotion of public health and safety measures, and the
prevention of deceptive and unfair acts of unscrupulous businessmen. This law protect the
consumers from trade malpractices, and specifies the right of consumers and the responsibilities
of sellers, retailers, distributors, and manufacturers.

As what mentioned earlier there are specified rights of a consumer: There are 8 basic rights of
consumer, namely;
 Right to basic needs,
 Right to safety,
 Right to information,
 Right to choose,
 Right to redress,
 Right to representation,
 Right to education; and
 Right to healthy environment.

Objective of the law:


 Protection against hazards to health and safety.
 Protection against deceptive and unfair sales act and practices
 Provision of information and education to facilitate the proper exercise of rights of
consumer.
 Provision of adequate rights and means of redress; and
 Involvement of consumer representatives in the formulation of social and economic
policies.

 Weights and measures
 Consumer product and services warranties
 Labeling and fair packaging
 Liability of the product
 Consumer complaints
 Regulation of repair and service firms.

Penalties and violation;


o Any person who shall violate any provision of Article 18. Where article 18 explains the
unlawful for any person to: 1.Any consumer product which is not confirmed with an
applicable consumer product quality or safety standard promulgated in this act. 2. Any
consumer product which has declared as banned consumer product by a rule in this Act.
3. Refuse access or copying of pertinent records or refuse to permit entry of inspection by
authorized officers and employees of the department. 4. Failed to comply with an orders
issue. 5. Failed to comply the rule prohibiting stockpiling. If any of the provision article
18 you violate will be fine of not less than 1000 pesos but not more than 10000 pesos or
imprisonment of not less than 2 months but not more than 1 year or both upon the
discretion of the court. If you violated the RA 7394 you will be fine for not less than
10,000 but not more than 50,000 pesos or imprisonment of not less than 3 months but not
more than 2 years or both upon the discretion of the court.
