The précis of the prosecution case is that on 27.10.2022, at about 07.

00 PM when Babita Devi, wife of

the informant Brajkishor Sah, s/o Rajaram Sah, vill.- Dumariya, PS- Bheldi, dist.- Saran, went to answer
natural call outside her house, then (1) Prabhat Kumar (2) Prakash Kumar, both s/o late Bhukhal Sah (3)
Upendra Sah, s/o Rajindra Sah, all vill.- Dumariya, PS- Bheldi, dist.- Saran, started abusing her. When she
asked them not to do so, (1) Prabhat Kumar injured her by hitting on her head with lathi (thick stick). (2)
Prakash Kumar and (3) Upendra Sah exhorted for hitting her more. They tore the cloths of Babita Devi.
When, at the shout of her, the informant went there, he saw that his wife was lying on the ground. Then
he also was hit on head by the alleged persons, resultantly his head was torn and his wife became
unconscious seeing the blood oozing out of her husband’s head. In course of the beating they ((1)
Prabhat Kumar (2) Prakash Kumar, and (3) Upendra Sah) snatched the Mangal Sutra (a kind of golden
locket) of Babita Devi and fled the scene taking advantage of darkness. The villagers took the victims to
Garkha PHC where the informant was treated and then referred to Sadar Hospital. Due to his being
under treatment, the informant submitted application to PS on 31.10.2022.
