The prosecution story, according to the statement given by Kamla Singh, 55 yrs, s/o late

Sukumar Singh, vill.- Pakridih, PS- Amnaur, Saran, at PHC Garkha at 06.40 pm on 03.06.2021,
before the Police Officer, Garkha Police Station, in brief, is that at 9.00 am on 03.06.2021, the
measurement of land was being done by private land surveyor (Ameen) between the informant
and Biji Singh, Baban Singh, Bhrigunath Singh. In course of the measurement, a portion of land
of Kamla Singh was found to be in the land of Baban Singh and Bhrigunath Singh, on which
these two persons started abusing Kamla Singh and his son. However, Kamla Singh and his son
came to their house after the mediation of a few persons. In the meantime, (1) Baban Singh, s/o
late Bishun Singh (2) Randhir Singh (3) Pawan Singh (4) Dhiraj Singh, all three s/o Baban Singh
(5) Binod Singh, s/o late Bishun Singh (6) Nitesh Kumar (7) Golu Kumar, both s/o Binod Singh
(8) Bhrigunath Singh, s/o late Chathu Singh (9) Arun Singh, s/o late Bishun Singh (10) Nikhil
Kumar, s/o Arun Singh, all residents of vill.- Pakridih, PS- Amnaur, Saran, being armed came to
the house of Kamla Singh.

Dhiraj Singh tried to fire with the local made pistol (Katta) with intention of killing Bipin Kumar
Singh (son of Kamla Singh), but the Katta couldn’t fire. At this, on the instruction of Baban
Singh, Dhiraj Singh frequently hit Bipin Kumar Singh in head with the same Katta. When Bipul
Kumar, the other son of Kamla Singh, came to protect, he also was attacked with sword by
Pawan Kumar, as a result of which Bipin Kumar, becoming injured seriously, fell down.
Meanwhile, at the instigation of Baban Singh, his son Randhir Singh, with sword, gave Kamla
Singh a serious injury to his head at which he fell down. Manju Devi (wife of Kamla Singh)
came to protect him but Bhrigunath Singh gave Kamla Singh a blow with Daab. Golu Kumar
and Nitesh Kumar attacked Kamla Singh with iron rod. When Rajesh (nephew of Kamla Singh)
came to protect him, Rajesh was attacked by all the ten persons mentioned, as a result of which
Rajesh got head injury. Rajesh’s car also was damaged by these persons with the arms they were
carrying and they snatched the golden chain of Rajesh Kumar. The wounded persons, Kamla
Singh, Manju Devi, Bipin Singh, Bipul Kumar, and Rajesh were rushed to Garkha PHC by the
villagers, where, in course of treatment, Kamla Singh got stitches in his head and leg, Bipin
Singh got 18 stitches in head and back, Bipul Kumar got five stitches in his head.
