The prosecution story, in short, is the following:

The informant Md. Salamuddin, s/o Abdul Gafur, Vill.- Basauli, PO- Nabiganj Bazar, PS- Basantpur
Distt.- Siwan, was coming from Calcutta to Chapra on 07.08.2022 for going to his village. He arrived at
Chapra Junction at about 04.30 AM and came outside of the Junction in search of some passenger vehicle
to go home. During this period he met an unknown person who told the informant that the unknown
person also had to go towards Malmaliya (that is on the way to Basantpur) and that he had come to see off
his Saheb (Officer). The unknown person offered the informant to go with the unknown person at which
the informant, trusting the unknown person, boarded a Bolero vehicle in which already three unknown
persons were sitting. The vehicle departed and after it covered some distance the two-three unknown
persons sitting in the vehicle started behaving wrongly and they took out Rs. 20,000/- (twenty thousand),
ATM, and Mobile from the pocket of the informant. By fraud through they made transaction of Rs.
40,000/- (forty thousand) from ATM and Rs. 175, 000/- (one lac seventy-five thousand) by Mobile
Banking Application, total Rs. 215,000 (two lac fifteen thousand) from his account. They, intimidating
the informant, took him till Mashrak and left him there from where he went his home and on 09.08.2022
got an FIR registered with PS Bhagwan Bazar Chapra.
