AFFIDAVIT

I, Sri. Govardhana D. S/o. Darmegowda, aged about 30 years,

Residing at No.1, Kunigal Main Road, Kondapura Cross, Gulur

Village and post, Gulur Hobli, Tumakuru Taluk and District –

572118, do hereby solemnly affirm and state on oath as follows:-

1. I submit that I am the son and Power of Attorney Holder of the

Plaintiff in the above case and well conversant with the facts of the

case. The averments made in the Plaint may kindly be read as part

and parcel of this affidavit in order to avoid the repetition of facts.

2. I submit that the above suit is filed by the Plaintiff for the relief

of Declaration and Possession. The Plaintiff is unable to appear

before this Hon'ble Court due to his ill health and old age. As

such the Plaintiff has executed a Power of Attorney in my favour

and I know the facts of the case as I am none other than the son of

the Plaintiff. Hence, it is just and necessary to permit the Plaintiff

to give the evidence through me and prosecute the case by

allowing this application. Under these circumstances, if this

application is allowed and I am permitted to conduct the above

case on behalf of the Plaintiff no prejudice or hardship would be

caused to anybody, if not, we will be put to great hardship.

Wherefore, it is prayed that this Hon'ble Court may be pleased

to allow the accompanying application as prayed therein, in the

interest of justice and equity.

 I, the Deponent, do swear in the name that this is my name

true and correct to the best of my knowledge, information and
