years, Occ: Private avocation, R/o. Bagalkot do hereby

state on solemn affirmation as under….

1. That I, know the accused and I know the full facts

of this case. The accused is my friend’s son.

2. That I am ready and willing to stand as a surety for

the release of accused on bail.

3. That I own property bearing TP No.46/1 situated at

Bagalkot, Tq:Dist: Bagalkot. The said property is

inherited by me by way of succession to my father and by

way of partition in 2002. Since than I am in actual

possession and enjoyment of this house property.

4. There is no any encumbrance/charge on the above

said property. The present market value of the above

said property is more than 1 crore.

5. That I shall not alienate the above said property by

way of sale mortgage or transfer in any manner to

anybody till the disposal of this case. I have not stood as

surety to any other accused so far.

6. I shall keep the accused present before this Hon'ble

court on each and every date of hearing of this case.

7. Hence, the Hon'ble court pleased to accept my

surety and release the accused on bail in this case, in the

interest of justice and equity.

over and explained to me in Kannada and the same are

true and correct to the best of my knowledge, belief and

information and in token whereof I have sworn to this

AFFIDAVIT

Herein I Sukhadev s/o Bhimappa Sanshi, Age: 32

years, Occ: Agriculture, R/o: Hanamaner Tq: Badami,

solemnly swear to the following facts.

1. I am ready and willing to stand as a surety for

accused No.1 to 11 in this case. I am knowing all the

accused who are the office bearers and employees in

Kedarnath Sugar and Agro Industries at Kerakalmatti

existing in a nearby villages. I undertake to see that all

the accused would attend the court as and when

required by the court. In case they commit default in

attending the court as required by the court I will

undertake to get their presence and attendance to the

court and on failure, I am responsible personally to get

their presence and in case I fail to do so my property

described below may be proceeded with.

2. I own an agricultural land R.S.No.32/1BP

measuring 4 acres 38 guntas at Karadigudda S.A. village

in Badami Taluka, which is irrigated land in which I have

grown sugarcane crop. There are no charges or

encumbrances for the said land. The value of the said

property is more than Rs.1,65,000/- per acre, to that

effect I have produced the certificate of village account

Karadigudda.

What are stated in the affidavit they are true and

correct to the best of my knowledge, belief and

information.

APPLICATION U/SEC.389 Cr.P.C.

Herein the Advocate for appellant states as under:-

1. The appellant has filed this appeal against the

order dated 21-07-2007 on the file of Additional JMFC,

Mudhol in C.C.No.364/2006. The grounds in the appeal

memorandum may kindly be treated as a part of this

application.

2. The trial court has awarded simple imprisonment

for one year and a fine of Rs.4,00,000/-. The lower court

has already granted stay of the operation of this

judgment for a period of one month, which is going to

expire within few days.

3. Therefore during the pendency of this appeal it is

necessary to grant the stay of the operation and

execution of the order of the trial court with regard to the

simple imprisonment and payment of fine otherwise the

very object of appeal would be frustrated and appellant

would be put to irreparable loss and injury.

4. Hence, the Hon’ble court be pleased to grant

interim stay of the operation and execution of the

judgment dated 21-07-2007 in C.C.No.364/2006 on the

file of Additional JMFC, Mudhol till the disposal of this

appeal in the interest of justice.
