WHEREAS, based on the record of the Philippines Statistics Authority (formerly
National Statistics Office) as of April 2021 Malabon has an 8.7%
unemployment and 17.2% underemployment rate, that needs to be
addressed by the Local Government Unit,
WHEREAS, cycling as a pollution free transport vehicle marked reduction in
traffic congestion, easier parking, greater maneuverability and zero
damage to roads, the City would have a vast benefits having a
livelihood support program such as bike for work,
WHEREAS, the Department of Environment & Natural Resources encourages
local government units to promote a shift towards a safe, collective,
efficient, non- congestive, non-pollutive and healthful locomotion and
transportation system that includes bicycle within its locality,
WHEREAS, Republic Act No. 9019 otherwise known as the Charter of the City of
Malabon mandates the Sangguniang Panlungsod, as the legislative body
of the city to enact ordinances for the general welfare of its inhabitants
pursuant to the proper exercise of the corporate powers of the City,
NOW THEREFORE, BE IT ENACTED AS IT IS HEREBY ENACTED, BY THE,
SANGGUNIANG PANLUNGSOD OF MALABON IN SESSION ASSEMBLED,
by virtue of the powers vested in it by law, that:
Section 1 Title - An ordinance requiring businesses engage in food, courier
services and other similar trade institutions operating within the City of
Malabon to hire cyclists or use bicycles to be part of their delivery
workforce and providing general guidelines and penalty for violation
thereof
Section 2 Short title — This ordinance shall otherwise be known as “Malabon Bike
for Work Ordinance of 2022”Section 3 Declaration of Policy — It is hereby declared the policy of the City of
Malabon to provide livelihood to its constituents and to instil health
consciousness among them and advance the right of the people to a
balanced and healthful ecology in accord with the rhythm and harmony
of nature, The City of Malabon recognizes the need for affordable and
alternative means of transportation and encourages friendly modes of
transportation.
Section 4 Definition of terms. — For purposes of this ordinance, the term —
a. Bike or Bicycle — means a non-motorized vehicle consisting of a light
frame mounted on two wire-spoked wheels one behind the other
having a seat, handlebars for steering, two pedals and has adequate
lightings safe enough to travel during dark hours
b. Cyclist — means a person who is a resident of the City who rides
bicycle equipped with safety gears such as helmet.
c. City — means the City of Malabon
4d, Food establishments — means business engage in providing food
services that are operating within the jurisdiction of the City
e. Courier services — means business engage in providing delivery
services that are operating within the jurisdiction of the City
f, PESO — Public Employment & Service Office
g. BPLO—Business Permit & Licensing Office
Section 5 Hiring of Cyclist — Every establishments, businesses engage in courier
services, and other similar trade institutions shall be required to hire
cyclists or use bicycles to form part of their total delivery workforce
operating within the City of Malabon subject to the following
conditions imposed upon the business and the cyclist:
a. No person shall deliver items with weight or volume more than he or she can
carry along with the bicycle
b. A cyclist shall not carry anything on the bicycle unless it is ina basket, bag
or rack designed for the purpose
c. No person shall operate a bicycle at as speed greater than what is reasonable
and allowed.
4. All cyclists must be provided with all safety gear and reflective materials
visible from both sides.
e. Bicycles when use at night shall be equipped with white front headlight and
a red reflective light at the rear.f. Bicycles shall be provided with adequate lock and a parking rack when not
in use.
Section 6 Monitoring of compliance. Businesses shall submit to PESO certified
true copy of employment contract of hired cyclists and proof of bicycle
used in their delivery services. The BPLO shall course the issuance of
notices to any compliance or non-compliance based upon the
recommendation of the PESO.
Section 7 Penalty Clause. Violation of any provision of this ordinance shall be
punishable as follows:
a. First Offense — Issuance of Notice of Violation
b. Second Offense - One Thousand Pesos (Php 1,000.00) and Issuance of
Second Notice of Violation
¢. Third Offense — Three Thousand Pesos (Php 3,000.00) and temporary
suspension of business permit to operate
Section 8 Repealing Clause. Any existing ordinance or previous resolutions within
the City, which are inconsistent with or in contrary to this ordinance, are
hereby amended
Section 9 Separability Clause. If any part or provision of the ordinance is declared
unconstitutional or invalid, the other parts or provisions hereof which
are not so invalidated, shall continue to be in force and with full effect.
Section 11 Effectively Clause. This ordinance shall take effect immediately upon
approval and publication on a newspaper of general circulation as
provided under the law.
