Scenario: Arrested Person re Unjust Vexation and Batas Pambansa Blg 6

Narrative
Preliminaries: To our instructor, observers from RTC5, ladies and gentlemen, good
afternoon!
The PSJLC Class 2021-03 will now be performing a Police Operational Procedure
Exercise with a given scenario.
The presentation is divided into four scenes.
First scene. Tops, Anwar, and his friends are having a drinking spree along the road
while having a discussion when suddenly, it turned into an altercation. Meanwhile,
police officers onboard a mobile patrol were conducting patrol and chanced upon the
arguing parties. The Team Leader approached Anwar in a professional and calm
manner with the intent to pacify the latter, but his offensive behavior and scandalous
actions continues. This compelled the police officers to effect warrantless arrest
pursuant to the rule of court, Rule 126, section 13. It was followed with the search
incidental to a lawful arrest to protect the arresting officers from harm due to possible
concealed weapon. The subject person (suspect)) will be notified on the nature of his
arrest and will be apprised of his constitutional rights (Miranda Rights). After the
search, the suspect will be brought to Legazpi City Police Station for proper
disposition.

Second scene. The desk officer will conduct interview to the parties involved
(suspect, complainant, and witness). After the incident has been successfully
recorded, the suspect will now be turned over to the duty investigator together with
the complainant and witnesses. The investigator will now prepare a request for
medical examination to be signed by the Chief of Police/Officer on Duty. The suspect
will be brought to a medical facility by the arresting officers while the testimonies of
both parties will be taken by the investigator for preparation of their affidavits.

Third scene. The suspect will be escorted by the arresting officers to undergo
medical examination. This process is vital in determining the medical condition of the
suspect prior his turnover to the police station. This is also to protect him from any
physical harm while in the custody of the police officers and to protect the officers as
well from any liabilities as the suspect may inflict harm to himself and blame the
officers. The suspect will then be brought back to the police station . The arresting
officers will now present the medical certificate to the desk officer to record the same
prior his turn over to the investigator for booking procedure which will include the
taking of his mugshot and fingerprints. The suspect will then be subjected to tactical
debriefing before the intel officer. Tactical debriefing is vital to further determine any
association and or affiliation of the suspect to any criminal and terrorist groups and to
determine if he has pending warrants before criminal courts.

Fourth scene. The arresting officers, together with the complainant and witnesses,
will be examined by the city prosecutor. It is during the inquest proceedings that the
truthfulness of the affidavits and the oath of affiants and the probable cause will be
determined (Rule 112, section 7 of the Revised Rules on Criminal Procedure). Upon
determination of probable cause, the suspect will be brought back to the police
station for temporary detention pending the resolution from the prosecution and
commitment order from the court. The suspect will then be escorted to the Public
Attorney’s Office (PAO) for his legal counsel. After the inquest proceedings, the
Chief of Police will direct the Chief, Intel to conduct background investigation (BI) as
to the possible association and affiliation of the suspect to any criminal and terrorist
groups. Likewise, Chief, PCAD will be directed to conduct information operation ,
lecture/seminar on peace and order and anti-criminality.
