As applied to the professions, reciprocity is a relation
established by law, treaty or agreement between 2
countries or states, whereby each country or state grants to
citizens of each other, the privilege of being admitted to the
practice of the profession within their respective territorial
jurisdiction.

Reciprocity is based on the principle of “do ut des” which
means that for a country to expect a favor from another, it
should be willing to give a corresponding favor.

state/country. Provided, that the requirements for registration or
licensing of nurses in said county are substantially the as those
prescribed under this act. Provided further, that the laws of that
state/country grant the same privileges to registered nurses of the
Philippines on the same basis as the subjects or citizens of such
foreign state or country.

Specifically, these provisions are explained thus:

1. Nurses registered in the Philippines desiring to practice in said foreign


state/country are granted under its laws the same privileges as those
accorded to its subject or citizens and as enforced by them. Proof of
such reciprocity may be verified from the Department of Foreign Affairs.
2. The applicant is a nurse registered under the law of his/her
state/country.
3. The requirements for registration of licensing of nurses in a foreign
country/state where the applicant is registered as nurse as
substantially the same as those prescribed under this act.
4. The applicant has resided in the Philippines for at least 3 consecutive
years as provided by R.A. 5181.

Applicants for registration as nurses by reciprocity shall
present to the Board of Nursing a properly completed
application on the prescribed form, together with their
respective certificates of registration as nurse granted by
their state/country.

1. A certification from the Commission on Immigration and Deportation
stating that they have been residents of the Philippines for at least (3)
three years prior to registration.
2. A copy of the law or petition thereof showing reciprocal practice with

application: Applicants must apply online through the
PRC website and submit the necessary documents and
fees.
Valid Identification (ID): Applicants must present a
valid ID during the examination. Acceptable IDs include

Examination fee: The examination fee for the nursing
licensure examination in the Philippines is currently
around Php 900 to Php 1,000.
Application fee: The application fee for the nursing
licensure examination in the Philippines is currently
around Php 900 to Php 1,000.

Initial registration fee: Once the applicant passes the
nursing licensure examination, they must pay an initial
registration fee of around Php 600 to Php 900.
Professional Identification Card (PIC) fee: Applicants
who pass the nursing licensure examination must also
pay a fee for their professional identification card, which
is around Php 450 to Php 900.

Continuing Professional Development (CPD) fee:
Nurses in the Philippines must fulfill continuing
professional development requirements to renew their
license. The CPD fee is currently around Php 1,500 to Php

Scope of examination.
The scope of examination for the practice of nursing in
the Philippines shall be determined by the Board. The
Board shall take into consideration the objectives of the
nursing curriculum, the broad areas of nursing and
other related disciplines and competencies in
determining the subjects of examination.

Scope of examination.
Since May 1994, an integrated comprehensive nursing licensure
examination has been designed to better measure the level of
competence or proficiency rather than the compartmentalized
subject area examination. It cuts across clinical nursing areas
where examinees answer questions that necessitate
recognition and understanding or concepts, theories and
principles as well as the skills and attitudes involved involve in a
given test problem situation.

Scope of examination.
It draws knowledge from five broad areas of nursing –
fundamentals of nursing, maternal and child nursing,
community health nursing, nursing adolescents, adults
and aged and mental health and psychiatric nursing,
including physiology and anatomy, pharmacology and
therapeutics, microbiology and diet and therapy.

The examination shall be divided into 4 parts organized


around four major goals in nursing: promotive,
preventive, curative, and rehabilitative.

The schedule of mass oath-taking (date and time) is within 15
days upon the release of the results of the licensure examination,
which is included in a press release issued by the PRC.

The professional oath includes a pledge to support and defend the


Constitution.

The Commission, during the mass oath-taking, is assisted by the


accredited professional organization.

Every practicing professionals of the occupations regulated by the
PRC shall pay a fee for three (3) years which shall be paid on the
professional's birth month.

There are circumstances however that a certain professional may


not be able to pay his/her birth month. There is 20% surcharge is
made on every calendar year being missed.

ANNUAL REGISTRATION
It is also mandated that after five continuous year after the last paid
annual registration there is a tendency for the professional's
certificate of registration shall be suspended and the professionals
name shall not be included in the roster list.

The advent of the not practicing their profession it is still a must to


send a letter to the Board within one year from the time he/she
stopped practicing to avail exemptions of the annual registration
fee.

The annual registration card, at least for the calendar year
immediately preceding, shall be presented to the collection agent
of the Bureau of Internal Revenue when paying his/her professional
tax.

the payor is authorized by law to practice the profession.

revocation has disappeared or has been cured and
corrected, upon proper application therefor and the
payment of the required fees,issue another copy of the
certificate of registration/professional license.

SEC. 24. Re-issuance of Revoked Certificates and

A new certificate of registration/professional license to


replace the certificate that has been lost, destroyed or

Although the core concern of health profession regulation is the protection of the
public, achieving self-regulatory status was historically considered akin to achieving
professional status. Regulation often helped to create a state-sponsored monopoly
over the profession’s services. This status attainment may have been afforded to only
a few professions, reflecting a hierarchy within a division of labor. For example, health
professional regulation often constrains a health profession’s scope of practice or
modality ‘crystalizing’ the dominance of the medical profession. This differential
outcome speaks to the dynamic relations that exist between the state and
professions; a relationship that has evolved from granting state-sanctioned self-
regulatory status to funding health professional services and broader systems
management.

Contemporary approaches to health professional regulation have increasingly
focused on improving accountability to the public interest through more open,
transparent, and publicly accountable processes for peer surveillance and control, in
light of clinical mistakes threatening the safety of patient care. Regulation by design
should protect patients from the possibly deleterious effects of asymmetrical
information between them and health professionals. A focus on ‘patient safety’
challenges, what was traditionally the technical and esoteric domains of health
professionals, was increasingly brought into the scope of political and managerial
reform in healthcare.

The principles of right-touch regulation—where the level of regulation is proportionate
to the level of risk to the public—have been used in varied ways by regulators across
international jurisdictions to modernize regulation in the public interest. This focus on
risk management also highlights how health professions regulation must be flexible
enough to support efficient and effective use of the health workforce. Nelson et al.
argued that regulating scopes of practice requires balancing the intersecting
dimensions of flexibility—empowering teams to determine the relative responsibilities
of the different practitioners based upon community need; and accountability—
ensuring the optimization of scopes of practice within a professional regulatory
environment. This intersection has sharpened during the COVID-19 pandemic with
regulators being urged to enhance their flexibility, while maintaining accountability
for protecting the public, as a way to augment the health workforce

The pandemic has also highlighted a fundamental truth: society moves quickly while
regulation and law tend to be more static, and regulatory frameworks need to be
made nimbler and more responsive to meet the needs of modern society. This is true

technological advances increasingly transform health professional work. Despite the
nexus between modernizing regulation and optimizing the health workforce, there is a
gap in knowledge around the impact of different regulatory models on health
professional scopes of practice.

Any person appointed as Chaiperson or Member of the Board shall:
immediately resign from any teaching positionin any school, college,
university or institution offering BSN and/or review program for the local
nursing board examinations;
immediately resign from any office or employment in the private sector
and in the government or any subdivision, agency or instrumentality
thereof, including goverment-owned and/or controlled corporations or their
subsidiaries.

Term of Office
Section 6. The Chairperson and Members of the Board shall hold
office for a term of three (3) years and until their successors shall
have been appointed and qualified: Provided, That the Chairperson
and members of the Board may be re-appointed for another term
Any vacancy in the Board occurring within the term of a Member
shall be filled for the unexpired portion of the term only. Each
Member of the Board shall take the proper oath of office prior to
the performance of his/her duties.

Section 11. Removal or Suspension of Board Members. - The


president may remove or suspend any member of the
Board after having been given the opportunity to defend
himself/herself in a proper administrative investigation, on
the following grounds;

(a) Continued neglect of duty or incompetence;


(b) Commission or toleration of irregularities in the
licensure examination; and

Powers, Duties, Functions and Responsibility
of the Board
Section 11. The Board shall supervise and regulate the practice
of the nursing profession in the Philippines. As such, pursuant to
the provisions of R.A. No. 9173 and RA No. 8981, otherwise known
as the "PRC Modernization Act of 2000", the Board shall have the
following specific powers, functions, duties and responsibilities:

a. Conduct the licensure examination for nurses;

b. Issue, suspend or revoke certificates of registration for the


practice of nursing;

c. Monitor and enforce quality standards of nursing practice in
the Philippines and exercise the powers necessary to ensure
the maintenance of efficient, ethical and technical, moral and
professional standards in the practice of nursing taking into
account the health needs of the nation;

d. Ensure quality nursing education by examining the prescribed
facilities of universities or colleges of nursing or departments of
nursing education and those seeking permission to open nursing
courses to ensure that standards of nursing education are
properly complied with and maintained at all times. The
authority to open and close colleges of nursing and/or nursing
education programs shall be vested on the Commission on
Higher Education upon written recommendation of the Board.

e. Conduct hearings and investigations to resolve complaints
against nurse practitioners for unethical and unprofessional
conduct and violation of this Act, or its rules and regulations. In
connection therewith, the Board, upon application with the
court, is empowered to:
1. Issue subpoena ad testificandum and subpoena duces
tecum to secure the appearance of respondents and
witnesses and the production of documents; and
2. Punish with contempt persons obstructing, impeding and/or
otherwise interfering with the conduct of such proceedings.

f. Adopt and promulgate a Code of Ethics and a Code of Technical
Standards for the practice of nursing in coordination and
consultation with the accredited professional organization of nurses
within one (1) year from the effectivity of the subject Nursing Act;

g. Recognize nursing specialty organizations in coordination with the


accredited professional organization: the recognition of nursing
specialty organizations shall be based on the criteria jointly
developed by the Board of Nursing and the Accredited Professional
Organization.

h. Subject to the review and approval of the Commission, prescribe,
adopt, issue and promulgate guidelines, regulations, measures, and
decisions as may be necessary for the improvement of nursing practice,
advancement of the profession, and for the proper and full enforcement
of the provisions of the "Philippine Nursing Act of 2002" ; and

i. Submit an annual report to the Commission at the close of its calendar


year giving detailed account of its proceedings and the
accomplishments during the year and making recommendations for the
adoption of measures that will upgrade and improve the conditions
affecting the practice of the nursing profession.
