PETITION FOR JUDICIAL SEPERATION UNDER SECTION 10 OF

HINDU MARRIAGE ACT, 1955

MOST RESPECTFULLY SHOWETH:

The petitioner, above named submits as under:

1. That the marriage of the petitioner and respondent was solemnized on January 12, 2021 at
Bhubaneswar according to Hindu rites and ceremonies. The marriage was registered with
the Registrar of Marriages at Khordha. Certified copy of extract from the concerned
register is attached herewith.
2. The status and the place of residence of the parties to the marriage before the marriage and
at the time of filing the petition were as follows:
3. That from this marriage, the couple has not been blessed with any child so far.
4. That the petitioner and her husband (respondent) were living happily together at the
matrimonial home together. On October 16, 2022 the petitioner has found that her
husband was having an illicit relationship with an office colleague.
5. That there started some arguments and disturbances in their married life since February
2022. The petitioner found some changes in her husband behavior and which further lead
to uncertainties in their married life. One day, the petitioner has found a conversation
 between her husband and his colleague which is how the petitioner found the illicit
relationship between her husband and his colleague.

6. That the petition has not in any manner condoned the acts complained of or connived at
adultery.
7. That the petition is being presented in collusion with the Respondent.
8. That the petition is being presented without any unnecessary or improper delay on the part
of the petitioner.
9. That there is no any other legal ground as to why the decree prayed for should not be
granted in favour of the petitioner.
10. No litigation has taken place between the parties to the petition earlier.
11. This Honourable Court has jurisdiction to entertain and try this petition as the marriage
was solemnized at Khordha as the parties last resided together at Bhubaneswar and even
presently the respondent is residing within the jurisdiction of this Honourable Court.
12. In the facts and circumstances of case mentioned herein above this Honourable Court may
graciously be pleased to:
 PRAYER

That the petitioner therefore prays:

(a) For the grant of decree of judicial separation in favour of petition and against the
respondent; and
(b) Any other relief or reliefs which the court may deem proper under the circumstances
also be awarded to the petitioner.
