that heretofore, and before making and filing of this complaint, on or about the 1_8tlday of Ml 2023. in the
County of Bastrop and the State of Texas the Defendant;

then and there knowingly discharge a firearm at or in the direction of a vehicle, and the defendant was reckless as to
whether the vehicle was occupied, namely occupied by four female young adults when the actor shot at the vehicle
multiple times with a firearm penetrating the interior of the vehicle.

My probable cause for said belief is as follows:

My name is Nathan Neitsch and l am employed as a Detective for the Elgin Police Department. On the 18‘”
day April 2023, was contacted by Sergeant Brimhall to respond to a shooting that occurred at 1080 US Hwy. 290
of |

E., Elgin, Bastrop County, Texas (HEB). Upon arrival at the dispatched location, l learned the occupants of a white
2013 Kia bearing TXLP# FVX5632, had been shot multiple times by an unknown Hispanic male reportedly wearing a
black hoodie and basketball style shorts. The HEB Manager witnessed the Hispanic male shoot at the vehicle multiple
times, striking the vehicle, before fleeing the area.

While at the scene, Elgin Detectives obtained surveillance footage of the parking lot where the shooting
occurred. The surveillance footage displayed the actors’ Texas license plate. The license plate returned to Pedro Tello;
an individual known by Elgin Police Officers from previous iaw enforcement encounters.

Elgin Detectives conducted an internal database search and located a known address for Pedro Tello. Patrol
Sergeant Hicks observed Pedro Tello enter the above-mentioned residence. Elgin Detectives contacted Pedro Tello
at the residence. Pedro Tello was still wearing the clothing that was observed by Elgin Detectives in the surveillance
footage.

Based on the detail of events, positively identified Pedro Tello Rodriguez Jr. as the Hispanic male who

intentionally and recklessly shot at the white Kia knowing it was occupied.
