SUBJECT: NOTICE OF ABANDONMENT AND DISCIPLINARY HEARING

Dear [Mr./Ms. Name],

This is to inform you that your failure to report for work since [date] and to
accomplish the tasks that were assigned to you has hampered our operations.

Your persistent failure to report back to work despite previous promises made,
constrain us to declare an abandonment of your work, which is considered as a serious
misconduct and gross neglect of your duties. Per Article 282 of the Labor Code, these
acts are sufficient grounds for you termination.

In view of this, you are directed to appear at an administrative hearing on [date


and time] at the HR office of the company to explain why your services should not be
terminated on the ground of prolonged unauthorized absences and abandonment.

During the said administrative hearing, you are free to be represented and
assisted by a counsel of your choice. If you fail to appear for the administrative hearing,
such failure shall be deemed a waiver of your right to present evidence and to defend
yourself. In that event, the company will be compelled to render its decision on the
basis of available evidence.
