Question 1

The basis of criminal liability is human voluntary conduct, however, there are factors
that could render conduct involuntary in the eyes of the law.

With reference to case law, discuss factors (defences) that could exclude the
voluntariness of X’s conduct. (25)

Question 2

Insane automatism refers to involuntary conduct and unconscious behaviours


attributable to mental illness. Section 78 of the Criminal Procedure Act 51 of 1977
enacts provisions for mental illness and criminal responsibility.

Demonstrate your understanding of this section by discussing its provisions, paying


particular attention to:

Section 1 (a) appreciation of wrongfulness of his/her (X) conduct, (b) acting in


accordance with such an appreciation as well as the burden of proof in section 1B.
