ISSUE
Whether or not the petitioner is guilty of three counts of Grave Threats.
RULING
YES, the petitioner is guilty of three counts of Grave Threats. Under the RPC, a person is guilty
of Grave Threat if a person threatens another with the infliction upon the person, honor or property
of the latter or of his family of any wrong amounting to a crime. In the case at bar, the MCTC
found the prosecution evidence sufficient to prove the elements of Grave Threats noting that the
Darongs’ persistent water tapping contrary to petitioner’s directive "must have angered" petitioner
triggering his criminal behavior. Therefore, the petitioner is guilty of three counts of Grave Threats
and ordered him to serve time and pay fine for each of the three counts.
