THE 6TH REGULAR SESSION OF THE SANGGUNIANG BAYAN OF MEDINA,
MISAMIS ORIENTAL ON AUGUST 8, 2022 HELD AT SB SESSION HALL,
MEDINA, MISAMIS ORIENTAL.

CALL TO ORDER
The Presiding Officer declared in session at exactly 2:20 in the afternoon with an
opening prayer followed by the Pambansang Awit. The Body recited the Councilor’s
Creed and sung the Medina Hymn.

APPROVAL AND CONSIDERATION OF THE PREVIOUS MINUTES

Hon. Dacar, I move to dispense the reading and consideration of the previous
minutes, resolution and ordinances last regular session dated August 1, 2022.
The Presiding Officer displayed, there’s a motion of Hon. Dacar to dispense the
reading and the consideration of the previous minutes last August 1, 2022. Any
second motion? It is severally seconded; the motion is hereby approved.
Hon. Dacar , I move for the approval for the approval of our previous minutes,

APPROVAL OF THE CALENDAR OF BUSINESS

Hon. Aratap , I move for the approval of the Calendar of Business for today’s 6 th
Regular Session dated August 8, 2022.
The Presiding Officer there’s a motion of Hon. Artap for the approval of the
Calendar of Business for today’s 6th Regular Session. Any second motion? It is

Budget Officer.

The Presiding Officer: may I request madam Secretary to read all the
Communications received by the Office of the Sangguniang Bayan.

1. An Executive Agenda from the LCE Re; “Creation of the Plantilla Position of
MGDH HRMO (Municipal Government Department Head - Human Resource
Management Officer) - SG -24 in the Local Government Unit of Medina,
Misamis Oriental.
2. An Executive Agenda from the LCE Re; “An Ordinance authorizing the
Supplemental Budget No.1 of the Municipal Government of Medina, Misamis
Oriental series of CY 2022 involving an amount of Two Million Four
Hundred Twenty-Five Thousand Three Hundred Fifty-Three Pesos
(P2,425,353.00)

Matter No. 2 - An Executive Agenda from the LCE Re; “An Ordinance authorizing
the Supplemental Budget No.1 of the Municipal Government of Medina, Misamis
Oriental series of CY 2022 involving an amount of Two Million Four Hundred
Twenty Five Thousand Three Hundred Fifty Three Pesos (P2,425,353.00)

Hon. Dacar May I ask the Budget Officer Mr. Chair to explain further because it is
noted here 20% Local Development Plan 2022 road concreting the expenditures in
the amount of 2,425,353.00 for clarification Mr. Chair.
Hon. Sarmiento , I move Mr. Chair to suspend the specific rule.

Hon. Bolos , Ms. Jabagat we just want to clarify relative to the 2,425,353.00
supplemental budget no. 1?
Ms. Jabagat , we are recipient of excise tax year 2018, this is 50% of the total
amount of 4.8 million. The 50% was released last year and the remaining 50% and
this project is already implemented. This was bid last year with the total amount of
4.8 Million. If we have already the SARO then you are allowed to implement or
allowed to bid the project.the contractor received the 50% and later on the remaining
50% was downloaded the project is concreting located at maanas purok 6 and
buyogon Gawad kalinga. I asked supplemental to have a guideline from dbm wich is
all the municipality of mis. Or. Receipt for this project and uniform amount is 4.8
Million. Last time it was recorded as trust fund therefore it was not tackled in
Sangguniang Bayan but lately the findings of the treasurer why is it as trust fund
which is supposedly it will be recorded as General Fund the blgf inform that it BLGF
it should be recorded as General Fund therefore i ask supplemental.
Hon. dacar queried, the whole amount of 4.8 million, the road concreting is already
done. This 2 million is the 50% of the total amount. According to you that the BLGF
found out that it shouldn’t be in a Trust Fund liability instead it should be in the
General Fund. Therefore, this 2 million is for the payment?
Ms. Jabagat this is the first time that we ask about the previous supplemental budget
because usually national fund which is recorded as trust fund as long as it is included
in the annual investment program it is not necessary to ask. because it is already
authorized. The project of the national especially the LGSF already provided the
resolution from Sangguniang Bayan identified which is identified programs and it is
already included in AIP. If it is download in LGU directly under go for biding
because it is already in the AIP. This guidelines from BLGF that it should be
recorded as general fund.
Hon. aliza queried, this 4 million Ma’am jabagat is road concreting of what
barangay?
Ms. jabagat, Purok 6 Maanas and Buyogon near Gawad Kalinga actually this was last
year. The release of another payment this is also the first time that by tranche the
release was excise tax 7 million the release was the whole amount but because the
election was approaching so it become 50-50.

Ms. jabagat, this share was downloaded as per LBC to DBM which is identified to
what municipal guidelines last year. The half was downloaded last year and the
remaining half will be this year.

Ms. jabagat yes, it is already incorporated.

Hon. Llemit, it was not stated in SARO?

Ms. jabagat, only the name and the project amount were stated in SARO.

Hon. gallido, is there any specific location?

Presiding officer

Ms. jabagat, the specific location will be identified in proccing time.we already
submit the letter to DBM for the release identifying the project after that they will
submit to Central Office for SARO for fund allocation. This is the first time to per
tranche and needed for the supplemental budget because it should be recorded as
General Fund and once General Fund it is required in Sangguniang Bayan.
Hon bolos, thus 4.8 Million has two location which is Boyugon and Maanas?

Hon. sajulga do we have a projects from the excise tax intended for road concreting
and the project was already implemented 100%. How many meters is it?

Engr. castro, the Boyugon is 110 meters (5mx.20m) thickness and tee Maanas is 200
meters (5m x 20m).

Hon. Averion is there any component for the drainage?

Presiding officer

Engr. castro there is no concreate drainaged.

Hon. artap, do the law allow this? because the project is based on the cash
availability. Since 50%, what if the government will delay for some reason?
Ms. jabagat, there is a provision of R.A 9184 that we can able to bid for as long as we
have a allocation fund. For the part of the contractor this is burden. Only the cash
availability will be implemented because this is what our treasure certifies. If The
treasurer will received beyond that account the treasurer will not sign the P.R and
P.O. if they can’t reach that’s their problem why did they implement it all.
Supposedly its already bid that we only emplement those what we are received.
Hon. artap suggested, next time, if the money is only 50%, therefore only 50% also
will be implemented because the Sangguniang Bayan must be aware of whatever
project that is subject for implementation. Because the check and balance between
executive and legislative sometimes it is lapse because the project is already
implemented. This is the First time that happened they lost the essence of check and
balance because the project is already implemented.

Ordinance authorizing the Supplemental Budget No.1 of the Municipal Government
of Medina, Misamis Oriental series of CY 2022 involving an amount of Two Million
Four Hundred Twenty-Five Thousand Three Hundred Fifty Three Pesos
(P2,425,353.00).

further for the approval for the second, third and final reading.

Submitted by the Committee on Education and Committee on Rules Laws and

Ordinances last August 4, 2022, 8:30 in the morning at the Sangguniang Bayan
Session Hall.

Subject Matter

1. An Executive Agenda from the LCE Re; “Resolution authorizing the Local
Chief Executive Hon. Mayor Donato N. Chan to sign and enter the
Memorandum of Agreement (MOA) with the Portulin National High School
(PNHS) relative to the Brigada Eskwela Partnership in the Municipal
Government Unit of Medina, Misamis Oriental.

2. An Executive Agenda from the LCE Re; “Resolution authorizing the Local
Chief Executive Hon. Mayor Donato N. Chan to sign and enter into
Memorandum of Agreement (MOA) with the St. Isidore School (SIS) relative
to the limited face-to-face Classes in the Municipality of Medina, Misamis
Oriental.

3. An Executive Agenda from the LCE Re; “Resolution authorizing the Local
Chief Executive to enter and sign into Deed of Donation with Department of
Education Medina, Misamis Oriental South District represented herein by
District Supervisor Carnilla D. Simacon, Ph.D. relative to the parcel of Land
Situated in San Vicente, Misamis Oriental with Tax Declaration No. 947045
and an area of 1.0100.”

Recommendation:

After a thorough deliberation the Committee recommends for its approval on

the next 6th Regular Session, dated August 8, 2022 for appropriate legislative action.

Matter No. 3 - An Executive Agenda from the LCE Re; “Resolution authorizing
the Local Chief Executive to enter and sign into Deed of Donation with
Department of Education Medina, Misamis Oriental South District represented
herein by District Supervisor Elly Lofranco relative to the parcel of Land Situated
in San Vicente, Misamis Oriental with Tax Declaration No. 947045 and an area of
1.0100.”

Recommendation:

As agreed during the discussion that the Name in the Tax Declaration will be
Department of Education (DepED) and the San Vicente Elementary School will be
the Administrator and this matter is subject for approval in the next regular session
dated August 8, 2022 for appropriate legislative action.

After hearing no matters to be discussed, the committee adjourned at exactly

10:10 in the morning.

Ordinance amending article VI, section I, II and III of the Municipal Ordinance No.
928-2021 entitled Municipal Comprehensive Traffic Ordinance of Medina, Misamis
Oriental.
The Presiding Officer displayed, there’s a motion of Hon. SAJULGA of the approval
for the third reading the Ordinance amending article VI, section I, II and III of the
Municipal Ordinance No. 928-2021 entitled Municipal Comprehensive Traffic
