The Administrator General’s (Fees) Rules.


(Under sections 20(1) and 38 of the Act.)

1. Citation.

These Rules may be cited as the Administrator General’s (Fees) Rules.

2. Fees.

There shall be payable to the Administrator General out of every estate


administered by the Administrator General or his or her agents fees in
accordance with the scale prescribed in the Schedule to these Rules.

Scale of fees.

1. For the administration of an estate, the following fees calculated,


to the nearest shilling, as a percentage of the gross amount realised or the
value of assets brought to credit, whichever is the higher—
(a) 1 percent of the first 100,000 shillings or part of that amount;
(b) 1/2 percent of the balance; except that the Administrator General
may, in his or her discretion—
(i) increase the fees up to an amount not exceeding double the
scale in respect of estates which have been exceptionally
difficult to administer; or
(ii) reduce or waive the fees in respect of estates which have
been for any reason exceptionally easy to administer or in
respect of estates where the poverty of any beneficiary to
the estate justifies such a course.

2. For taking or keeping possession of property under section 14 of


the Act, where the estate is subsequently administered by a person other than
the Administrator General or one of his or her agents, on the value of
property protected or, in the case of assets disposed of, the gross amount
realised, such fees not exceeding one-half of the fees prescribed under
paragraph 1(b) of this Schedule as the Administrator General, having regard
to the amount of time and trouble involved, may consider reasonable.

3. On—
(a) inspection of any document allowed under section 17 of the Act,
per document, one shilling;
(b) the issue of an extract or copy of any document under section 17
of the Act, per folio or 100 words, fifty shillings; except that the
minimum fee in respect of each document shall be one shilling;
(c) certifying each copy or extract as a true copy if required, two
shillings.

4. On every payment to a claimant under section 19 of the Act, 5


percent on each amount paid out.
