Ms. Mehreen Gilani W/O Muhammad Ahsan Iqbal Hashmi Caste Gilani CNIC:
36302-4377544-6, R/O 331-L Shah Rukn e Alam Colony, Multan, hereinafter referred
to as the “VENDOR” being the first party.
AND
Mr. Muneeb Sarwar S/O Muhammad Sarwar Rana, Caste Rajpoot CNIC: 36303-
4688520-3, R/O House No. 7, Phase B, Hashmi Canal View, Multan, hereinafter
referred to as the “Vendee” being the Second Party.
Both expressions, wherever the context so permits, shall mean and include their heirs, executors,
successors, administrators, and assign.
A) WITNESSETH AS UNDER:
WHEREAS, the vendor aforesaid is, at this date, the sole and undisputed owner, seized, and
possessed of and is otherwise well and sufficiently entitled to an open plot consisting Five (5)
Marla’s /150 Square yards. Plot is situated on land bearing Khewat No. 52/30 Khatooni No.
75, Salim Khata Measuring 88K 09M, share transferred measuring 5 Marla’s (150 Sq
Yards), as per records of the rights for year 2014-15 situated in Mouza Arazi Ghulam Mustafa
Khan, (Plot No. 311, Icon Villas, Executive Block), Multan City, Tehsil & District Multan,
more or less Bounded as Under:
B) MODE OF PAYMENT:
That the vendor has this day, received a sum of Rs. 200,000/- (Rupees Two Lac Only) in
Though Pay-Order Bearing No. 24475675 Dated: 07/06/2021 of HBL, Shah Rukn e Alam
Branch, from the Vendee being the “Advance Part payment” out of total sale consideration of
Rs.1,800,000_/- (One Million Eight Lac Only).
That out of the balance of the said consideration, i.e., Rs. 1,600,000/- (Rupees One million Six
Lac Only) shall be paid by the Vendee to the Vendor within 120 days of the date of this
agreement.
That the vendor doth hereby undertakes to deliver peaceful possession of the said
property together with all the original relevant documents to the vendee immediately on
receiving the balance amount of the total sale consideration as per clause “B” above and
after payment of the balance of total sale consideration, the vendee shall be the sole
owner of the said property and shall hold, occupy, and possess full possession of the
same to which the vendor shall have no claim and concern.
That irrespective of the agreed sale consideration, the purchaser/ vendee by just to avail
the relief/concession in payment of stamp duty on execution of sale deed against the
subject house/ flat right to fix face value thereof according to the valuation table provided
by provincial Govt. U/S 27-A of the stamp Act or equal to the amount to be sanctioned
by the HBFCL for its investment, whichever is higher.
That the vendor shall be responsible to pay all the dues, taxes and charges including
property tax, water tax, electricity charges, gas charges, fire and conservancy and /or all
other taxes/charges payable to the Local, Provincial, or Federal
Governments/lessee/lessor and /or any other concerned authorities up to date and
thereafter, the vendee shall be responsible to pay the same.
That the vendor hereby assures and covenants with the vendee that he is the full owner of
the said property, which is free from all sorts of claims, litigation, liens, charges, and
encumbrances, whatsoever in nature, and that he has good right/ title and lawful authority
to sell the said property to the vendee in all respect.
That the vendor hereby further undertakes to indemnify the vendee against all losses or
damages, if any, caused due to mis-statement/concealment of facts or any defect in title
of the said property.
That the vendor and his successors further agree to be ready and prepared to sign all such
application papers, deeds, and documents, whenever needed, or clearance of total sale
consideration as they agree and appear before the authorities concerned, whenever
required, in connection with registration of Sale Deed and /or Transfer/Mutation of the
said property in favor of the Vendee.
That the vendor, hereby, declares that he/she has not entered into any agreement or
negotiation of sale, gift, rent, etc. of the said property prior to this agreement of sale with
anyone.
That Both the parties hereto agree to abide by the terms and conditions of this agreement IN
WITNESS WHEREOF both the parties have set and subscribed their respective hands on the
day, month and the year mentioned above in the beginning.
