MODULE 2 UNIT 1 ELABORATE

In not more than 5 sentences, give illustrative examples for each: (CHOOSE 5
ONLY)

1. Conspiracy
In the crime of conspiracy, there's an agreement between two or more
people to commit an illegal act or crime. According to the legal maxim that
"the act of one is the act of all," this agreement and cooperation constitute
a conspiracy that justifies holding everyone equally responsible. For
instance, Potchi and Mimi conspire and plan to kill Barney in the restroom
and stab her with a knife. However, whether or not they carry out the illegal
act, they are both still guilty of conspiracy. In the second case, if Potchi
and Mimi had succeeded, they would have committed murder rather than
attempted murder.

2. Self-defense
Self-defense occurs when people protect themselves from harm and
respond with violence or force, but it has a perfect or imperfect defense
depending on the circumstances. In addition, given that it almost always
entails the use of force, self-defense can be used as a reason for assault
and criminal homicide. For instance, Charlie walks along the Quiapo to
attend the mass and pray for her family. But Angelo, a robber in Quiapo,
threatens Charlie with a gun until she gives her wallet to him. However,
Charlie didn't give her wallet but instead protected herself from the gun
and responded by assaulting Angelo.

3. Irresistible Force
When a perpetrator employs violence or physical force to compel another
person into committing a crime, that situation is an irresistible force.
Furthermore, the compulsion is through physical force, and physical force
must be irresistible and must come from a third person. For example, a
fraternity leader coerces members to commit hazing to welcome newbies.
However, the members disagree with doing the hazing for some reason.
Then, the fraternity leader employs brutality of physical force like beating
and paddling that causes his member to commit hazing.

4. Passion or Obfuscation
A crime of passion is committed under extreme rage or emotional
disturbance. Crimes of passion are frequent for many reasons, including
strong emotions like fear, vengeance, rage, and jealousy often drive
them. An example of a crime of passion is when Juanico, the husband
of Wannabee, catches her cheating with Salvi. In a jealous rage,
Juanico shoots her wife, Wannabee, because he saw them kissing at
their house. Juanico chooses to assault Wannabee out of anger for
being broken up because he didn't have enough time to cool off before
shooting her wife.

5. Recidivism
Criminal recidivism is the act of engaging in criminal activity after being
released from jail or prison, which leads to arrest and re-arrest. It
involves committing an illegal act once more after receiving punishment.
For instance, BabyM is released from prison after committing robbery
and stealing charges and returns to its group, Corrputkami. This group
steals money every day because this is their income source. Since
BabyM was released from prison, he repeatedly and immediately stole
a car parked outside the police station, this is an act of recidivism.
