Heard Mr. Salve, learned senior counsel for the petitioner and Mr.
Sibal, learned senior counsel for the respondent-State.

2. Because of paucity of time, we could not continue with the

hearing today. The hearing will be resumed on Friday i.e., 12.06.2020.
To be taken up as the first item on board.

3. It is submitted by Mr. Salve that police of Pydhonie Police Station

has summoned the petitioner to appear before it tomorrow i.e., on
10.06.2020 in connection with FIR No.137 of 2020. The said area has
been declared as a containment zone. Therefore, petitioner going to the
said police station in the midst of the pandemic won’t be safe; besides

there being no urgency at all. On the other hand, Mr. Sibal submits that
petitioner cannot dictate to the investigating authority when he will
appear or whether he will appear. However, petitioner may appear before
the N.M. Joshi Marg Police Station where he had appeared earlier in
connection with F.I.R.No.164 of 2020.

4. That being the position, petitioner may appear in N. M. Joshi

Marg Police Station in connection with F.I.R.No.137 of 2020 registered
under Sections 153, 153-A, 295-A, 500, 505(1)(b), 505(1)(c), 505(2),
511 and 120-B IPC by the police of Pydhonie Police Station.

5. Since we are in the midst of hearing no coercive action against

petitioner shall be taken though he shall appear before the police as
directed above.

6. List on 12.06.2020 as already ordered.

7. This order will be digitally signed by the Private Secretary of this

Court. All concerned will act on production by fax or email of a digitally
signed copy of this order.
