Re: DEMAND TO VACATE THE PROPERTY OWNED

BY MR. D.W. LEE

We write on behalf of our client MR. D.W. LEE relative to the

above-captioned matter for the property located in Antipolo City.

It has been disclosed to us that Mr. D.W. Lee inherited a parcel of

land in Antipolo City from his deceased parents. When the parents of our
client are still alive, they allowed your family to put up a structure in
order to avoid trespassers/squatters in the subject property. However,
when his parents died, he intends to sell the same but no prospective
buyers would consider purchasing the property if there are occupants
therein. In this regard, our client demanded you to vacate the property in
order to sell the same. Nevertheless, you refused to vacate the property
and demanded compensation for supposedly being caretakers of the
property for the total number of years you resided therein.

In consideration that there is no stipulation between you and our

client’s parents that you are entitled for compensation for occupying the
subject property as caretakers, our client is under no obligation to tender
payment for the number of years you resided therein. Tender of payment
is likewise not a condition for you to vacate the subject property.

Due to the foregoing, we hereby make a final demand upon you to

vacate the property within fifteen (15) days from receipt of this letter.
Otherwise, we shall be constrained to institute appropriate civil
complaint against you. Please bear in mind that you shall be held
accountable for interests, damages, attorney’s fees and other expenses
that our client shall incur arising from the possible unlawful detainer
suit if you fail to vacate the property within the said period.
