RE: DEMAND TO VACATE AND PAY ACCRUED MONTHLY RENTALS

Dear Mr. Oliveros:

My client, Ma. Teresita Mijares, has referred to this Office for


appropriate legal action your unlawful possession and non-payment of
rentals on her land situated in San Agustin, Caloocan City which you and
all persons claiming right and interest over the said property have
perpetrated to the damage and prejudice of my client who is the real
owner of said land.

Despite repeated verbal demands, you failed and still fail to comply
with the demands of my client. Hence, we are formally serving this
DEMAND for you to vacate the land in question within 30 days from the
date of receipt of this letter and pay reasonable rent in the amount of
Php___________.00 from ______________________, within five (5) days
from receipt hereof and. Otherwise and much to our regret, we would be
constrained to CIVILLY CHARGE YOU before the appropriate courts, if
legally warranted and/or CRIMINALLY PROSECUTE YOU for Usurpation
of Real Property under the Revised Penal Code, as the evidence may
warrant, and recovering actual, moral, exemplary and nominal damages,
litigation expenses, and attorney’s fees.

In order to avoid the embarrassment and discomfiture of court


litigation and incur unnecessary expenses, we strongly suggest that you
comply with our client’s demands within the above-mentioned periods
upon receipt of this letter. Should you have any questions regarding this
matter, please confer immediately with the undersigned counsel’s
telephone number indicated hereunder from Mondays to Fridays
between 9:00 a.m. to 6:00 p.m. or directly contact our client to settle the
matter before court action.
