Sub- Permission to mortgage for flat no. 303 on the Third floor Building No-A2 of the building
proposed to be named as / named as SHADAWAL IMPRESSIONS situated at Palghar-Boisar
Road, Vill-Saravali, Boisar (West) Dist-Palghar-401504

1. This is to confirm that we have allotted/ sold flat/ shop no 303 admeasuring 32.79 Sq. mtr.
(carpet area) on the Third floor of the building proposed to be known as SHADAWAL
IMPRESSIONS situated at Palghar-Boisar Road, Vill-Saravali, Boisar (West) Dist-Palghar-
401504 under construction/ constructed by us to Ms. SHADAWAL ENTERPRISES (‘the
Seller’) for a total consideration of Rs. 16,81,000/- (Rupees Sixteen Lakhs Eighty One
Thousand only) under an Agreement for Sale/ Sale Deed at PALGHAR dated PALGHAR-2-
5338-2016 Dated-28/12/2016.

2. We confirm that we have obtained all requisite permissions/ approvals/ sanctions for
construction of the said building from all the competent authorities and the construction
of the building as well as the flat are in accordance with the approved plans and
permissions.

3. We assure that the said flat as well as the said building and the land appurtenant thereto
are not subject to any encumbrance, charge or liability of any kind whatsoever and that
the entire property is free and marketable. We have a clear, legal and marketable title to
the said land and building and every part thereof.

4. The Seller has paid an amount of Rs. 16,81,000/- (Rupees Sixteen Lakhs Eighty One
Thousand only) the total cost towards the cost of the said flat.

5. Possession of the said flat has already been given to MR.KISHOR DAADU
AWALEGAONKAR & MRS.SWAPNALI KISHOR AWALEGAONKAR on 02/06/2017 With Rs.
16,81,000/- (Rupees Sixteen Lakhs Eighty One Thousand only) as Full & Final
Consideration.

6. We are aware that the said Seller has agreed to sell the said flat and all his/ her/ their
right, interest and title therein to MR.ASHOK SOMNATH AND MRS.SUMITRA BHUSARE
(“the Purchaser “) under an Agreement for Sale/ Sale Deed dated __________________
and that the said the Purchaser has approached to Jana Small Finance Bank Limited for a
loan for purchasing/ acquire the said flat and that Jana Small Finance Bank Limited has
agreed to sanction/ grant the loan to the Purchaser to purchase/ acquire the above flat
and the Purchaser has agreed to mortgage the said flat in your favour as security for the
said loan.
7. We hereby confirm that we have no objection to mortgage the said flat and shall transfer
the said flat to the name of the Purchaser, in our books on completion of the sale
formalities between the said Seller and the said Purchaser.

8. Notwithstanding anything to the contrary contained in the said Agreement for Sale/ Sale
Deed, we confirm to register the aforesaid charge in our books in respect of the said flat
on completion of the sale formalities as aforesaid and the said Purchaser will not be
permitted to transfer/ cancel, assign, sell off/ or in any other way/ manner deal with the
said flat prejudicial to the interest of the Jana Small Finance Bank Limited or without the
prior written consent of the Jana Small Finance Bank Limited.

9. We undertake to form a Co-operative Society/ Apartment/ Condominium under the


applicable provisions of state/ central act in the aforesaid building within the statutory
period. And we agree to inform and give proper notice to the Co- operative Society/
Apartment/ Condominium as and when formed, about and said flat being so mortgaged to
Jana Small Finance Bank Limited.

 This NOC is to be signed on behalf of the Developer/ Builder by the same persons who have signed
the Agreement for sale/ Sale Deed in favour of the Purchaser/s (Borrower/s) or any person
authorised by the Developer/ Builders to sign on their behalf.
 Point No. 4&5- The not applicable clauses in ‘OR’ may be deleted and keep only which are
applicable.
