Voicemail message to Desiree Yagan. Judge James Murphy’s secretary on Aug 28, 2020 left
message: "Desiree, 17 Emails Quarantined by our Court System have been Released”.

VOICEMAIL MESSAGE (EVIDENCE OF ILLEGAL SEIZURE) PUBLISHED ON YOUTUBE

I had called and told her my emails to Judge Neri’s Law Clerk Schepp and his Secretary, -- - who
provided me their Emails, Onondaga County Law Librarians: Barbara Turner and Ellen Fuller and
subsequent letter to Judge Murphy re Emails to 'Court Staff and Supreme Court Law Librarians ***
'Not Found". I asked that she look into this matter with IT Department.

On Aug 28, 2020 received message from Judge James Murphy, Administration Law Judge for the
Fifth Judicial District secretary. Barbara Kowell looked into why Emails within the Court System
were No longer Received. i.e. “Not Found”.

Barbara Kowell Secretary to Judge James Murphy, Administration Law Judge for the Fifth Judicial
District, pursuant to our conversation about Emails missing - Intercepted by IT.

Emails to Judge Neri's Law Clerk Schepp and Secretary Lamont Both who provided their emails,
Onondaga County Supreme Court Law Librarians, Barbara Turner and Ellen Fuller and subsequent
letters to Judge Murphy, Not Found. Requested investigation into seizure: Desiree Yagan’s Emails.

OCA IT DEPT NTERCEPTING MY EMAILS HAS CONTINUED. THIS IS ILLEGAL AND I WANT
ANSWERS. MOST RECENT ILLEGAL SEIZURE OF EMAILS OCCURRED PAST FEW WEEKS:

March 8, 2023 Email to Liverpool Village Police Chief Unger and Sgt Sturtz. Inquired about
2013 Police video. *April 11, 2013 Surveillance video Posted (2020) on YouTube Channel.

On April 4, 2023 Email to Liverpool Village Court, Kristen Marshall secretary to Judge Lavalle.
Requested information: Certificate of Dispositions in (3) court cases. Kristen Marshall replied.
Email with an attached Certificate of Disposition Form.

CERTIFICATE OF DISPOSITION REQUEST FORM WAS DIFFERENT FROM ALL FORMS I HAVE SEEN.
LIVERPOOL COURT’S FORM INCLUDED A “WAIVER OF LIABILITY” REQUIRED IT NOTARIZED.

On April 11, 2023 I Emailed Ms. Marshall's NYS OCA official Form. Asked if Judge Lavalle would
accept the form. I also asked about “Waiver of Liability “included on the court's version of the
Certificate of Disposition Request Form. I then called to confirm my email to her was received.
She advised Email “Not Found”.

On April 17, 2023 called Chief Bizgia, head of Onondaga County Courthouse Security. Left
messages with Chief Bizgia and Captain Kovalsky re: April 17, 2019, Security Camera Video.
Stated I wanted to obtain CD of preserved Courthouse Security Videotape. No contact and
Anxious for Answers on Process, I called OCA Counsel's Office Chief Counsel, Anthony Perri.

Staffer answered. I asked for the Phone Number of the Office of Public Safety (DPS). As I Need
information on obtaining CD Onondaga County Courthouse Surveillance video. She DID NOT
give a phone number. She instead, transferred me to Dept of Public Safety. Captain Rabinovicz
answered and advised, that I need the dates and labels For DPS to retrieve the archived video.

Next day, I called and talked to Captain Kovalsky who said he would Email the video Labels and
Time Stamps. Captain Kovalsky sent Email with Security Camera Video labels which I Received.

PREPARED LETTER TO OCA CAPTAIN RABINVICZ, CHIEF BIZGIA AND CAPTAIN KOVALSKY
INCLUDED EXCEPTS OF PREVIOUS CORRESPONDENCE VIA EMAIL AND HAND DELIVERED

(2020-2022) Email Correspondence to Chief Bizgia and Captain Kovalsky recounting April 17, 2019
arrest inside Supreme Court Law Library. Charged w/‘Failure to Appear’ in Liverpool Village Court
on Local Sign Violation. *Previous Correspondence Stressed Importance of Preserving Surveillance
Videotape. Email on April 19, 2023 included Original FOIL & Preservation Letter (May 3, 2019).

Letter Sent April 19, 2023 total 12 pages which were scanned with previous Email correspondence
(truncated) and May 3, 2019 FOIL Request "Not Found". Letter was Hand Delivered April 20, 2023.
To notify IT Director i added a Text box on Letter. Requested Phone and Name of Director of IT.

Letter to Chief Bizgia and DPS accepted by Onondaga County Courthouse Security. At my request
Sargent Ramos signed my copy (Attached).

FOIL ALL RECORDS ON DESIREE YAGAN’S EMAILS & IT DIRECTOR SASARIO’S PHONE NUMBER

Request Letter from Chief Counsel Millett and Deputy Counsel addresses confirming Email was
received. In addition to IT Director's Name and Phone Number and FOIL Request Acknowledged.
Request all Records citing Desiree Yagan to IT Director & Staff relating to Emails in Court System.

Again i stress the seriousness of OCA IT Department intercepting a citizen's email. Obstructing
citizen’s right to communicate with the Courts and OCA Counsel. Prevents communication with
Court Employees, State & Local Courts, Judges, UCS Staffers, and Department of Public Safety.

Be advised my rights have been egregiously violated within the NYS Court System. OCA Chief
Counsel and Deputy Counsel have Ethical Duty when informed about such illicit acts.
