Under new electricity law (Law No. 30 of 2009), which is followed by related Government Regulations, PLN, the State Electricity Company, is no longer
a PKUK (Government Authorized Agency) but a PIUKU (License Holder) as any other business entity supplying electricity for public interest. The
electric power business for public interest consists of generation, transmission, distribution and/or retail as separate activity; however a BUMD (Regional
Government Owned Company), private or Cooperatives may combine those activities as an integrated electricity business area which will be determined
by the Government.
All existing regulations such as Government Regulations, Presidential and Ministerial Decrees which were enacted based on Law No. 15 of 1985 will remain
in full force as long as they are not in contrary to the intent of or replaced pursuant to Law No. 30 of 2009.
In mega size projects, the Independent Power Producer (“IPP”) developers shall primarily show sufficient financial strength, IPP Project Development
Experiences, and proven ability to raise equity and debt financing for IPPs, and together with its partners have proven construction experience in similar
power plants, relevant O&M and related fuel supply management experience. The general requirement on small scale projects is less stringent. These
issues could be obtained through the appropriate documents issued by PLN during the procurement process.
