ALTERNATE DISPUTE RESOLUTION (ADR)

PART - A: RECORD ON TOPICS FROM UNIT I TO III (40 MARKS)


INSTRUCTIONS:
1) All Questions are compulsory for completing this Part.
2) All the questions shall be handwritten in the Diary provided to Students/same is availab le
in College Office.
3) Every answer must be minimum of 4-5 pages.
4) The answer must include the relevant provisions of law, case laws, examples wherever
required.
5) The Viva- voce will be conducted on the Basis of Part-A and Part- B Record and ADR
Proceeding and Observation of Students in Court Visit, Lok-Adalat.
6) The Record must be neat and clean; all headings and subheadings should be highlighted.
7) All the students shall submit Practical Record on or before 15th May 2023.

1) Explain Alternative Dispute Resolution? What are the advantage and disadvantages of
Alternative Dispute Resolution?

2) Write in detail historical background and development of laws relating to Alternative


Dispute Resolution in India.

3) Write Aim and Object and Salient features of The Arbitration and Conciliation Act,
1996.

4) Define Arbitration and write essential features of Arbitration? And difference between
Arbitration and Conciliation.
5) Define Arbitration Agreement? Explain “Arbitration agreement is the foundation stone
of arbitration, without which arbitration cannot take place.”
6) Explain what is Arbitral Award? Discuss the grounds and circumstances on which the
court can set aside the arbitral award.

7) State the difference between Negotiation, Conciliation and Arbitration. Which of these
is most appropriate one according to you? Explain.

8) Explain the procedure of appointment of an Arbitrators and termination of mandate and


substitution of Arbitrator.

9) State the grounds for challenging the appointment of Arbitrator and procedure thereof
under the Arbitration and Conciliation Act, 1996?

10) State the provisions relating to conduct of Arbitral proceedings.

11) Write in details Power of Court and Arbitration Tribunal to invoke power to grant reliefs
u/Sec. 9 and U/Sec. 17 of the Arbitration and Conciliation Act, 1996, State when can a
Court refer a matter to arbitration under Section 8 of the Arbitration and Concilia tio n
Act. 1996.

12) Examine the provisions of the Arbitration and Conciliation Act, 1996 regarding the
appointment of a conciliator and the role of a conciliator in the settlement of disputes.

13) State in brief the provisions relating to enforcement of foreign Award with reference to
New York Convention.

14) Examine the concept of Unilateral, Bilateral and Triadic (third party) intervention in
Alternative Dispute Resolution.

15) Write a note on Lok-Adalat, and state the Power and Jurisdiction of Lok-Adalat.

16) Write a note on Lokpal and Lok-Ayukta.

17) Write a note on Mediation? And difference between Mediation and Negotiation.

18) What is mean by Negotiation? state the essentials, techniques and processes of
Negotiation.

19) Write in details Section 89 and Order X Rule 1A, 1B, 1C of C.P.C. with reference to
Arbitration.

20) Write in details the Role played by Family Court as alternative dispute resolution.
