RESIDENTIAL LEASE AGREEMENT

LEASE AGREEMENT, made between:

KENNETH J SCHACKAI (LANDLORD)

AND

SARAH SUMPTER & TREY KELLY (TENANTS)

For good consideration it is agreed between the parties as follows:

1. Landlord hereby leases and rents to Tenant the premises described as follows:

Unfurnished Three Bedrooms/Two bathrooms House

Address – 4108 N 23rd St, Waco, TX 76708.

This Term of Lease is on a Monthly basis, to commence at 10:00 am on July 1st 2023. Tenant will pay subsequent

rent on or before the 3rd of every month. A 14 days notice move out date will be required in case of a month to

month lease.

• Full payment of One thousand three hundred and sixty Dollars (utilities bill included (water & sewer,

electric and gas)) monthly in advance to my Attorney via Cashapp/zelle or cash deposit /wire transfer. Receipt will

be given through email by Landlord upon payment confirmation and there won’t be no increase in the rent fee for a

year(month to month). The Tenant is able to cancel the lease within the 3 days of occupancy in any case of

dissatisfaction, difference in Facebook group ad pictures or prior communication and agreements considering that

tenant didn't get to view unit prior to signing contract. Immediate refunds will be coordinated in which Tenant stands

to forfeit $100.00 of the first month rent refund in this case.

Late fees will be charged as follows: $25 if later than the 7th of each month,

Tenant shall at its own expense provide the following utilities: Cable, Trash & Home phone, if used

• Insurance: Tenant acknowledges that OWNER's insurance does not cover personal property damages caused by

fire, theft, rain, war, acts of God, acts of others, and/or any causes, nor shall OWNER be held liable for such losses.

Tenant is hereby advised to obtain his/her own insurance policy to cover any personal losses.

• Tenant further agrees that:

a) Tenant must meet guests at the Front Door or inquire of owner if door may be left open for guest.

b) Upon the expiration of the lease it will return possession of the leased premises in it's present condition,

reasonable wear and tear excepted. Tenant shall commit no waste to the leased premises.

c) It shall not assign or sublet or allow any other person to occupy the leased premises without Landlord's

prior written consent. (Guest staying longer than 3 weeks.) Rental is for individual said tenants only.
d) It shall not make any material or structural alterations to the leased premises without Landlord's prior

written consent.

e) It shall comply with all building, zoning and health codes and other applicable laws for said leased

premises.

f) It shall not conduct a business deemed extra hazardous, a nuisance or requiring an increase in fire insurance

premiums

g) In the event of any breach of the payment of rent or any other allowed charge, or other breach of this lease,

Landlord shall have full rights to terminate this Lease in accordance with State Law and reenter and claim

possession of the leased premises in addition to such other remedies available to Landlord arising from said

breach.

• This Lease shall be binding upon and inure to the benefit of the parties, their successors, assigns and personal

representatives.

• A month rent will be prorated ($1360 utilities bill included). (move in date – July 1st, 2023). Total amount to

move in: first month rent & Security deposit : $1360 + $650= $2,010 (Total).

• The said tenant will stay in the Unit for a year with an extension possibility. Starting July 1st, 2023 to July 1st, 2024

The landlord and tenant have fully affixed their signatures on this April 5th, 2023.
